SPECIAL REQUIREMENTS FOR INSTALLATION, RESTORATION OF RIGHT OF
WAY AND MAINT;NANCE OF UTILITY
All State of Florida Department of Transportation properties
shall be restored to their original condition as for as practical,
in keeping with the State of Florida Department of Transportation
Specifications , and in a manner satisfactory to the State of
Florida Department of Transportation. The following guidelines
are established for this purpose:
it
A. All necessary signs, flagmen and other safety devices
will be used in accordance with the Department's Manual on Traffic
Control and Safe Practices.
B. At any and all open cut crossings , a minimum of one-way
traffic will be maintained during the daylight hours and two-way
traffic at night. All traffic detours should be restricted to
the limits of Department of Transportation right of way with
necessary flagmen and marking devices. Detour of traffic outside
oftepartment of Transportation right of way will be considered
with the approval of local governmental agencies involved. These
detours including the traffic control plan will be approved by
the Maintenance or Resident Engineer.
C. All side drains , side ditches and storm sewers will be
referenced as to grade and location prior to construction.

equal to or greater than the adjacent undisturbed material.
This requirement holds for embankment, subgrade, and base.
The, density determination can be made by, the permittee if
qu�Iified, or a certified laboratory under the supervision of
the permittee's consultant. A copy of all density test reports
shall be *furnished to the State of Florida Department of Trans-
portation on the job site at the time the tests are made.

open cut .is allowed. In some instances , additional paving will
be required.
{ F.-:, , .Temporary patches will be maintained so as to provide
a smooth,; all-weather surface at all times. Permanent replace-
ments; of .the temporary patch shall be made as soon as all other
wo1k on the,°installation is completed and the local Maintenance
Enigineer "will`'be notified twenty-four (24) hours prior to appli-
cation of;'the _permanent patch. The permittee will be required
to maintain the patch. for a period of one (1) year.

G. Shoring will be required to conform with OSIiA require- ,
ments where necessary to protect existing pavement .
H. All excavated material in excess of the quantity
required for rackfill in Department of Transportation right of
ways shall be hauled by the permittee at his cost and expense ;
a maximum distance of three (3) miles from the trench excavation
and stockpiled in those areas as directed by the State of Florida
Department of Transportation. All unusable material shall be
disposed of at the permittee 's expense and not placed within the
limits of the State of Florida Department of Transportation Right
of Way unless so directed by the State of Florida Department of
Transportation Engineers .
I. All correspondence regarding construction procedures :
will be handled directly wiEh the permittee and not through
their consultants , contractor or subcontractor.
J. At such locations where Department of Transportation
signs and reflectors will interfere with proposed construction,
the permittee will notify the Maintenance of Resident engineer
forty-eight (48) hours in advance of starting work. All signs
and reflectors will be removed or relocated by Department of
Transportation forces. Any signs or reflectors damaged , destroyed
removed, or relocated will be replaced by the State of Florida
Department of Transportation at the expense of the permittee.
K. All trees and/or shrubbery damaged or distrubed during
construction shall be replaced by the permittee at his expense
as directed b,,• the Maintenance or Resident Engineer. Any that •
have been planted by property owners shall be removed and replaced
to the satisfaction of the Maintenance or Resident Engineer. All
debris shall be removed by the permittee at his expense.
L. Grassing and mulching operations are to begin within a
maximum of three (3) weeks after an utility installation except
in cases of front and back slopes which should be done immediately
after- installations are completed. All requirements regarding
grassing. and nulching will be in accordance with the Department
of Transportation specifications. Any yards or part of right of
way in front of private property that has a grass mat will be
resodded with like sod, or otherwise, to the satisfaction of the
Maintenance or Resident Engineer. Permittee shall maintain that
portion of 'the right of way affected by the permit installation
until acceptable vegetation is established.
The �indescriminate cutting or'disfiguring of trees of
any- scenic;•value . shall not, be permitted. This includes other
methods such; as herbicides. The necessary trimming or . cutting
of .trees! by, utility, companies in.:the interest of public safety
or continuity of utility service shall not be considered indes-
criminate where such utilities cannot bypass the obstruction
without violating the clear roadside policy. {

engineers to the City -of South Miami , has reviewed the
proposed relocation of the sanitary sewer line within the
above described boundaries and is hereby submitting its
conclusion .

