The.City would appreciate your full cooperation in getting these issues resolved. The outstanding issues are as follows: I 1) The location of the fence remains a question. As previously requested please provide the City with documentation to indicate that the'fence has been installed as indicated on your permit plans. The fence must be located on or within the property,line. Midi ation: Please provide a sealed and signed survey indicating the fence location in relationship to your north property line. 2) As you know, your driveway encroaches on your neighbors' properties. Consequently, the gates installed across your driveway encroach on your neighbors' properties as well and is blocking their access to a portion of their property. Mitigation: As I recommended to you early on, please address the driveway issue with your neighbors in order to establish a permanent legal arrangement for your driveway and remove the portions of the gates that are not on your property at your earliest. As you are aware, the chain link fence was installed without a permit and this type of fencing is prohibited adjacent to the public right-of-way. i Residents agreed to accept the chain link fence provided the following: 1) Landscaping would be installed on both sides of the fence. This would be a permanent condition of approval and would be recorded with the County Clerk in order to insure that the current or future1and owners be required to maintain said landscape. 2) All building requirements (including inspections) must be adhered to including sign and sealed plans demonstrating that the installed fencing meets all current building codes. 3) All fencing must be outside of the right-of-way and easements. It appears that the existing fence is installed approximately twenty feet from the centerline of the roadway and is therefore installed within the right-of- way. The approval of a permit should not have been granted until all iof the above issues were satisfied. The permit approval process is this case is contrary to the requirements that any City of South Miami resident would have to follow if they had applied for a permit prior to construction. Attached please find the fence regulations from the City o p ( ) Regarding the fence you have installed on S.W. 63`a Street, it does not meet the regulations of the LDC because chain link fences are prohibited in the required setbacks adjacent to public rights-of-way. As an alternative, you may install a wooden fence, at a similar location as the existing chain link fence (along the property line as determined by a survey). The fence regulations specify that you may build a solid wooden fence up to four(4)feet high, and it may extend up to six(6)feet high if the top two feet remains at least 60 percent open (see diagrams in attached fence regulations for more details). No City of South Miami regulations exist regarding which side(finished or unfinished)must be placed facing outward;you may choose either way. We have also discussed with you and Mr. Ribas the possibility that the existing chain link fence might remain, to be covered up with the hedge landscaping that is growing along the fence. While it may be more aesthetically pleasing to have the landscaped greenery covering and hiding the chain link fence, technically it is still against the code. However, in this one instance,where you have had discussions with the neighboring property owners to try to reach agreement, the City may be willing to allow this alternative, if you have the assent of all neighboring property owners affected. The condition would be that the fence must be completely covered by landscaping on both sides of the fence; the building permit, with this permanent condition of approval included,would need to be recorded with the County Clerk. Please note, however, that this would be a one time only approval, for this unique situation only, where the property goes end-to-end between streets, and other mitigating factors. W. 64TH STREET 7 i DATE: July 17, 2003 1 Commissioner Wiscombe received a complaint from Ms. Marie Valente pertaining to a recently installed fence and gate at the subject property,;which is owned by Mr. Carl Colbert. She is alleging that the fencing encroaches on a neighboring property. Planning Director Subrata Basu has reviewed the situation and has requested Mr. Colbert to provide documentary evidence that the fence is located on his property. The City would appreciate your full cooperation in getting these issues resolved. The outstanding issues are as follows: 1) The location of the fence remains a question. As previously requested please provide the City with documentation to indicate that the fence has been installed as indicated on your permit plans. The fence must be located on or within the property line. Mitigation: Please provide a sealed and signed survey indicating the fence location in relationship to your north property line. 2) As you know, your driveway encroaches on your neighbors' properties. Consequently, the gates installed across your driveway encroach on your neighbors' properties as well and is blocking their access to a portion of their property. Mitigation: As I recommended to you early on, please address the driveway issue with your neighbors in order to establish a permanent legal arrangement for your driveway and remove the portions of the gates that are not on your property at your earliest. Please provide a sealed and signed survey to document the final disposition of the driveway. Thank you for,your prompt attention to these matters. Regarding the fence you have installed on S.W. 63`a Street, it does not meet the regulations of the LDC because chain link fences are prohibited in the required setbacks adjacent to public rights-of-way. As an alternative, you may install a wooden fence, at a similar location as the existing chain link fence (along the property line as determined by a survey). The fence regulations specify that you may build a solid wooden fence up to four(4)feet high, and it may extend up to six(6)feet high if the top two feet remains at least 60 percent open (see diagrams in attached fence regulations for more details). No City of South Miami regulations exist regarding which side(finished or unfinished)must be placed facing outward;you may choose either way. We have also discussed with you and Mr. Ribas the possibility that the existing chain link fence might remain, to be covered up with the hedge landscaping that is growing along the fence. While it may be more aesthetically pleasing to have the landscaped greenery covering and hiding the chain link fence, technically it is still against the code: However, in this one instance,where you have had discussions with the neighboring property owners to try to reach agreement, the City may be willing to allow this alternative, if you have the assent of all neighboring property owners affected. The condition would be that the fence must be completely covered by landscaping on both sides of the fence; the building permit, with this permanent condition of approval included,would need to be recorded with the County Clerk. Please note, however, that this would be a one time only approval, for this unique situation only, where the property goes end-to-end between streets, and other mitigating factors. The City would, in all cases, continue to enforce the fence regulations as they are in force in future. Please contact us at(305)673-6327 if you have any further questions.
