So ltz Re: Administrative Waiver Planner Deravakian (6780 SW 63 Street) Please, review the following staff report to be presented to the City Manager on March 10, 1996. 1. REQUEST Saro Deravakian and his wife Linda of 6780 SW 63 Street are requesting an Administrative Waiver to increase the permitted amount of impervious coverage from 40%to 48%pursuant to Section 20-5.10(C)(1)(d) of the City's Land Development Code. 2. BACKGROUND The applicant is proposing an 1,166 square foot swimming pool and deck addition to their existing single-family,residence. The property is located in the RS-3 single family zoning district. In this district the City's Land Development Code permits a maximum of 40% impervious coverage. With the addition of the swimming pool and deck the property's impervious coverage is 52%. In order to comply with the proposed 48% the applicant will be removing some of the existing asphalt as shown on the attached site plan. 3. ANALYSIS The Administrative Waiver ordinance allows the City Manager to increase the maximum impervious coverage requirement by no more than 20 % of that normally permitted. With approval of this administrative waiver the maximum impervious coverage allowance would be increased to 48%. The proposed pool and deck will meet all other requirements of the code. I inspected the site and concur that there is no negative impact to the proposed site or the surrounding properties. The applicant has submitted written consent of all surrounding property owners. Staff believes that the Administrative Waiver ordinance was adopted for cases like this one, in which a property owner is constrained by the existing structure from making improvements that would not negatively affect the property or surrounding properties. 4. COMPREHENSIVE PLAN This requested Administrative Waiver does not conflict with the adopted Comprehensive Plan of the City of South Miami. 5. RECOMMENDATION Staff recommends approval of the requested Administrative Waiver. Any construction will be in accordance with the site plan presented with the application, and will require a building permit. The applicant must also be aware that no additional Administrative Waiver will be granted to any present or future owners of the subject property. The applicant is also required by the ordinance to record this Administrative Waiver in the official Public Records of Dade County. After the Administrative Waiver is recorded, the applicant must submit a copy which shall be retained by City's Building and Zoning and Community Development Department. Graulich has prepared contruction documents for the addition of a recreational swimming pool and landscaping. See Site Plan attached. The pool complies with all your requirements outlines in the Code as to the setbacks and enclosures. My request is the area of lot coverage, where could comply if we did not have the existing porch and a portion of our drive on the west side of the house. However, our Administrative Waiver asks for your kind assistance so we may maintain our porch and our driveway on the west side. If required, I am willing to give up a portion of the drive on the west side. The pool is setback at a 300 angle to allow for a better landscape buffer between my neighbor. This request puts us a few percentages over the allowance by Code. Please see plans for more data and clarity.
