It is again going against the wishes of the residents in that area who object to the variance being granted on the basis that they were promised by former actions by the City Council that no variances would be allowed in this area. 2. The granting of this variance will result in requests for at least five more variances within the same area in the near future. 3o Until the Council,, Zoning Board and Planning Board can get together and set some sort of precedent and future plan for . C01 and C®2 zoning,, that applications of' this type will reoccur and serve no point other than to cause the residents of the area concern. On September 6, 1955 this area was rezoned from RU-1 Useage to RESTRICTED C-1 USEAGE by Ordinance 332 with the stipulation that all buildings erected must be approved for Architectural Design by the City Manager after conferring .with the Chairman of the Planning Board. When the A.D.P. Corporation submitted the sketch for their Store Building, the Chairman of the Planning Board suggested many changes in the design which they compied with and this was approved by the City Manager and the building as constructed will be a cdedit to this rezoned area. We cannot visualize how a SERVICE STATION could be designed along "Attractive Lines", even if the rezoning were granted. 2. When this area was rezoned for "RESTRICTED C-1 USEAGEft, the adjoining property owners were assured, after they asked the question, that "This Area Would Be For Restricted C-1 Useage And The Zoning, Would Never .Be Broken Down". With this assurance they withdrew their objections. We are of the opinion that granting of this requested rezoning would be breaking faith with the adjacent property owners and would cause them to--lose confidence in the existing City Administration. 3. To permit this requested rezoning and allow construction of a Service Station would create a "BLIGHTED AREA" that would not only be detrimental to this immediate area, but would also ruin the entire City of South Miami frontage on Red Road and this should be protected with the utmost, vigilence. 4. A. Larkins Sub-division. Mr. and Mrs. Zinker have entered into an option agreement with Gulf Oil Corporation for the sale of their property with a proviso contained therein that such sale is contingent upon this property being usable as a service station. We are attaching hereto a copy of such option agreement containing the terms of said sale with the exception of the purchase price which has been deleted there- from and vh ich is of no concern for the purposes of this application. We are further attaching thereto and making a part of this letter, which is to be construed as an application for necessary variance in zoning, a Plot Plan prepared by Gulf Oil Corporation showing the proposed layout of the service station to be constructed upon the premises subject to approval by this Council. Mr. -Esbitt, before coming to Florida, was employed as a bartender for a number of years in extremely high -type taverns and restaurants and Mrs. Esbitt, a college graduate, was employed as a social worker, both jobs requiring direct contact with the general public. Mrs. Esbitt makes this application for a beer and wine tavern, said beer and wine to be consumed on and off the premises, but will deal in no food or other merchandise of any type. We believe, in all fairness, the City of South Miami should .: seriously consider the granting of this zoning change to allow Mrs. Esbitt to operate a tavern as they will expend considerable funds to establish a first class tavern and actually their past experience limits them to making their livelihood through this type„ of business. We feel that . the tavern, if established at this location, will not lower the standards . of .any of the businesses in that locality. It will not be near a church or school and will follow the same practice of taverns to adjacent cities. In substantiation of this ..faet I might point out that Coral Gables for a number of years had a tavern on Miracle Mile and does at present have several on Ponce de Leon Boulevard and other on various main thoroughfares. Likewise both Miami and Miami Beach. Both Mr. and Mrs. Exbttt conducted a very extensive search for various locations and the present location in their estimation seemed to be the most suitable site to establish the high type business and clientele which they desire to cater to. Mayor Gluck called the meeting to order with all Councilmen, Manager Bishop, Attorney Proby and Clerk Martin present, He then welcomed Councilman Tevis back, who stated that he very much ap- preciated the beautiful flowers sent to him while in the hospital and the cards which were sent by the Administration and the employees of the City of South Miami. Mayor Gluck then stated that before he would call for the approval of the minutes of the regular meeting of February 15 he would, with Council consent, read a petition containing many signatures, There were no objections and he proceeded with the reading of the petition, which dealt with Item A under Petitions and Coimunicationss "Petition of property owners in vicinity of Lots 40 to 45 W.A.LARKINS to be heard before adoption of minutes of February 15," These were 39 signatures on the petition and Mayor Gluck suggested, if agreeable with the City Council, that these petitioners be heard at this particular time, Attorney Tom Lummus was spokesman for the group of petitioners and addressed the City Council,, He stated that the minutes of the Zoning Board recommended that this particular request be denied and also that the minutes of the regular Council meeting of Feb- ruary reflected the same sentiment was brought out in the recom- mendation of the Planning Board; that the Planning Board had an "overall plan" for the particular area in question. Attorney Lummus then read to the members of the City Council a couple of paragraphs from the "Zoning Round Table" conducted by Hugh R, Pomeroy and explained these writings to the City Council, He further stated that he was of the opinion that the City Council should give these