REQUEST Craig and Jessica Sherar of 6501 SW 61" Street are requesting an Administrative Waiver to reduce the required rear yard setback for a proposed addition, from 25 feet to 20 feet, pursuant to Section 20-5.10(C)(1)(a) of the City's Land Development Code. BACKGROUND & ANALYSIS: The owners would like to build an addition at the northeast side of their existing single family residence, zoned RS-3 (Low Density/Medium Lot Single-Family Residential). The proposed addition complies with maximum building coverage and impervious coverage limits. The property requires a rear yard setback of 25 feet. However, the proposed addition would encroach 5 feet into the required rear setback, maintaining a new and proposed rear setback of 20 feet, in lieu of 25 feet. The applicant's request for a reduction of the rear setback requirements does not exceed the limitations of an administrative waiver, as set forth in Section 20-5.10(C)(1)(a). Furthermore, through review of the application and inspection of the property, it has been found that the waiver (1) would be in harmony with the general appearance and character of the neighborhood and the entire community and (2) would not impose any substantial negative impact on the surrounding area. Review of the site plan shows the proposed addition is consistent with the existing architecture and poses minimal visual impact on the adjacent public right-of-way. Lastly, the applicant has submitted the written consent of all surrounding property owners. COMPREHENSIVE PLAN This requested administrative waiver does not conflict with the adopted Comprehensive Plan of the City of South Miami. RECOMMENDATION Staff recommends gpproval of the requested Administrative Waiver. Any construction will be in accordance with the site plan presented with the application, and will require a building permit. The applicant should be aware that only one administrative waiver may be granted for the subject property. The applicant is also required by ordinance to record this administrative waiver in the official Public Records of Miami-Dade County. After the Administrative Waiver is recorded, the applicant must submit a copy to the Planning& Zoning Department of the City of South Miami. The size of the addition is two story 25x20 which will encroach on the rear setback by 5 ft. The addition was originally planned to be 20 x 20. But the area required for the stairs(5 ft)occupies too much of the downstairs to make the lower addition practical for its intended use as a mother in law suite. The lot is 15,625 sq ft. The zoning allows 30%lot coverage, 40%impervious. The building footprint with the addition will only be 3,262 sq. ft., and impervious will be 4,797 sq. ft., well below the maximum allowed by the zoning of 4,687 sq. ft. and 6,250 sq. ft. respectively. The variance is only for 20 lineal feet of building and because the house behind us is built at a diagonal on its lot it is well away from the part needing the variance.
