Dear Mr. Dixon:
I have reviewed your file and found that a Notice of Violation was
issued on January 17, 1990 and was received by you .on January 18,
1990 (signed certified receipt recorded) . A second Notice of
Violation was sent on February 2, 1990 and was received by you on
February 8, 1990 (signed certified receipt recorded) . Following
two months of non-compliance by you, a Notice of Hearing was mailed.
on April 2 , 1990 and was received by you on April 6, 1990 (signed
certified receipt recorded) for the Code Enforcement Board meeting
scheduled for April 12, 1990.
Please be reminded that at this hearing, the Board assessed a fine
of $25.00 per day due to begin April 24, 1990. A copy of this
order, notifying you of the fine, was mailed on April 16, 1990 and
was received by you on April 17, 1990 (signed certified receipt
recorded) .
On March 18, 1991, you requested an appeal before the Code
Enforcement Board; this appeal was heard by the Board on April 11,
1991 . The Minutes of this meeting reflect that the basis of your
appeal was alleged lack of knowledge that a violation existed due
to improper notification. However, certified signed receipts were
presented which you acknowledged were signed by you. Based on
these facts, a motion was made at the hearing that the appeal be
denied, and the denial was approved by the Board 4:2.
Almost three years later, you came to City Hall requesting a permit
for your roof. The City granted this permit (No. 8903 , March 9,
1994 , dry in roof only) on an "emergency" basis for the health and
welfare of your tenant.

At this time we discussed the lien and your compliance, and we both
agreed. that compliance was met on January 31, 1994 . In summation
of your case, the "Junked Vehicle" was in violation from April 24 ,
1990 through January 31, 1994 for a total of three years, nine
months, and seven days, or a total of 1288 days at $25.00 a day for
a total of $32,200.00.
For your reference information, City Ordinance 14-90-1454 mandates
a comprehensive fee schedule stating that "the larger of 25% of a
fine or $300.00 cannot be waived and will be used to cover the
administrative costs associated with processing violations. " This
means that the Code Enforcement Board cannot entertain anything
less that 25% ($8050) of the lien .amount. Also, please be advised
that even .though compliance was met,' the lien amount is accruing
at 18% interest per annum.
I would like to have this matter resolved as soon as possible to
prevent a future foreclosure on this property. Therefore, at your
earliest convenience, I would like to meet with you to discuss your