Boards (Zoning and Planning) full and due con- sideration, Mr, B. S. Chinn read a written statement to the members of the Council in behalf of the objectors to the proposal, A car- bon copy of this statement was submitted to Mrs. Martin, the City Clerk, for the benefit of the record, Mr, MaBroom then addressed the City Council and stated that he had heard "just tonight" that the A & P had cancelled the idea of building a supermarket, Mr. Cutler was then asked if he had any such knowledge and Mr. Cutler answered in the negative, Con- siderable discussion was held on this particular subjects Mr. Chinn stated that if the City was going to expand that it should expand, but little expansion at a time would not assist the growth of the City, 4� Mrs. Alle s Mason of 5720 SW 74 Str stated that she was in acoord with the view of the gentleman who had just spoken➢ Mr. Chinn. Further discussion followed. Mr. Luther Shafer spoke against the measure, stated that he was in agreement with Mr. Chinn. Mr. Jackson of 5822 SW 74 Terrace also spoke against the measure Mayor Gluck then read the contents of a second petition to the City Council of people who were in favor of the project. He stated that there were approximately 30 names in the petition, At this point of the proceedings Councilman Annie stated that he wished he could show the members of the audience the map that was used by the Zoning board and the Planning Board for considers-Q tion of the particular problem at hand. He stated that it was a most difficult question and especially since it was "all not in South Miami." He referred also to the problem of business going to Coral Gables and the north side of Bird Road. He then read the portion of the minutes of February 15 wherein Councilman McKinney'moved granting of the variance, with Councilman Annie seconding. Councilman Annie pointed out that it was contingent upon compliances with the overall plan. Mayor Gluck :hen called for anyone to speak for the petition that had just been read. Mr. G. W. Larkins arose and addressed the Council and the audience present. Mr. Cutler, when called upon, spoke in favor of the petition. He stated that he had some more names for the list from the Sunset Drive Association. He stated that he believed he was right when he stated that this Association was paying the majority of the taxes. Mayor Muck asked for those who opposed to please standa Seventeen persons were counted. Mayor Gluck then asked for those favoring the project to stand. Mr. Larkins stood, but Mr.. Cutler stated that there were ,42 people on the petition. Mr. George Pink of the Planning Board referred to their report wherein the Board recommended a public hearing on the proposed "overall zoning." Mayor Gluck then stated that he had attended the original informal hearing relative to this particular matter and that he had gleaned the Impression from the proceedings that there was no objection to the project providing it was an overall one. "Board's Recommendation: That the Council be advised that the Board does not feel it would be in order for the Zoning Board to make a, recommendation to the Council in this matter prior to a public hearing Which has already been c"I ed in the same vase, but that the Zoning Board express its willingness to attend the public hearing as a Board and to sit with the Council at such a hearing with the night to question witnesses, if nec3essary, and to render its recommendation to the Council upon conclusion of the public hearing." Councilman McKinney then asked if any members of the Zoning Board were present to speak with the Counoll in view of the fact that they were Invited by the City Council so to do. Mr. Edgar Shafer, Vice-chairman of the Zoning Board, arose and addressed the City Council stating in substance that he be- lieved that it was the general opinion of the Board that they were very happy to have a school, but felt that as a Board they had no right to express their individual opinion. I know that. in. some instances some .people must be hurt but at the .same time.I .think all. of you wish_.to be .fair and impartial. In this case of variance or spot .zoning for .a supermarket, I cannot believe that. all of the facts .for long range planning have been considered as they should have been. It.is inconceivable to me that you. would override the recommenda- tions of your Zoning Board, the Planning Board and ignore the .wishes of an overwhelming majority of the home owners in the affected area. The value of these homes will run into the hundreds of thousands- of dollars, which sum will. be greatly depreciated if this supermarket is allowed .to come -into this area. That is not fair. This area has a large percentage of young children playing in the yards and streets. The added traffic of a supermarket will. greatly endanger the lives of .these children. That is not fair. The proposed .parking for 90 cars is wholly. inadequate which means that cars. will.be .parked. along the streets too narrow.for present traffic and in the yards of sw.rounding. property. owners. That is not fair. The operating hours of a supermarket will begin long before daylight and continue until late at night with the noise of delivery trucks, garbage cans,etc. That is not fair. Speaking for myself, I came back. to South Miami to build my home for two reasons: first, I like the people and the community, and secondly, to take advantage of zoning restrictions for .the protection of m4Y .home. I realize that conditions change and we cannot .foresee too far .ahead the .needs of the future. Right now I cannot see the need.of .additional. rezoning and this reasoning is borne out by the report of Councilman Annis on September 21, 1954 in which it is estimated that present zoning.for business would absorb a'.population of 90,000. If it could be pointed out.