Oravec Subject: Request of Reverend Whipple Acting Director of Planning& Zoning This memorandum serves to advise you of the most appropriate mechanism by which Reverend Whipple of Mount Nebo Church may locate a "Youth Alternative Program" at the properties identified by the following folio numbers: 09-4025-000-0790, 09-4025-000-0720, 09-4025-000-0900, 09-4025-000-0700, hereinafter referred to as the property. This memo only addresses the property, itself, not the type of structure to be located on said property. The property is zoned RS-4, as depicted on the attached portion of the zoning map. The RS-4 zoning district, also known as the "Small Lot Single-Family Residential District," provides for single-family residential development on smaller lots and serves to protect and improve the character of existing development in the area. A school is not an appropriate use for this zoning district and is not permitted at the subject location. Therefore, if this property is to accommodate a school, the zoning district must be changed. Currently, there are at least two options by which to change the current zoning conditions to allow the school. One, the property could be zoned Public Institutional (PI) by an ordinance of the Mayor and City Commission. This district allows elementary or secondary schools. However, since a school for "at-risk children" falls outside of the parameters of a normal elementary or secondary school, a similar use request would have to be approved by the Mayor and City Commission to allow the subject use in the PI district. Two, the property could be made part of the Community Service Overlay District by an ordinance of the Mayor and City Commission. This district's intent is to "provide for the special needs of community- based service providers..." The district permits the use of school, vocational or special programs, pursuant to special use approval; and, the property would maintain its underlying RS-4 zoning in the event that it was sold to a"non-community service provider." I believe that including the property in the Community Service Overlay District is the superior mechanism by which the school-use may be located on said property because it would assure that the use was approved by the Mayor and City Commission via the special use process, thereby allowing for the public and planning board to comment on the perceived impacts of the proposed use. Additionally, if the subject property were sold to a"non-community service provider,"the property would only be developable at the RS-4 intensity,thereby protecting the surrounding residential neighborhood.
