RESOLUTION OF CITY OF SOUTH MIAMI, FLORIDA,
GRANTING VARIANCE AS TO FRONT AND REAR SETBACK
REQUIREMENTS TO PERMIT CONSTRUCTION OF THE DUPLEX
ON WEST �, LOT 79 AND 80, BLOCK 14, FRANKLIN
SUBDIVISION PB 5/34; IMPOSING RESTRICTIONS.
WHEREAS, REBECCA S. WELLS, owner of the lands hereinafter
described, duly made application for a variance as to setback
requirements so as to permit construction of a duplex on said
lands, and
WHEREAS, the Planning and Zoning Board duly held a public
hearing on said application and recommends that a variance be
granted as to front and rear setback requirements, providing
the existing frame structure is removed from said lands prior
to issuance of a certificate of occupancy, and
WHEREAS, the City Council, after the hearing of interested
parties, finds that the existing zoning regulations would cause
undue hardship and practical difficulties if the variance were
not granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
C CITY OF SOUTH MIAMI, FLORDA:
1. That a variance is hereby GRANTED so as to permit a
front setback of 15 feet and a rear setback of 17.1 feet on .the
following described property:
West h of Lot 79 and Lot 80, Block 14 of
FRANKLIN SUBDIVISION according to the Plat
thereof as recorded in Plat Book 5 at Page
14 of the Public Records of Dade County,
Florida, less the South 15 feet thereof.
2. It is provided, however, that the existing frame
structure located on said lands shall be removed therefrom
prior to the issuance of a certificate of occupancy.

3. It is provided, further, that in the event an ,
application for building permit is not filed with the City
in conformity herewith within 130 days of the date of the
adoption of this resolution, the variance granted hereby shall
became null, void and of no force and effect without further
Council action and property reverts to its prior zoning rights.