It is understood that:
(1 ) Sunshine State Bank proposes to close 62nd Court
within the above referenced boundaries and relocate
utilities within these boundaries as necessary or
required, and that ;
(2) this relocation is to include a sanitary sewer
line , owned and operated by the City of South Miami
(a plan showing the existing sanitary sewer line
and the proposed route of the relocated line is
attached herewith) .
The sanitary sewer line to be relocated is currently in use'.
As such , provisions must be made to maintain and continue
service to landowners currently discharging to the line.

The proposed relocation of the sanitary line is technically
fea ible provided there is : no conflict with existing
utilities- or other underground structures. Available
information indicated there would be no conflict and that it,
is possible to construct the proposed line , but this
information is subject to verification.

This same information indicates that a .slab covered trench
draiinage structure runs close to , and parallel with the
proposed route and may prevent the developer from
constructing the line within the existing . right-of-way . An
easement adjacent to the Sunset Drive right-of-way may be
req i red.
It is estimated that the construction work for the
relocation of the line would be between $10 ,000 and $20 ,000.
This excludes engineering, permitting fees , surveying, etc.
From a technical point of view , the proposed line is
acceptable .provided , that Sunshine State Bank understands and
agrees to the following:
( 1 ) Service must be maintained to current landowners
at all times.
(2 ) Relocation and final design of the line is subject
to approval by all agen-cies .having jurisdiction
including the City of South Miami .
(3) This view does not guarantee that the proposed
route is technically possible. The route is
subject to verification by the developer.
(4) The relocated line must meet the standards
established by the City and other agencies having
jurisdiction at the time of construction .

Staff has reviewed the above referenced applications and finds that the City's
and otlher utility.:- companies interests are protected because the proposed road
closings maintain the entire 60 foot roadways as utility easements, which can -:then
be re eased upon proper relocations or establishment of individual utility easements.
Further, Staff finds that subject to the new S.W. 73rd Street being located so
that westbound egress will be provided for the Sunshine State Bank property that there
will be a net public benefit achieved by the proposed closure of S.W. 62nd Court
and tie relocation/creation of the new S.W. 73rd Street.
The traffic impacts are more fully discussed in the attached letter from the
City's traffic engineer, Kimley, Horne & Associates.

Dear Mr. McDowell: relocation
During discussions with the City of South Miami staff and given the
rigid time constraints for review, it was decided to review the traffic
impact of the subject matters on the basis of all projects full build-
out only. All projects full build-out would include all non-residential
development and renovation within the area bounded by Sunset Drive, U.S. 1,
S.WI 62 Avenue and S.W. 63 Avenue.
Traffic generated by full development of the subject area was
analyzed for its impact on the local arterials of Sunset Drive and S.W.
62 Avenue north of U.S. 1. Ingress and egress for the subject area
were also reviewed.
After discussions with the City of South Miami staff and review
of the S.W. 62 Court closure and S.W. 74 Street ,relocation study, it
is recommended that the City of South Miami approve the closure and
relocation as presented by the study with the provisions that the Suns�ine
State Bank property be provided access to new S.W. 73 Street to allow
more efficient and safe ingress and egress to the site from the south
and,east and from the site to the north and west. Other major items
in the study that impact traffic are as follows:
Relocation of new S.W. 73 Street with a minimum 75 ft. right-of-
way :and installation of a traffic signal at its intersection with S.W. 62
Avenue will facilitate north-south traffic flow by providing greater
southbound storage north of U.S. 1 and allowing for sufficient northbound
left turn storage into. new S.W. 73 Street.

• Improvement of S.W. 62 Place within existing right-of-way to include
twolnorthbound left turn lanes, northbound right turn lane and southbound
through lane and signalization of its intersection with Sunset Drive
would minimize traffic impact on Sunset Drive. I't would be more desireable
to provide two southbound lanes to eliminate potential congestion at ingress
to driveways.
• Both proposed traffic signal installations should be coordinated
with surrounding signals to facilitate traffic flow on the arterials and
thereby minimize impact.
It is hoped that this review and the recommendations will aid the
City of South .Miami to reach an informed decision.

the' vacation of S.W. 62nd Court between S.W. 72nd Street and
S.W. 74th Street, by the various utilities and by the State of
Florida Department of Transportation.

