SW 68 AVE_PB-83-15 s. 1 RESOLUTION NO-_fi3-83-5(143 A RESOLUTION OF THE CITY OF SOUTH MIAMI, FLORIDA, ABANDONING AND VACATING A CERTAIN DESCRIBED ROADWAY IN WEST LARKIN PARK AND MANGO TERRACE SUBDIVISIONS; A PORTION OF S.W. 68TH AVENUE ; RETAINING CERTAIN RIGHTS THEREIN. WHEREAS, the City has determined that it is in the best interest of the City that the roadway hereinafter described 'be abandon and vacate and WHEREAS, the City has no need for the roadway hereinafter abandon and vacated; and WHEREAS, 'it would be to the best interest and general welfare of the general public of the City of South Miami to abandon and vacate the roadway,, hereinafter referred to, . NOW, THEREFORE, BE IT RESOLVED` BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI , FLORIDA: Section 1. That all that land shown as roadway legally described as: A portion of S.W. 68th Avenue (Pine Strcet) , WEST LARKIN PARK, according to the Plat thereof as recorded in Plat Book 12 at Page 49 of the Public Records of Dade County, Florida, bounded on the South by the Northerly Right-of-Way line of S.W. 77th Terrace (Park Avenue) and bounded on tho North by the Northerly boundary, of said WEST LARKIN PARK,. and A portion of S.W. 68th Avenue, MANGO TERRACE, according to the Plat thereof as recorded in Plat Book 61 at Page 23 of the Public Records of Dade County, Florida, bounded on the South by the Southerly 'boundary of said MANGO TERRACE and bounded on the North by the Southerly Right-of-Way line of S.W. 16th Terrace together with the two (2) fillet areas formed by circular curves having a radii of 25 feet and being tangent to the said Southerly Right-of-Way line of S.W. 76th Terrace and the Easterly and Westerly Rights-of-Way lines of ,aid S.W. 68th Avenue. Containing 0.31 Acres, more or less. be, and the same is hereby abandon and vacated. Section 2. , The City retains the right to maintain, operate, repair, replace, by itself or by any licensee or a holder of a franchise from the City, any poles, wires, pipes, conduits, sewer mains , waiter mains or any other facility or equipment for the maintenance or operation of any utility now located or in the future located in the roadway or portion thereof abandon or vacated by this resolution. The above abandoning and closin i g shall be subject to 'the' adjoining property owners being required to pay all costs for advertising, engineers and consultants, cost of any relocation and/or reconnection of utilities within the roadway being closed and reconnection of services or relocation of said utilities, if made, and otherwise by fully being responsible for all future costs relating to utilities within the road being closed. Section 4. This resolution shall become effective upon Marc Techau filing and recording in the Public Records of Dade County, Florida, an agreement acknowledging the City, its licensees or franchisees, rights under Sections 2 and 3 hereof,' or upon the release by the City of its licensees or franchisees holding utili.ty. ri.ghts, whichever is applicable, or their respective rights hereunder.
