City Hall. 6130 Sunset Drive South Miami, Florida 33143 Dear Mayor Block: Several months ago the Department of Housing and Urban Development began the process. of designing streets ,. utilities-, and storm drainage to service six- single- family homes on dis- position site 607 in .the South Miami NDP area. In order to preserve an existing row of trees,, we relocated the centerline of the proposed street .with a seven foot off- set from the center line' of the 50' right-of-way, This was done at the request of NDP #6 Project- Area Committee so that the proposed homes would be screened from the rear ya-rds of existing homes which are platted on double facing lots to...the north. on S.W. 6th Street. . At this point the design work is completed and the. construc- tion is underway. The contractor and the consultants have discovered that the existing trees are too close to the pro- posed curb on the north side- of the street. The HUD staff, and staff of the City of South Miami met on the site this morning to verify this fact and have concluded that the trees . must be removed. The removal of the trees will require that additional. land scape work be undertaken to' screen the rear yards of the existing homes and S.W. 61st Street from the proposed homes sponsored by HUD. Since we are committed to providing a proper environment for these homes., HUD will provide the money and landscape services to create a proper buffer along S.W. 62nd Street. We are proceeding as quickly as possible to contract with a landscape architect to develop plans and specs for construction of an appropriate- screening device. Chairman Coburn asked if there was anyone present who wished to speak against granting the request of the applicant. Mrs. Florence Hafner and Mr. Fred Ha.fner of 5701 S. W. 82 Street spoke against granting the request of the applicant stating that if the Home occupational- License were to be granted to Mr. Yappa. it would start a trend and the neighborhood would soon become commercial. Chairman Coburn explained that Home Occupational Licenses must be reviewed and renewed each year and that they are not transferrable. Chairman Coburn deemed the public hearing closed. A discussion was had by the Board. Chairman Coburn read into the Minutes a letter which had been received by the Planning Board from Mr: and Mrs. Harry P. Schultz stating that they objected to the granting of the Home Occupational License. Mr. Pierce stated that Mr. Yappa had furnished the Board with an Affidavit bearing the signatures of 43 residents in the immediate neighborhood stating that they did not object to the granting of the request of the applicant. EXECUTIVE SESSION: In response to a request of the Planning Board for an opinion from Jim Duncan, Zoning Consultant, regarding the rezoning of the north side of S. W. 41st Street between S. W. 58th and S. W. 59th Avenues, a. memorandum from Mr. Duncan dated May 27, 197.5 setting out his recommendations with this regard was presented to the Board. A discussion was had by the Board. . There was some confusion expressed by various members, of the Board as to the proper procedures for processing this type of hearing. Lots 26, 25, 24, 23, 22, 21 and 21 are presently being used by Fidelity National Bank. However, it was pointed out that the bank does not own lots 22 and 23 which are being held in life estate. It was the opinion of the Board that only lots 1 through 4, plus 10' of lot 5 are presently owned by the bank. Lots 14 through 19 and 24 through 26 are presently zoned RS-4 while lots 20 through 23 are presently zoned C-2 . It was the opinion of the Board that the entire north side of S. W. 41st Street between S. W. 58th and S. W. 59th Avenue should be rezoned to C-3. First, as to the validity of the expanded usage itself, and secondly, if valid, as to the appropriate method to permit expansion within the framework of proper planning and zoning procedures. First, it appears that the proposed expansion can be accommodated without having an undue adverse effect upon surrounding residential areas, but only if certain designed precautions are first required. These would include (1) the location of all structures on lots- fronting , on Bird Road, (2) the prohibition of all vehicular access to S. W. 41st Street, (3) the provision of. a 15 foot intensively landscaped perimeter buffer along S. W. 41st Street, (4) the placement of extensive land- scaping throughout the entire vehicular use area, (5) the prohibition. of all lighting in vehicular use areas abutting residential areas, and (6) the requirement of a Unity of Title between all lots (1 through 8 and 20 through 2.6) involved in. the overall site plan. The second question as to how to properly permit the above usage should be initially addressed by removing the current C-2 zoning on lots 20 through 23. This classification is totally improper as it has been applied and could have a seriously damaging effect on not only the surrounding neighborhood, but also on the credibility and integrity of the City' s entire zoning program if left in place. Since the City does not have within its zoning code, the mechanism for permitting. transitional parking areas for commercial use adjacent to residential areas, it appears that the "variance" procedure would be the most appropriate route to permit the expanded use and accomplish the design objective enumerated previously. An outright rezoning of lots 20 through 26 would not permit the protection requirements necessary to make the expanded use compatible. It is my recommendation, therefore, to leave all lots abutting S.. W. 41st Street zoned RS-4 and permit the vehicular use area expansion contingent upon a satisfactory, site plan adherring to specific design requirements which ensure compatability with adjacent areas. W. 58th Court, Mr. Roscoe Matchett of 2840 N. W. 187th Street, Mrs. Lulu Bowman of 6151 S . W. 63rd Terrace, and Mr. Willie Turner of 6081 S . W. 64th Terrace addressed the Board stating that they objected to building houses on undersigned lots . They stated that they would agree to the private homes being built on the subject site provided the lots are of adequate size.