1. Miami-Dade Water & Sewer Authority.
Letter of May 20, 1983, from Rick Herrera, Plans Review
Engineer/Utilities Coordinator, consenting to the vacation. The
two inch water main within the Public Right-of-Way must be cut .
and plugged at both ends, upon petition made to the New Business
Office. Also transmitted is letter of May 25, 1983 from this
office to the New Business Office, confirming the above and
stating that the Authority will be contacted as soon as Sunshine
State Bank and South Miami Hospital are in a position to order
that the work be done, some time after the street is vacated.
2 . Florida Power & Light.
Letter of June 1, 1983 from John J. LaSelva, Service
Planner Representative, confirming that Florida Power & Light Co.
has no objection to the proposed vacation. Florida Power & Light
will prepare any necessary Easement and/or Relocation Agreement

4. UltraCom of Dade County, Inc.
Easement Agreement dated June 10, 1983 pertaining to
existing cable television transmission lines located along S. W.
62nd Court.
5. City of South Miami Sewer System.
It is our understanding that you have received confir-
mation from the City' s engineers, Carr, Smith & Associates, per
letter of June 3, 1983, that relocation of the existing sewer
line along Sunset Drive is feasible.
6. Gas Companies.
We have been advised that there are no gas lines
involved with the area being vacated.
7. State of Florida Department of Transportation.
Letter from the Department of Transportation stating
that the vacation of the subject street would have no impact upon
the State Highway System, and that the Department of Transporta-
tion has no objection to the vacation.
With reference to your letter of May 5, 1983 we submit

8. We believe that Item #2 has been previously amended to
reflect that the Plat is recorded in Plat Book 4, at Page 111, of
the Public Records of Dade County, Florida.
9. With respect to Items #3, 5 and 7, we believe that the
Traffic Study by Plummer Associates, and the parking and site
plan sketches, and previous plans and sketches submitted have
satisfied your stated concerns.
10. We have also enclosed herewith the deed establishing fee
simple title of Lots 17 and 18 in Sunshine State Bank, as
requested in Item #4.

In response to your letter of May 19, 1983 in which you stated that
your client, the Sunshine State Bank and the South Miami Hospital are
interested in the closing of S. W. 62 Court from S. W. 74 Street to
S. W. 72 Street, I would like to inform you that Southern Bell Telephone
and Telegraph Company has no objections to its closing, provided an
easement is secured for our underground and aerial facilities in the
area.
Enclosed please find two applications for Right-of-Way Easements, one
for the north half and one for the south half of S. W. 62 Court. These
easements are to be executed and in effect upon the closing of S. W. 62
Court.
If in the ,future the Bank and the Hospital desire to terminate the afore-
mentioned easement, Southern Bell has nq objections to the relocation
of its facilities, however the cost of relocating such facilities in
existence at that time will be at the expense 'of the Sunshine State Bank,
and the South Miami Hospital.

petition the Mayor and City Commissioners to vacate, abandon, discontinue and close
an existing public or private street, alleyway, road, highway,.-or other place used for
travel, or a portion thereof, and to renounce and disclaim any right of the City and the
public in and to any land in connection therewith; or to renounce and disclaim any right
of the City and the public in and to certain land, or interest therein, acquired by pur-
chase, gift, devise, dedication or prescription for street, alleyway, road or highway pur-
poses; or to renounce and disclaim any right of the City and the public in and to
certain land delineated on a recorded map or plat as a street, alleyway, road or highway.

Dear Mr. Godwin:
As you know, this firm represents Sunshine State Bank,
which, along with South Miami Hospital, has petitioned the
Board of City Commissioners to vacate S.W. 62nd Court between
S.W. 72nd and 74th Streets, City of South Miami. To obtain final
approval by the City of South Miami, it is necessary to establish
that the City of South Miami can release the Sewer System on that
Street.
In that connection, I have met with Mr. Russe of Building
and Zoning to review the existing sewer lines. He has advised
me that there is an existing sewer line in S.W. 62nd Court which
also runs about 100 feet west along S.W. 72nd Street from S.W.
62nd Court. Mr. Russe informs me that the only property serviced
by said line and not owned by the Bank or the Hospital is the
Professional Building located on S.W. 72nd Street just past where
the existing line ends. Copies of the pertinent portions of the
aerial map and overall sewer system map are enclosed herewith
and highlighted for your convenience. The location of the
Professional Building is marked by an "X" .
In order for the City to release the system, it appears
that the only required work will be to run the sewer line along
S.W. 72nd Street, from S.W. 62nd Court to hook up with the line
at S.W. 62nd Avenue.

