My intentions are to construct a structure with a size of 35' x 40' in the southwest rear corner of my property located at 6800 SW 64th Street. The structure will of course meet. all the codes and standards required for City of South Miami approval. There is currently a slightly smaller structure that I have received permit to demolish. I intend to replace the old structure with the new structure described above. The purpose of this letter is to confirm that I can construct the new building with the same 5' setbacks presently used by the current structure. I need these set backs to avoid the removal of some very large trees that I would prefer to leave in place. I am also hesitant to remove the old structure without your approval of these setbacks. With your signature below confirming that I can indeed use 5' setbacks I can begin the expense of having the architect begin work on the designs. Currently, Greenberg Traurig, on behalf of a neighboring property owner, is investigating the zoning of the property in order to determine if the 2 on-site accessory structures can legally be utilized as dwelling units. Per the current LDC, the property is zoned RS-1 and does not permit accessory dwelling units. However, unlike the Colsky case, I believe that accessory dwelling units may have been permitted at this address up until 1971 (please see case file faxed to your attention). Are there,any City-records which show the subject property located in a zoning district other than the "RS-1, Single-Family, Estate Residential? Yes. Please find the following zoning history. The subject property was platted in 1937 as Tract 14 of the "Nelson Homesites" Subdivision, comprising 1.989 acres, more or less, all lying and being in the City of South Miami, as recorded in Plat Book 39 at page 57 of the public records of Dade County. The zoning map approved in 1938 as part of Ordinance No. 98 demonstrates that the subject property was within the boundaries of the City, but it was not depicted as being in a zoning district. (See attachments) According to Miami-Dade County Records, the structures on the subject property were built in 1946. (See attachments) A zoning map in the City Clerk's Office, dated 1965, depicts the subject property as being zoned "EU-1." Currently, Greenberg Traurig, on behalf of a neighboring property owner, is investigating the zoning of the property in order to determine if the 2 on-site accessory structures can legally be utilized as dwelling units. Per the current LDC, the property is zoned RS-1 and does not permit accessory dwelling units. However, unlike the Colsky case, I believe that accessory dwelling units may have been permitted at this address up until 1971 (please see case file faxed to your attention). Therefore, I must determine if the buildings are nonconforming or illegal, per Section 20-4.8. Currently, I believe that the use of the accessory buildings as residences may be nonconforming, depending on whether or not"seventy-five percent or more of the gross floor area shall remain [or has been] vacant and unused for more than six months..." per Section 20-4.8(A)(6), in which case the use would be illegal. Are there,any City-records which show the subject property located in a zoning district other than the "RS-1, Single-Family,Estate Residential?" Yes. Please find the following zoning history. The subject property was platted in 1937 as Tract 14 of the "Nelson Homesites" Subdivision, comprising 1.989 acres, more or less, all lying and being in the City of South Miami, as recorded in Plat Book 39 at page 57 of the public records of Dade County. The zoning map approved in 1938 as part of Ordinance No. 98 demonstrates that the subject property was within the boundaries of the City, but it was not depicted as being in a zoning district. (See attachments) According to Miami-Dade County Records, the structures on the subject property were built in 1946. (See attachments) A zoning map in the City Clerk's Office, dated 1965, depicts the subject property as being zoned "EU-1." A definition of the "EU-1" zoning district was found in Ordinance No. 276, which was approved on June 15, 1954, and is attached for your reference. Please note that the attachment demonstrates that the "EU-la" zoning district specifically prohibited 2 separate dwelling units, but the EU-1 district did not. The zoning map approved in 1971 as part of Ordinance No. 20-71-724 depicts the subject property as "RS-1." The 1971 definition is attached for your reference. "City of Pleasant Living" The current code's definition of"RS-1" is also attached for your reference. 2. Does a CO for the subject property exist in the City's records? No. A CO for the subject property does not exist in the Planning& Zoning Department's records, however, approved permits from November 2, 1976, through November 3, 1993, are present as described in the attachment.
