In accordance with the C-1 Building and Zoning 'Ordinances, multi- story construction, offstreet parking is required and shall have approval of the Council. We are,therefore, directing this matter to your attention for the con- sideration by the Council at their July 16th meeting in lieu of a three week delay for the next scheduled agenda. Regarding this ,particular site and parking, we wish to point out the following items as supplementary information. A. The City of South Miami maintains a public parking lot directly across the street. B. The existing building location makes additional parking spaces almost impossible on the site. Any additional spaces off 73rd Street or 58th Avenue would mean backing into the street - this is certainly undesireable with in- creasing traffic, or even today's traffic. C . Traffic, being what it is today and getting worse, it is our opinion that NO consideration should be given to ttKe closing of right-of-ways anywhere. Rather, we should consider the improving and opening of more streets. 2. It would be a gross injustice to those homeowners 'adjoining this right-of-way to the south to have taken away from them a buffer strip 'as provided by a street. 3. Howard for a change in zoning which will permit the erection of a bowling alley on the Northeast corner of S.W. 59 Avenue and S.W. 74 Street. We object for the following reasons (1 ) The zoning in this area is already poor. 0-1 zoning adjoins residential property without any sort of bxCfer strip between the two. A change to C-2 would considerably worsen the situation. (2) The original reason for changing the zoning on this property from residential to 0-1 was the owner's plea that he be regarded as a hardship case because his property adjoined C-1 zoning. By this reasoning all residents whose property is adjacent to Mr. Bower's are justified in pleading hardship at the present time. If a change to 0-2 is made, the hardship will be intensified. A situation will be created which the Board will not in all fairness be able to ignore. It will be impossible to hold the line an future zoning. (3) We feel - and we think rightly - that changes of this sort permit one man to profit financially at the expense of others. While the property under discussion will become more valuable by a change in zoning, the value of the adjoining land, as residential property, will be lowered. This is certainly discrimination against the home owners. (4) The residents of this area were given assurance by preVious councils that there would be no further changes in zoning until the need was very great and there was no more zoned land available for commercial development in the vicinity. We do not reel that this point has been reached. (5 ) If the proposed change is granted, it will certainly con- stitute spot zoning of the worst sort. Furthermore, we do not see how any ap lieation in any section for a similar change could then be refused. This applies particularly to the rest of the land in the W. A. Larkins Subdivision. ) (6) We do not see what will prevent the bowling alley's be- ing sold at a future date and used for any legitimate business which is covered by 0-2 zoning, regardless of desirability. I oppose any spot zoning or variance at any place, '. because this usually benefits a very few at the 4, expense of many. 2. I oppose a plan which would insert an area of C-2 zoning between existing 0-1 and RU-1. 3. I oppose any change of a small portion of this neighborhood. At the time of the last zoning change in this area, my neighbors and I agreed that we would not oppose a plan to enlarge the C-1 zoning then proposed IF we had some assurance that spot zoning in this vicinity would not occur. When we made this thlugnt - known to the Zoning Board and to the City Council, we were given this assurance. We know of a few requests far variances in this vicinity which have been denied, but which we know will be reactivated as soon as one case of a variance is allowed. There is so much vacant C-1 property in this area, that I feel it would hurt the area in general to alter its present status in any way until there is no more land left to build on. Harvey prepared the "use map" for future zoning of our City he indicated the closing of S.W. 58th Court exactly as re- quested by Mr. Bower, but, at the same time, Mr. Harvey suggested closing of S.W. 74th Street from S.W. 58th Avenue to S.W. 59th Ave. Under our idea for developing this erea, S.W. 74th St. would remain open. Thereupon a short recess was called, sc that interested persons could examine the proposed plan. Chairman Foster then read the following letters. From the South Miami Mortgage &. Title Co., , 5842 S.W. -. 