-that. mor_e land is..required.now.for business by an expert in such matters, then.I would .be. inclined to go along with an area zoning that would take in sufficient. lands to care for the. needs of the foreseeable future. I would not like to see it done a blo.ck..or two at a time for .the reason that home owners could never be sure where it would stop. In conclusion, I would be .grateful,. if feasible, .for the Council to procure the services of an expert in zoning.matters and find out two things: first, if there is .real need now for additional-business property, and secondly, if there is, should it. be .in the highly desirable residential area under discussion or if a less desirable. area might. meet. the needs just as well. Brown, Chairman Dear Mr. Brown: For the information of the Zoning & Planning Board in regards to building permit for Kenneth S. Keyes, Jr., the building to be located on Lot 12, W. A. L9.RKINS , SUBD. , Mr. Keyes made a written request to the Council requesting to be heard on this matter. He appeared before the Council at its regular meeting on September 18th. and after discussion and consideration, the Council voted to approve his request enabling him to build to the existing building line with the provisions that the necessary legal documents would be executed by him conveying the required 6 feet set back to the City of South Miami at such time as Sunset Drive would be vridened. The City Council in arriving at this decision took into con- sideration the fact that three other buildings on Sunset Drive have re- cently been permitted under the same condition and there will be included in the written agreement with Mr. Keyes that the cut back of this new building will be at his expense. The City Council does not wish to over- ride the decision of the Planning & Zoning Board in these matters, however, in this instance and also acting on the advice of the City Attorney that possibly the City could be forced to permit the requested building line. Dear Sirs: I recently purchased lot 15 of W.A. Larkins sub-division, with the intention of building,:othree stores on that parcel. This letter is to inform you that I would like very much to be able to build up to my western lot line. Since the side street to the west has a forty foot right of way, I feel that I should not be required to observe a set back on that side. With a forty foot right of way, and allowing eight feet on each side of the street for a sidewalk you would have a remaining twenty four feet for a paved road. That is twenty four feet of actual pavement for traffic. In my opinion that should be sufficient for a side street. I can easily understand that Sunset Drive is a main artery and therefore building set backs should be set and observed. Due to the amount of traffic and congestion on fiunset we need more space for the use of the public. There- fore I will cooperate with you, and be more than willing to observe set-backs on Sunset Drive. When the Planning Board starts to recommend set backs for buildings along South first Road, I wish you would give due consideration to my request. This will mean a difference to me, because with less thah the fifty-seven foot front- age I now have.. I might not be able to construct the three store buildings. Larkins Subdivision from RI to C-2 for the fol- lowing reasons: 1. Thi s reque st is very similar to one made last fall involving to a great extent the same area. At that time the residents vigorously opposed any change in the zoning with the result that the Advisory Zoning Board and City Council upheld such objections. 2. Spot zoning is particularly dangerous to a community as it co- mingles the different zones to such an extent as to devaluate all the surrounding property. 3. In this case only two owners and one prospective purchaser are the petitioners involving a total of five lots . In the case ofone of the two bona fide owners the petition is requested through an agent. . 4. This petition,if granted, could at a future date be used by other petitioners as a basis for further changes in our present zoning. 5. It is very desirable to have a buffer strip between an area zoned for business and one for residential. We have such a buffer strip at present in the lots along the north side of South First Street being Lots 48 to 53 inclusive, 64 to 69 includive and 80 to 82 inclusive. This begins 142a feet West of the intersection of South ji'irst Avenue and South First Street and, extends to Red Road. 6. This property has been zoned RI for years. The present owners were aware of this fact when they bought, thereCore it cannot be construed the failure to change the zoning to C-2 would be a h ardship on them. Rather it would be a hardship on those of us who have built our homes in the good faith that we would be protected by rigid zoning enforcement. Larkins sub- division, so I wish to take this opportunity to clarify my position. I bought lots 46 and 47 because they are, in my opinion, a, very suitable site for a profess- ional office, or clinic-type building, for myself and possibly another practitioner. Rough sketches have already been drawn, and many other. plans studied in an effort to draft final plans for an attractive building which will make even better medical and surgical care available to the people of South Miami and surrounding towns. Mr. Cotton, owner of the other lots in quest- ion, hopes to have them re-zoned to business, and -he suggested that we petition the Board jointly fcr the re-zoning. Conversations with my neighbors have made it quite clear that they are not in favor of the pro- posed change in zoning, of lots 48, 49 and 50. I have been a real estate appraiser in the City of Miami since 1913, and have specialized in the analysis of benefits and detriments caused by different kinds of improvements in various classes and kinds of properties. I fully appreciate the fact that funeral homes are a necessity. However, it is my opinion that locations should be selected for them in quiet districts where they will have the least affect on the surrounding properties.. I also appreciate that you would not want to buy property adjoining the funeral home if the funeral home was a per- manent location, and pay half the price of it that you would pay two or three blocks away. Mr. Average Buyer is no different than you are when