DIAZ FROM THE PLANNING BOARD OF THE CITY OF SOUTH MIAMI, FLORIDA FOR THE PROPERTY KNOWN AS 6815 B.W. 63RD STREET, SOUTH MIAMI, FLORIDA 33143 (A SINGLE FAMILY RESIDENCE) AND LEGALLY DESCRIBED HEREINBELOW WHEREAS, Maria M. Diaz requested the Planning Board of the City of South Miami, Florida for a variance from section 20-3.6 (H)(2) of the Land Development Code of the City of South Miami to allow (two) gates about eight (6) feet high, where four (4) feet is allowed, in front of the property known as 6815 S.W. 63rd Street, South Miami, Florida 33143 (a single .family residential property), which property is legally described as follows: Lot 9 in Block 2 of TRANQUILITY ESTATES, according to the plat thereof, as recorded in Plat Book 78 at Page 64, of the Public Records of Dade County, Florida. . WHEREAS, Staff did not reccomend approval; and WHEREAS, on December 29, 1992, the Planning Board voted to recommend denial of the request by a 6 - 1 vote; and NOW, THEREFORE, 'BE IT RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. That the request of Maria M. (1) All fences, walls trellises and hedges may be erected on or along a property line, but shall not extend into official public rights-of-way or project on or over adjacent properties. ( 2) Height Limits (a) Fences, walls, trellises and hedges on or abutting property zoned or used for residential purposes shall not exceed four (4) feet in height above grade . in the required front yard, and no chain link fences shall be permitted in the required front yard. In the backyard fences, walls, trellises and hedges shall not exceed six (6) feet in height above grade. In no event shall this section affect any previously permitted fences, walls, trellises or hedges." (b)1' No fence located within a front setback zoned or used for residential purposes shall be greater than four feet in height above grade. (c) No fence located within a yard adjacent to a street or right-of-way shall be greater than four (4) feet in height above grade nor shall it be of chain link material. (d) Fences, walls, trellises or hedges on property zoned for anything other than residential use shall not exceed eight (8) feet in height above grade. (3) Prohibited Features Fences constructed wholly or partially of barbed wire are prohibited, except in intensive districts where fences or walls exceeding six (6) feet may be permitted which 'have a maximum top extension of sixteen (16) inches bearing a maximum of three ( 3) strands of barbed wire. Each sheet of plans for any improvement estimated at $15, 000 or greater, including labor, materials and services , shall bear the date and the impress seal and signature of a licensed, professional architect or engineer, in accordance with the South Florida Building Code. 2 . All applications are reviewed for accuracy, completeness and compliance with City of South Miami's Land Development Code. If a problem is found with an application, the applicant will be notified as soon as possible. Problems that are not resolved before the noon application deadline will result in the exclusion of that application from the upcoming agenda. 3 . Neither applicants nor their representatives are REQUIRED to attend the ERPB meeting. However, the chances of receiving approval are much greater if someone is present at the meeting to answer questions about the project and is authorized to make corrections or modifications to the plans. It is RECOMMENDED that architects and engineers present their projects in person before the Board and be adequately prepared. 4 . APPROVAL BY THE ERPB IS NOT AUTHORIZATION TO BEGIN CONSTRUCTION. You must obtain a valid Building Permit after receiving approval from ERPB. Applications for Building Permits for single-family residential projects will be processed and issued as soon as possible after ERPB approval . All other permit applications must observe a fifteen ( 15) day appeal period before such permits can be issued. In order to allow the entire process to proceed as quickly as possible , you must submit a completed Building Permit Application when you apply to appear before the ERPB. Those plans submitted without complete Building Permit Applications will be disposed of sixty ( 60) days after being reviewed by the ERPB. 5 .
