City Commission Agenda Item Report Meeting Date: July 3, 2018 Submitted by: Thomas Pepe Submitting Department: City Attorney Item Type: Resolution Agenda Section: ADD-ON ITEM(S) Subject: A Resolution of the Mayor and City Commission for the City of South Miami to petition Homeland Security and petition the court to drop the deportation charges against Denise Kolb Covington. 3/5 (Commissioner Welsh) Suggested Action: Attachments: Reso re Covington petition#s.docx 1 RESOLUTION NO. _________________________1 A Resolutionof the Mayor and City Commission for the City of South Miami 2 to petition Homeland Security and petition the court to drop the deportation 3 charges against Denise Kolb Covington.4 5 WHEREAS,Denise Kolb Covington has been a long-time resident of the City of South 6 Miami,and7 8 WHEREAS,she has served as a member of the Community Redevelopment Agency of 9 the City of South Miami,and10 11 WHEREAS,she has been an active citizen, having beenpositively involved in the City’s 12 elections and, also, having actively voicedher opinions atCommission meetings;and13 14 WHEREAS,she is the daughter of an American Service man stationed in Germany in 15 the 1960s;and16 17 WHEREAS,she hashad a prestigious employment career for over 27 years with no 18 legal problems;and19 20 WHEREAS,she has raised two daughters,one who works for the United States Post 21 Office and one who is currently serving in the U. S. Navy;and22 23 WHEREAS,she is the caretaker of her two grand-daughters during their mother’s active 24 Naval duty;and25 26 WHEREAS,she has been honored by Habitat for Humanity to help build and buy her 27 own house;and28 29 WHEREAS,Denise Covington is a responsiblecitizenwho isknown as a forthright, 30 conscientious, active and disciplined member of thiscommunity; and31 32 WHEREAS,she was detained on January 30, 2018, by Homeland Security for 32 days33 and Homeland Security is currently taking action to deport her;and34 35 WHEREAS,deporting her would be a significant loss to her family, to her employer, to 36 her neighbors, to her City, and to the United States.37 38 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 39 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:40 Section 1.The Mayor and City Commissionhereby petition Homeland Securityandthe 41 immigration court to drop the deportation charges against Denise Kolb Covington.42 2 Page 2 of 2 Section 2.The City Clerk is instructed to send a copy of this resolution to the appropriate 1 person at Homeland Security and to deliver it to Denise Covington’s attorney or Denise 2 Covington to be filed with the immigration court.3 Section 3.Severability.If any section clause, sentence, or phrase of this resolution is for 4 any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall 5 not affect the validity of the remaining portions of this resolution.6 Section 4.Effective Date.This resolution shall become effective immediately upon7 adoption by vote of the City Commission.8 9 PASSED AND ADOPTED this ____ day of ______________, 2018.10 11 ATTEST:APPROVED:12 13 ________________________________________________14 CITY CLERK MAYOR15 16 READ AND APPROVED AS TO FORM:COMMISSION VOTE:17 LANGUAGE, LEGALITY AND Mayor Stoddard:18 EXECUTION THEREOF Vice Mayor Harris: 19 Commissioner Welsh:20 Commissioner Liebman:21 ________________________Commissioner Gil:22 CITY ATTORNEY23 24 3
