WHEREAS, JAMES W. GOULD duly made application for a variance so as to permit the construction of a non- conforming swimming pool on the lands hereinafter described, and WHEREAS, the Planning Board of the City duly held a public hearing on said application on the 30th day of January, 1968, and recommends that the variance be granted, and WHEREAS, after the holding of a duly advertised public hearing, the City Council finds that the existing zoning requirements cause ,an undue and unique hardship as applied to the particular property, and .that the variance sought would not be detrimental to the surrounding and abutting properties; BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF CITY OF SOUTH MIAMI, FLORIDA: 1. A variance is hereby GRANTED so as to permit the construction of a non-conforming swimming pool with, a rear . setback of 10'4" on those lands legally described, as, to-wit: Lot 8, Block 3, TRANQUILITY ESTATES, according to the Plat thereof as re- corded in Plat Book 78 at Page 64 of the Public Records of Dade County, Florida, a/k/a 6825 SW 64 Street. 2. PROVIDED, HOWEVER, that in the event a building ` . permit is not filed with the City within 180 days after the date of the adoption of this ordinance, the variance granted herein shall become null, void and of no force and effect without further Council action and the property shall revert to its prior zoning rights. 3.