Section 1. That -Section I of Chapter 17A of the Code of
Ordinnnces of the City of South Miami be, !and the same is hereby amended to

Please be advised that the petition you filed on, behalf of the Sunshine State
Bank and South Miami Hospital is incomplete in the following respects:
Item #2 needs to specify exactly where deed or plat is recorded in the
public record.
Item #3 The survey submitted does not identify driveway entrances onto
S.W. 62 Court and the relationship of the roadway to adjacent
properties - i.e., building locations and what if any existing
facilities (such as the drive-in tellers) are dependent upon S.W.
62 Court for proper access. Please revise accordingly.
Item #4 Our tax rolls indicate that John B. Slocum is the owner of Lots
17, 18 while Sunshine State Bank is listed as Lessee. Please
furnish an up to date opinion of title or joinder of John B.
Slocum.
Item #5 I am concerned that by cutting off direct access to the South
Miami Hospital visitor parking lot located directly south of the
proposed road closing that all visitors coming to the Hospital
from the west will now be forced to use S.W. 62 Place, thereby
significantly increasing. the traffic flow on that street and S.W.
74 Street to the detriment of other properties and pedestrians on
that street. To understand the magnitude of the traffic diversion
we will need to know how many vehicles a day actually use the
affected portion of S.W. 62 Court as a through roadway and not
just for access to the bank.
Item #7 I assume from your statement that a dangerous intersection will
be eliminated , that you intend to close off S.W. 62 Court at
Sunset Drive so that there will be! no vehicular access at that
point. You will need to submit plans showing how you intend to
block off this roadway and how proper acceess will be maintained
to the existing bank facilities.

Last page - None of the copies of the application that I have seen
have been signed or notarized by anyone.
In addition to correcting the above deficiencies, a number of other problems
will need to be resolved prior to the public hearing:
First, the survey indicates that the following utilities have equipment in the
affected portion of the right-of-way; Florida Power and Light, Southern Bell,
Miami Dade Water and Sewer Authority, and City of South Miami Sewers. The
survey does not indicate it, but probably at least one CATV company is
involved also, and we will need to be sure there are no gas lines. You will
need ' to have a written release from each of the utilities involved prior to
the goad closure. This may mean either relocation or the creation of an
easemeent.
In tIfie case of the City sewers, since the sewer line in question serves
another property past your property and not involved in the petition, you will
more than likely want to create an easement for the, existing facilities. If
you !decide that you want to do this we will .require a minimum fifteen (15)
foot ! easement. You will need to have your engine-ers__ develop a proposed
easement and legal description. _ which will then be submitted to- -our _ C�ty
6-n-gi-nee.rs _and-City attorney for their review.
It will be your responsibility to contact the various other utilities, and
submit their releases to the City as soon as they are available.
Probably the greatest problem is the question of adequate traffic circulation
and laccess for the bank itself. As I understand what was said at the
Commission meeting on May 3, 1983, the bank and the hospital have a contract
to swap land so that the bank's southern property line will be at the line of
the (north thirty-six (36) feet of Lot 11 as shown in the petition to close the
roadway. As I assume you are aware, the proposed new S.W. 73 Street is some
eighty (80) feet south of that point. Due to the magnitude of traffic on 62
Avenue and the distance between the S.W. 72 Street/62 Avenue intersection and
the proposed new 73 Street/62 Avenue intersection, I have some real questions
and doubts about moving the new S.W. 73 Street northward by 80 feet. If the
new 73 Street cannot be moved northward, the bank would then not have proper
access to any signalized intersections.
If the bank cannot gain proper access to a signalized intersection, it could
severely limit the development potential of the bank's property.
Fori that reason, I believe that it is in everyone's best interest to fully
understand all of the implications of the proposed road closing before action
is taken. Therefore, the City will be engaging an independent traffic
engineer to assess the impact of this application. As stated in the
instructions for the roadway petition,you will be expected to reinburse the
City for these engineering costs. At this time, ! the estimated cost of this
review will be approximately $5,000. You will need to submit a check in that
amount to the City prior to our being able to continue the processing of this
application.

Vacation of S .W. 62nd Court From
Sunset Drive (S.W. 72nd Street) Southerly
For 215 feet in South Miami, Florida.
The primary function of S.W. 62nd Court within the subject limits is to
provide on-street parking to the public as opposed to a circulation
link within the surrounding street network . At Sunset Drive, no median
opening exists so that right turns from and onto Sunset are the only
allowed movements .
Adequate circulation is maintained surrounding this one block roadway
by Sunset Drive, S .W. 62nd Place, and S .W. 64th Street with full access
intersections at each .

Right turning traffic to Sunset now has to weave through a right turn
lane to go east on Sunset. Some traffic tries to weave to the left
turn lane to go north on 62nd Avenue . Right turns onto 62nd Court
create hazards to pedestrians crossing 62 Court due to an existing
building on the right-of-way line obstructing the view.
