Dear Sir:
Regarding your inquiry, the South Miami zoning district for the above property is "RS-4"
Single Family Residential. Based upon the City's Land Development Code regulations
this site is non-conforming because the lot frontage is below the minimum required 60
feet in the RS-4 district. Therefore a new building on this lot can not be constructed
without a variance being granted or a zone change.
A copy of the RS-4 zoning district regulations are attached.

ARTICLE III. ZONING REGULATIONS
20-3.1 Zoning use districts and purposes.
(A) Zoning Districts Established. In order to implement the intent of this Code and the
city's adopted Comprehensive Plan, the City is hereby divided into eighteen (18) zoning use
districts with the symbol designations and general purposes listed below and permitted uses
set forth in Section 20-3.3(D). A planned unit development (PUD) district is also created in
Section 20-3.7. Standards shall be uniform throughout each zoning use district. District
symbols and names shall be known as:

a Cumulative width of both side yards shall be not less than 20 percent of total lot width.

Mr. Jackson received a notice on 9/29/92 to submit a plan within
30 days for cleaning his property. Donna Gordon of DERM met with
Mr. Jackson on 10/21/92, which was within that 30 day period. Due
to Mr. Jackson's inability to read and write, he was not able to
provide a written proposal, therefore, a verbal agreement was
established. This agreement is in three phases and includes all
previously established time-tables.
PHASE I: On November 6th, a DERM inspector will meet with Mr.
Jackson at the property where Mr. Jackson will set aside all solid
wastes and chemicals such as acids, paints, etc. The Program
Manager has approved his taking these items on November 7th and 8th
for disposal at a, minimum fee at Joe Robbie Stadium. Mr. Jackson
will receive a receipt as proof of his having disposed of these
items.
PHASE II: Mr. Jackson will be required to clear the property of
tires, shopping carts, etc. (The time-table on this, which could
be . as long as 45 days, will be determined by the DERM inspector
after Phase I is in compliance. )
PHASE III: Mr. Jackson must provide DERM with proof of excavation
(disposal of soils) and re-sampling. If this cannot be done due
to lack of funds, DERM will do the re-sampling to ensure
compliance.
If the DERM inspector finds that Mr. Jackson has made no effort to
clean this property, he will be given Notice of 30 days in which
to comply. An inspection will be made at the end of the 30 days
following which he will be allowed an additional 10 days. At the
end of this period of time, if Mr. Jackson has done nothing to
indicate that he intends to comply with these requirements, court
action will be brought against him, which could result in
penalties.
Donna Gordon will FAX copies of inspections reports to us as they
become available.
DERM will not enforce removal of vehicles and/or other junk. The
City of South Miami is responsible for this action as well as
removal of the unsafe structure on the site.