73 St. "This company is. the owner .of . Laots 38 and 39, W. A, Larkins Subd. Our property adjoins that. of Mr. Bowers szught to be rezoned and is improved by the South Miami Title Building and the accompanying stores and offices. ' We are anxious to see Mr. Bower's property imprdved and developed, but we are opposed to the proposal of closing a portion of. SeW. 58th Court. It is and has been our feeling for many years that the principal business. district of South Mimi should and would be developed southward, as its development to fihe north is physically limited by the railroad tracks and other factors. If the business district is to develop to the south, it must have north and south streets to carry traffic and provide access. Therefore, we feel that the closing of 58th Court would be most undesirable and .would completely choke off and restrict the south traffd.c flow, which would normally be expected in the development of any business district. Mro Finn explained that under present. oning requirements several small I.,uildings could be constructed on the-property in- volved without any necessity of any variance from the zoning re- quirements.o M o Fink further explained that Mr. Bower would like to connstruct one large: building instead of several small ones and thereb;.-, provide a greet deal more off®street parking than would be pvovided should the small buildings be constructed. To do this '(that is, to build one large building) necessitates closing the street which now runs through the middle of the . property owned 'sir Mr. Bower. Fronk to explain the actual distance which it is reqt�icst,i!d to close 58th C€iurt, and the point at which it would be closed, Zoning 3-10-57 t Mr. Fink stated that Mr. Bower has requested closing of 5Sth Court for a distance of 159 feet, running north from 74th Street--)to a point approximately 15 feet south of Mr. Bower's north property line. A property owner interested in Lots 31 and 32 stated she would much prefer if the rest of that block of ' Soth Court also be closed, since it would assume the uses of an alley to the rear of Mrs. Bower's property and further, that the owners of the lots .9kti+itting .th_at short dead-end street would be assessed for the pavi�ig _6f that portion, which would be of considerable benefit to Mro Bower's property but of little use to the people who own,, the abutting lotso Chairman Foster then requested anyone who would care to speak further on behalf of Mr. Bower's request. There being no further statements for the proposal, Chairman Foster then requested those opposed to speak, Mr. Glasel addressed the Board to state that he is not opposed to building for business purposes , and that he under- stands that 74th from Route l is now already zoned for business. However, Mr. Glasel stated a strong opposition to the creation of any dead-end street, anywhere in South Miami, for any purposed r. Fink addressed the Board to state that 5J8th Court now ends at 74th Street, and is to all intents and purposes a dead-end street which Mr. Bower's proposal would largely eliminate. Mr. Garber withdrew from the Board on this question since he is interested in properties within this area involved. Mr,, Garber requested clarification on the question of installing a buffer wall on the south and east portion of the proposed building area to separate the largest parking lot from the residences across the street. Mr. Bower, who owns this property, was in the audience and stated that he would install such a wall. At this point Chairman Foster called the public hearing to a close. Smith to re- zone Lot 11, Blk 3 ROSSWOOD Sub. from R-4 to C-2o Chairman Foster read the notice of public hearing as follows: "Notice of Public Hearing ' "by the South Miami Advisory Zoning and Planning Board, September 10, 1957 at the City Hall at 8:15, PoMo on the application of Doris E. Smith, 7730 Sono 66 St. to rezone Lot 119 Blk 3 ROSSWOOD Subd. , (5959 S.W. 71 St.) from R-4 to C-2. "All interested parties are urged to attend the hearing. Failure to attend or object in writing shall constitute approval. Written approval or objection may be filed with the Board prior to the hearing, The Board reserves the right to make recommendations as it deems to be in the best interests of the area involved." Chairman Foster read portions of a letter received from Mrs, Smith and requested Mrs. Smith to address the hearing with a statement of just what her needs are. Mrs. ,Smith stated that she would like to have her property rezoned so that she could build a nice looking building, and also have a retail outlet at the same location. Mrso Smith described herself as a rack jobber of foliage plants. Further discussion revealed that ' Mrso Smith is desirous of securing a mortgage commitment for her proposed building and permission to operate her business from the location involved; with whatever zoning change is required to accomplish these purposes. Chairman Foster then requested any further discussion on behalf of the application. There being none, he then requested those opposed to the application. A property owner in the arena addressed the hearing to state that he is not particularly against Mrso Smith's rezoning. request, but that the entire 62nd Ave - Sunset Area is supposed to be rezoned to C-1 as a result of a 'previous hearing and two readings of the rezoning ordinance . Although the ordinance was