Dear Mr. Farinas:
This letter is in response to your correspondence dated January 4, 1996, regarding your
application for a building permit in order to erect a canopy carport on your property
located at 6800 S.W. 63 Street.
On December 20, 1995, you submitted an application for a building permit. Based on a
discussion by a member of my staff with you regarding the placement of the canopy
carport, you proposed that the canopy be located at the rear of the house. As part of that
discussion, you were asked why the structure that you were indicating as the proposed
canopy was already depicted on the survey. You replied that the surveyor had located it
on the survey as part of your application. As a result of these discussions, I highlighted
the proposed location on your survey, and initialed the permit application as approved.
During subsequent review by the Structural Engineer, you were requested to draw the
location of the proposed canopy on the survey/site plan. You indicated a different
location than previously approved.
On December 29, 1995, the Structural Engineer approved your drawings based on the
revised site plan now on record. The Building Official informed you that the permit was
ready for you. Prior to your payment and permit issuance, the Building Official spoke
with me regarding the revised site plan and a possible conflict with the previous zoning
approval. Upon my review of the revised site plan, the permit could not be issued. I do
ndt consider this, nor have I stated that this was an oversight.
I have met with both you and your wife at City Hall. I am still willing to visit your
property and help you locate a suitable site for the canopy carport. The revised location
which is shown on the building permit application is not acceptable.

No permit has been issued for the property for a canopy carport; therefore, the City is not
obligated to you regarding this issue. Again, I am willing to meet with you on site to
resolve this matter by identifying an alternate location that will meet with City code.

Dear Mr. Mackey:
I am writing concerning our permit to install a carport at our home located at 6800 S.W.63 Street.
As you are aware, our permit process started in late November and we have worked diligently
with the city to meet all the prerequisites for obtaining the required permit. We have worked
with the city through the three required approvals. As part of this process, we even incurred
additional expenses to prepare an engineering drawing for the carport. The reason for this letter
is to request that the city follow through on the comm.itiment made to us on January 2, 1996.
As part of the permit process, we talked with various city department heads to ensure that
everything required of us was addressed. On the morning of January 2,my wife talked with the
last person required to sign the permit, the department head of building and zoning. At that
time, Ms. Lamas notified her that the permit had been approved and it was ready for us to pick
up. Since the carport must be custom-made for the location where it was being installed,my wife
inquired whether it would be prudent to inform the manufacturer,at that time, to begin
manufacturing the carport. She was told by Ms. Lamas that we could notify the manufacturer
since everything had been approved;nothing else was required and no conditions were being
placed on the permit. We acted in good faith, based on the approval from the city,and informed
the manufacturer to begin manufacturing our carport that same morning.
However,when I went to pick up the permit the following day (January 3), I was told by you
that the approval had changed and the permit was now being denied. This was a great shock to
us since we had been working with the city for the past month and a half and had obtained an
approval to proceed the day before. You mentioned that the city had made an oversight and the
permit was now being denied.
The problem we encounter now is that we are faced with litigation for the full amount of the
carport from the manufacturer since we had given him the okay to proceed with manufacturing
the carport (as the city had approved on January 2). The carport was custom-designed and
cannot be utilized in another part of the house. The manufacturer does not want the carport since
he cannot resell it; it was custom made for our home. I am requesting that the city follow through
on the January 2-,d approval and issue the permit without any conditions as indicated at that
time. We have made every attempt to meet the city's requirements and have proceeded in good
faith based on the city's approval. We should not be penalized for an oversight the city made. I
am requesting;your assistance in diligently resolving this matter. If you have any questions

next few days. I appreciate your help in ensuring the city meets its commitment as we. have met
