( 2) In order to minimize the number of nonconforming lots, if two or more adjoining vacant and platted lots and/or parcels. with continuous frontage on a public street in continuous ownership since the time of passage of this Code, and if either or any of such lots or parcels individually is/are too. small in any dimension to meet the yard, width and lot area requirements of the district in which they are located, then such group of lots and/or parcels shall be considered as a single lot or several lots of such size as is necessary to met the minimum dimensional requirements of the district. (a) No portion of said parcel shall be used or sold in a manner which diminishes compliance with lot width and area requirements established by this Code. (b) No division of any parcel shall be made which creates a lot with width or area below the requirements of this Code. ( 3 ) If any person shall have at any time after passage of this Code created a lot or parcel which fails to conform with the dimensional requirements of the district in which it is located by selling part of a lot, such sale shall have no effect for purposes of this Code and the lots and/or parcels shall still be considered as part of one ( 1) or more lots. Shall mean a yard on the same lot with the building between the principal or main building and the adjacent side of the lot, and extending from the front yard to the rear yard thereof. ZONED RIGHT-OF-WAY. Shall mean the ultimate planned design width of a public street right-of-way as set forth in the City's adopted Transportation Element (See Rights-of-Way, Official) . Facts: The nursery property description included certain lots in the University Park Subdivision, and to the east of those lots, the western half of an alley which was abandoned by the City. Your Memorandum regarding ."Habitat Proposal Old Nursery Site" indicated that the alley was a part of a different (Franklin) subdivision, immediately to the east of the University Park Subdivision. 2 . Rule : Upon abandonment of `alleys, roads, etc. dedicated to the public in a plat, the pr.operty. r.everts to the immediately adjacent property owners in that plat. 3 . Conclusion : The City, as a property owner to the west of the abandoned alley In a different (University Park ) subdivision, could not have a reversionary right to abandoned land in the Franklin Subdivision In the east. Thus, the only immediately adjacent property owners in that (Franklin) plat were the property owners to the east of the alley. A . Resolution: A Quit Claim Deed from the adjacent property owners to the east in Franklin Subdivision to the City of South Miami , 5. Incentives The adjacent property owners in the Franklin Subdivision should be advised that, upon the addition of the western half of the alley to their land, the increase in property size should be worth more and could result in increased property taxes .