tabled at the time it was presented for a third and final reading, that any rezoning to a lower classification than C-1 L would be spot zoning and might adversely affect the entire area in the future. Mr. Adams que.:tioned Mrso Smith as her to her ownership of the property involved. Mrso Smith stated she had purchased the property in 1945, that it contained a . frame duplex, in one half of which she has relatives now living, and the other half of which is supposed to have been vacated within the last day or so. Chairman Foster then read a letter of objection as follows° "Application of Doris E Smith to rezone Lot 11 Block 3 Rosswood (5959 SW 71 Street) from R-4 to C-2o "My property is located at 7040 SW 61 Avenue, Zoning 9-10-57 ,�- "In view of the pending ordinance to rezone the entire areas of which the above captioned propwty is a parts I object to the rezoning of the above to a classification lower than that provided in the ordinance. "I sympathize with Mrs Smith's situation. The strange and unexplained action of the City Council of South Miami in delay- ing the ratification of the rezoning ordinance, has left property owners in this area in a state of complete perplexity. The iner- tia of the Council with reference to this matter is hurting the property owner in the sale or use of his property. "Nevertheless, in the faint hope that the City Council will some day take final action, one way or the other, on the ordinance, I object to spot zoning of any part of the area involved in the ordinance." Chairman Foster asked Mrs. Smith if the Board would have her permission to study the requirements of the City in con- nection with the particular type of business intended and to reconsider in executive session her .application on the .basis of intended use, since it had to be determined just what type of zoning her business would require. Mrs. Smith stated that this would be perfectly all right with her. At this point Chairman Foster called the public hearing to a close, BOARD'S ACTION re Doris E. Smith application to rezone. In executive session, discussion :revealed this property located within the area previously determined to be C-1; also it was clearly shown that Mrs. Smith's business would require a C-3 or a very liberal C-2. zone and could never be operated as a C-1 usage. Mr. Carter, seconded by Mrs. Byers, moved that the applica- tion of Doris E. Smith to rezone Dot 119 Blk 3 ROSSWOOD Subd. , from R-4 to C-2 be denied as this action would constitute spot zoning:. Motion carried unanimously. The next item was a public hearing on the application of Mr. and Mrs. E. C. Segert for permission to construct a duplex on a non conforming lot No. 14 BEAVER Hl1MESITES. Chairman Foster read the notice of the public hearing as follows: "Notice of Public Hearing "By the South Miami Advisory Zoning and Planning Board, Septem- ber 10, 1957, at the City Hall at 8:30 P.M. on the application of "Mr. and Mrs. E. C. Segert, 7340 S.W. 63 Ave, Lot 14 BEAVER HOMESITES, South Miami, Florida 1 "for permission to construct a duplex on this property which measures 50 x 159.42 ft. ' Discussion revealed that numerous duplexes are constructed in the immediate vicinity on 50 ft. lots. There were no objections to the appli- cation and Chairman Foster then called the Public Hearing to a close, BOARD'S ACTION RE SEGERT: Mss. Byers, seconded by Mr,, Carter, moved on the application of Mr. and Mrs. E. Co Segert to construct a duplex on Lot 14, BEAVER HOMESITES, that the Zoning Board recommendre the request be granted, inasmuch as there are similarly situated duplexes all around and on 50 ft. lots, and there were no objections of any kind indicated. Larkins Subdivision., Our property adjoins that of Mr. Bowers sought to be rezoned and is improved by the South Miami Title Building and the accompanying stores and offices. We are anxious to see Mr. Bowerts 'property. improved and developed, but we are opposed to the proposal of closing a portion .of S. W. 58th Court. It is and has been our feeling for many years that the principal business district of South Miami should and would be developed southward, as its 'development to the north is physically limited by the railroad tracks and other factors. If the business district is to develop to the south; it must have north and south streets to -carry traffic and provide access. Therefore, we feel- that the closing of 58th Court would be most undesirable and. would completely choke off and restrict the south traffic flow-, which would normally be expected in the development - of any business district. In the past five years,' since we first built the original store-building on the corner of S. W. 73rd , Street and 58th Court, the amount of traffic, business and attendant parking problems have increased at a Mr. T. T. Foster - 2 - September 10, 1957 tremendous rate. Needless to say, we are pleased with the progress made and hope that it will continue. We feel that maintaining 58th Court and developing it as a north-south street is vital to continued progress.