it comes to selecting his properties. tend, of course, the farther removed you are from the funeral home the least affect it will have on your property. We have had many experiences with this sort of thing in Miami proper and in Coral Gables, and I have yet to see the first time anyone wanted a funeral home near them, whether in a residential or business district, and properties have never sold as readily in the immediate vicinity of a funeral home. L. Cotton to set forth mar opinions and ob- servations of the effect that Funeral Homes have on the immediately adjacent, or surrounding property. About three years ago I was called upon by one of the largest morticians in- the city to appraise all of their real estate holdings, as well as the . personal property, furniture, fixtures and equipment. . In checking real estate values in the immediate block in which their property was located, as well as the blocks to the east and most of it on Flagler Street, I found that the recorded sales in the block in which they were located were far less per front foot, or square foot, than properties in the other blocks. It was my impression that the lower value was due to the presence of the funeral home, and so I checked with realtora who were making sales in that vicinity, and they informed me that the lower prices at which property was selling in that block were due to the presence of the funeral home; that it had a depressing effect on businesses adjoining, and immediately across the street, and they found it difficult to find purchasers who were willing to establish a retail business close to -the funeral homes. Page 2 City Council, City of South Miami, February 13, 1945 In appraising properties on Miami Beach, I found that they had purchased buildings which they had been given assurance could be used for that purpose, but when the fact was made,known to people in the area, they created so mob opposition that it was found nec®ssary .to revoke their permits. Govern- ment on property on Washington Avenue, in this instance I found that the proft parties adjoining, or near the funeral homes were selling for less per 'front foot and square foot, than similar properties in the adjoining blobks. I have had considerable experience. with chain stores, and they do not want to locate>: opposite, adjoining, or near funeral homes because it inter- feres with their business. The presence of funeral homes In retail districts has a tendency to depress selling prices of real estate which results in lovrer,assessed values and lower taxes. Y am speaking mainly of the new enterprise which is trying vainly to establish itself in South Miami, namely the Wilhelm Funeral Home. I cannot understand why the matter should even be deferred to a- later date, I would think a fine new business, should be welcomed with open arms, rather than given the proverbial "cold Shoulder". Can you think of a more refined or dignified business than a funeral home. I certainly can not. On the contrary I would think the City of South Miami would feel honored they would even want to locate there. Itnot only shows other communities that we are up and coming but is bound to bring other business to the town. It enhances the value of .property, otherwise I would not approve bf its for I have Q lot in the City of South Miami proper and in the Riviera Section of Coral Gables adjoining South Miami. rt seems to me that the Tax coffers of South Miami would relish new blood, from fine new businessesq rather than try and discourage them. One of the complaints seems to be the congestion k of a funeral home on Sunset Drive, do you know of any more congestion than is caused by the Bus Terminal in its pre- sent location. I have noted many Funeral Homes in Miami where there are no, parking facilities, I never noticed any particular confusion even during funeral services and surely the traffic on any of the main thoroughfares in Miami is heavier than East Sunset Drive. In fast my grandmother was recently buried from the BAAI,Funeral Home in Miami located on NW 7th Avenue. Have you ever noticed Ambulances parked in front. of the Funeral home while not in use - no they are always in their own driveways and certainly there is ample space on the Roberts property for several driveways. I am truly disappointed that South Miami should give readers of the paper that they are all for the small business man (Miami Daily News of Wednesday) want new busi- nesses and enterprises, then when a fine citizen wants to locate in this particular locale, he is §iven no encourage- ment in the least, but rather given the open door« to try and establish elsewhere. The pro- posed mortuary location is surrounded on three sides the property set forth above. Establishment of a mortuary depreciates adjoining property values. The effect is not so great on property at -some distance but the next adjoining property is definitely devaluated. To begin with, all types of food business such as groceries, restaurants, bakery goods, ice cream and candy shops, soft drink and soda fountains are definitely ruled out as prospects for locations adjoining mortuaries. Other types of business, while not so.much affected, are not prone to choose a location next to a mortuary. This phase is brought out in an article in the Coral Gables Riviera, a copy of which is available to each councilman here. When customers for a property are eliminated, the value of that property is damaged. I think it is only fair to consider the damage to next adjoining property whose value can easily be cut in half by the presence of a mortuary. It is true we need business,but do we need a business which damages the property of others ? Another factor is that the proposed mortuary property adjoins Lot 49 .which property is zoned residential. There is too much at stake for this problem to be settled without considerable consideration z .. 2 _ being given to all angles -- damage to property, parking problems, traffic problems in connection with new bus terminal, etc. I trust that the mortuary permit is held up pending further consideration.
