City Commission Agenda Item Report Meeting Date: June 19, 2018 Submitted by: Maria Menendez Submitting Department: Planning & Zoning Department Item Type: Resolution Agenda Section: RESOLUTION(S) Subject: A Resolution deferring the second reading of the Fellowship Church proposed amendments to the Future Land Use Map of the City of South Miami’s Comprehensive Plan and the zoning map concerning the Fellowship Church property generally located northwest of the intersection of SW 72nd Street and SW 67th Avenue. 3/5 (City Manager-Planning & Zoning) Suggested Action: Attachments: Resolution Fellowship Church Resolution for deferral of 2nd reading (003).doc Fellowship Request for Deferral.pdf 1 Page 1of 2 RESOLUTION NO. _________________1 2 A Resolutiondeferring the second reading of the Fellowship Church 3 proposed amendments to the Future Land Use Map of the City of South 4 Miami’s Comprehensive Plan and the zoning map concerning the Fellowship 5 Church propertygenerally located northwest of the intersection of SW 72nd 6 Street and SW 67th Avenue. 7 8 WHEREAS, on April 17th, 2018. the Commission deferred the second reading of the 9 two ordinances for Fellowship Church until May 15th; and10 11 WHEREAS, on May 15th, 2018, at the request of the applicant,the Commission 12 deferred the second reading of the two ordinances for Fellowship Church until June 19th; and13 14 WHEREAS,the attorney for the applicant has sent the Planning and Zoning Director a 15 written request to defer these items since the Fellowship Church will not be able to submit the 16 requested revisions in time for that meeting; and17 18 WHEREAS, in light of this request the ordinances in question were not advertised for 19 the June 19, 2018 Commission meeting; and20 21 WHEREAS,theCity Manager has indicated the City should defer the second reading 22 until the August 7th, 2018, City Commission meeting; and23 24 WHEREAS, Section 20-5.5 (E) (4) authorizes the City Commission to defer an item and 25 it provides that “[a]request for deferral made by the city manager, planning director, planning 26 board, city manager or city commission and shall not be subject to the requirements set forth 27 above in subsections 20-5.6(E)(1)(2)(3). 28 29 NOWTHEREFORE, BE IT RESOLVEDBY THE MAYOR AND CITY 30 COMMISSIONERSOF THE CITY OF SOUTH MIAMI, FLORIDA:31 32 Section 1. The application of the Fellowship Church and the 2nd reading of the following 33 ordinances are hereby deferred to August 7, 2018:34 35 An Ordinance Adopting a Small-Scale Amendment to the Future Land Use Map of the 36 City of South Miami’s Comprehensive Plan, amending the designation of an 37 approximately 2.60-acre property generally located northwest of the intersection of SW 38 72nd Street and SW 67th Avenue, and as legally described herein, from Religious to 39 Multiple Family Residential (Four Story); and40 41 An Ordinance amending the Official Zoning Map, amending the designation of an 42 approximately 2.60-acre property generally located northwest of the intersection of SW 43 72nd Street and SW 67th Avenue, as legally described herein, from “R” Religious to 44 “RM-18” Low Density Multi-Family Residential.45 46 2 Page 2of 2 Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for 1 any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall 2 not affect the validity of the remaining portions of this resolution.3 4 Section 3. Effective Date.
