However , the City now feels that to delay construction of the required sidewalk any further would be unreasonable . Therefore , if the required sidewalk has not been constructed within 60 days of receipt of this letter the City w,ill take action to have the required side- walk and street sign erected at the developer ' s expense . She further read the action of the City Council at the meeting of October 5, 1976 wherein the Council had approved the Tentative Plat as presented. The Board noted there was no change in the 20 foot alley they had originally objected to on the Tentative Plat stating they would prefer the 20 foot alley be divided between lots 11 and 12 . To maintain the 20 foot alley would violate the current zoning and if it were permitted. lot 7 could be subdivided as it would have frontage on two streets . MOTION: By Mr. Michelson, seconded by Mr. Pierce, to recommend to the ' City Council approval of the Final Plat of W. A. Daniel Subdivision as submitted with the exception of the 20 foot alley -between the bulk of lot 7 and S . W. 56 Street for the . following reasons: (1) approval 'of the plat with the .20 foot alley does not conform to the 75 foot frontage as per the City ordinance and (2) the possibility exists that lot 7 could be subdivided in that there would now be legal frontage on S . Succop, Architect, and Mr. Ed Sintz, Director of the new library to be built on the site presented the plans to the Board . Discussion was had concerning the right of way width on Sunset Drive of 100 feet . Mr . Russe presented a. letter he had received from Dade County Page 2 - 11/30/76 jk stating they would not require a 100 foot right-of-way and requesting the City of South Miami consider permitting the County to use the same setbacks for the proposed library site as was permitted for the Allstate Insurance Building. Mr. Pierce stated that although the county did not want the 100 �foot front right-of-way at the location the City' s Ordinance, Section 8-7 .01, "Official. Right-of-Way Widths " specifically states it shall be 100 feet. Discussion was had concerning possibly sliding the building to the southwest 15 feet. Chairman Masters suggested the applicant change their request for a variance to a change of zoning to C-2 which would eliminate the need for a variance for the side " setbacks . The applicant then withdrew their request voluntarily stating they would reapply for a change of zoning to C-2 and return to the next regular meeting of the. Planning Board on December 14, 1976. Chairman Masters asked if there was anyone else who wished to speak for or against the applicant. Mr. D. A . Konopisos of 9159 S . W. 77 Avenue "stated that he is a design engineer working with The" Bodyworks which hats taken over the Allstate Insurance Building next door and he would like to see the plans to know how it will look in relation to the Bodyworks building. After inspecting the plans he stated he would not have any objections. Hearing #76-31 Manuel E . Chairman Masters announced the public hearing was in session and asked if there was anyone present wishing to speak for or against the request. Mr. Richard G. Dunberg, Attorney for applicant, presented the request to the Board. He stated that Mr. Pelaez had hired Delta Pools to construct the pool. They made a mistake and took the permit out from Dade County rather than the City of South Miami. The pool was built in conformity with Dade County setbacks and inspected by Dade County inspectors . EXECUTIVE SESSION: Mr. Pierce stated he would like to recommend to the City Council, through the City Attorney, that the City should take firm action against Dade County for issuing Building Permits for the -City of South Miami. MOTION: By Mr. Pierce, seconded by Mrs. Masters, to recommend that the City pursue any methods in correcting the county' s oversight , in checking the building permits before issuing permits within the corporate limits of the City of South Miami and whatever legal recourse to reclaim lost revenue and damages should be attempted. VOTE IN FAVOR OF MOTION: Yes - 7 MOTION CARRIED UNANIMOUSLY. Mr. Fleischer stated that he felt it was presumptuous of Dade County to go to the expense of producing a set of plans for the library without first checking with the City of South Miami to make certain that it conformed to the City ordinances . Planning in Tallahassee regarding a general review of the Master Plan for the City of South Miami together with informal comments regarding the plan. The Pledge of Allegiance to the Flag of the United States of America was followed by the roll call. PUBLIC HEARING #76-21 William A. Daniel Request: Approval of Tentative Plat of W.A. Daniel Subdivision. Legal Description: The East 330 feet of the SE 1/4 of the SW 1/4 of the SW 1/4 . --of Section 24-54-40. - - - --- Location: 6439 SW 56th Street Mr. Bill Daniel, owner of the property appeared. He stated he has received tent-ative approval from the County; each lot meets every requirement and. is in keeping with dimensions of other lots in the area. A letter of intent was presented to the Board from Mr. Daniels. The land will be divided into 12 lots for proposed \ homesites, excluding lot #7 where there is presently a home. Dr. Herb Levine, of 5305 SW 64th Ct. appeared before the Board. He is a concerned resident, and questioned the adequacy of the lot sizes and what is proposed for the sights. Mr. Daniels advised that the lots meet specificiations as required and the homes would conform with the South Florida Building Code, and have proper setbacks. PUBLIC HEARING #76-21 (Cont.) 2, Mr. --Fleischer commented that if lots 11 and 12 were connected, this would eliminate the 20 foot wide entrance from lot 7 onto Miller. Road, a heavily traveled thoroughfare. The entrance and exit of lot 7 would then be on the cul-de-sac. Mr. Fleischer stated to use the 20 foot passageway for automobiles would bring the cars within close proximity to the buildings that might be built there.
