Chair deemed the Public Hearing to be open asking if there is anyone present wishing to speak either for or against the request. Jennifer Carter signed in representing Habitat for Humanity asking that the request be approved. The Board reviewed the plans. There being no one else wishing to speak regarding the request, the Chair declared the Public Hearing to be closed and the Board to be in Executive Session. In discussion, Mr. Lefley asked Mr. Mackey if there are many undersized lots east of 62nd Avenue and 64th Street. Mr. Mackey advised that this is a very old subdivision having been platted for 25 foot lots. The Code now requires 60 feet. Even .combining two lots would create a substandard property. Chairman Gutierrez opened the discussion stating .that the subject of fences was tabled at the last meeting so that Mr. Jorczak could draft wording for a proposed resolution. Mayor McCann had advised the Board that the proper way to proceed is by means of a resolution to be presented to the City Commission. and if the Commission acts upon the proposal, a Public Hearing will be called to return it to the Planning Board. Following is the draft proposal. "Proposed Resolution by the Planning Board of the City of South Miami to amend text of Section 20-3.6 (H) , (2) , (c) of the Land Development Code for the City of South Miami. Text amendment may be initiated by the Planning Board and submitted to the City Commission for approval under Section 20-5.7 (B) , titled City Initiated Applications. (c) No fence located within a yard adjacent to a street or right- of way shall be greater than four (4) feet in height above grade nor shall it be of chain link material. Masonry walls may be permitted to have a maximum top extension of twenty- four (24) inches provided that it is of wrought iron type construction with at least eight .(8) inches of space between bars of not more than one (1) inch in thickness. Masonry intermediate, corner and gatepost columns may be of a height not to exceed six (6) feet with no extensions allowed above that height. Lama: Habitat for Humanity of Greater Miami, Inc. hereby requests yard setback variances to be able to build a three-bedroom, one-bath house on the above referenced lot. This lot is located in an older neighborhood which has been platted for many years . As a result, I have been informed that no variance is required for minimum lot size for this lot. Yard setback variances are needed because the required minimum setbacks in the City' s Land Development Code were established with the larger minimum lots in mind. The existing houses in the neighborhood do not comply with the setback requirements either. The specific variances requested for this lot are as follows : Front-15 ' (25 ' required) Rear -1913" (25 ' required) One reason that Miami Habitat is requesting these variances is because its house plans call for a covered front porch. It is believed that this porch adds more to the quality of life for the future homeowner and for the neighborhood than strict adherence to the setback requirements .
