Dear Mr. ert:
A couple of issues remain outstanding with the recently installed fence and the gates.
The City :would appreciate your full cooperation in getting these issues resolved. The
outstanding issues are as follows:
1) The location of the fence remains a question. As previously requested please
provide the City with documentation to indicate that the fence has been installed as
indicated on your permit plans. The fence must be located on or within the property line.
Mitigation: Please provide a sealed and signed survey indicating the fence location in
relationship to your north property line.
2) As you know, your driveway encroaches on your neighbors' properties.
Consequently, the gates installed across your driveway encroach on your neighbors'
properties as well and is blocking their access to a portion of their property.
Mitigation: As I recommended to you early on, please address the driveway issue with
your neighbors in order to establish a permanent legal arrangement for your driveway and
remove the portions of the gates that are not on your property at your earliest. Please
provide a sealed and signed survey to document the final disposition of the driveway.

Please be advised that Mr. Colbert did provide this office with a professional land survey of his
property. Based upon a review of the survey , the recorded easement, and a field inspection, the
following information is provided:
(1) At Mr. Colbert's front driveway leading to his backyard, one half. f the entrance gate is on
your property;

(2) Mr. Colbert's driveway and gates are within his 10 feet of the 20''wide easement shared by
both of you;
(3) Your 10 feet of the easement appears to be occupied by hedges and a wood fence.
It is your option to decide if you want to enforce the conditions of the easement at the driveway
entrance area.zThis is essentially a private matter between two neighbors and I would encourage
you to communicate with Mr.Colbert.

In the matter of the fence and gates that were constructed at the subject
address, I have not received a response at this time. This issue has been
pending since March, with the last correspondence from the City to Mr.
Colbert, more than a month ago. In that letter, Subrata Basu, the Planning
and Zoning Director requested a sealed property survey from Mr. Colbert.
The purpose was for Mr. Colbert to show how he was legally entitled to
close off a;: right-of-way that included a portion of my property, denying me
access. The request was made subject to Mr. Colbert's "earliest"
convenience. I do not find that acceptable, all requests should have a
date/deadline for compliance. Please advise what action has occurred or
will occur at this time. Thank you for your consideration.
