Diaz Dear Mayor McCann: On January 19th, I accompanied Mrs. Maria Diaz to the scheduled hearing for the variance she is requesting. For some reason, no one contacted Mrs. Diaz to tell her that her petition would not be heard on that night, but would instead be heard on February 2nd. That being the case, I will be unable to be present for the proceedings as I will be in Tallahassee for the Legislative Session. Therefore, I respectfully request that this letter be placed in her file as testimony in favor of Mrs. Diaz's variance. I have known Mrs. Diaz for twenty-seven years and have seen all the homes that she has lived in. Being able to buy a home in the City of South Miami was a dream come true for her. However lately, it appears that the dream has turned into a nightmare. Since she moved into her current home six years ago, Mrs. Diaz, along with her husband and children, has been working hard to improve and beautify it. When she told me that Building and Zoning wanted her to knock down her columns and gate entrances, I was in shocked. Mrs. Diaz's residence is one of the most aesthetically pleasing homes in the area. Even her neighbors, who all signed the petition to have her variance granted, believe that what she has done has only improved the neighborhood and the property value of all their homes. I understand that Mrs. Diaz's columns are higher than what is stated in the building code, however, codes can be amended and in this particular case, it is to the benefit of the residence of Tranquility Estates that Mrs. Diaz's variance be granted because their neighborhood deserves to look beautiful. The applicant applied for approval of the subject gates at the Environmental Review and Preservation Board meeting on February 5, 1991. The gates were approved; however, the gates were NOT constructed as proposed, that is, according to the submitted plans; moreover, the applicant did not request a final inspection. The gates as constructed do not meet the Land Development Code (LDC) height requirement for residential fences because the gates are higher than 4 feet. Moreover, in order to bring the property into compliance, the applicant shall erect a fence around the pool in front of the property. Such fence shall be not more than 4 feet high. The applicant has applied for a variance to allow the existing gates to remain as constructed, and to be incorporated into the future fence. However, if such variance is granted, the existing gates shall be submitted for the ERPB re-evaluation because the gates as constructed did not follow the proposed design. A11 of this derives from the pool situation at the front of the house. i I must say that one of the things she took into consideration was the fact that she did not want to built a plain wall of 3 feet 4 inches high in front of her property, which would have been 150 feet accross. This would have looked inappropriate being her house located in the middle of the block. Ms. Diaz instead created this beautiful scenario which we all approve and enjoy every time we pass by, serving the purpose of hiding the pool from public view.
