PRESENT: Edward H. Coburn Pat Masters Bernard Michelson Larry Yarborough Ronald K. Smith ABSENT: Bob Huey Clyde McCoy Mr. William E. Godwin, Director, Building, Zoning & Community Development Department, and Mr. Gilbert A. Russe, Building Official, .were also present. Public Hearing #79-1 Dr. George W. Barnes Request: Approval of Waiver of Plat. Legal Description: Lots 13, 14 & 15, Block 6, WESTERFIELD MANOR SECTIONS ONE AND TWO, PB 18/47. Location: S. E. corner of S. W. 42nd Terrace and Red Road. Chairman Smith announced Public Hearing #79-1 was in session and asked if there was any one present wishing to . speak for this request. Dr. George W. Barnes addressed the Board stating he owns three lots at 4224 S. W. 57 Avenue which he desires to divide into two lots in order to construct .two single family residences at the site and for this reason was requesting approval of Waiver of Plat. Chairman Smith asked if there was anyone else present wishing to speak for the request of the applicant. Mr. Melville Miller of 5775 S. W. 42 Terrace addressed the Board stating he did not wish to speak for or against the request of the applicant, however he would like to correct the location of the property to read "N. W. corner of S. W. 42nd Terrace and Red Road". instead of the "S. E. corner . . . " . Discussion was had by the Board and the secretary was instructed -i:.o make the change in the records. Chairman Smith asN,-d if there was any one present wishing to speak aga.ihst granting the request of the applicant. There being no one,. Chairman Smith deemed the Public Hearing closed. Mr. McCoy arrived at 7:45 P. M. Public Hearing #79-2 Collegiate Marketing, Inc. Request: 1. Variance to Section 8-9-2 of City of South Miami Zoning Code to allow the placement of a structure closer than one=half the officially designated right-of-way width of S. W. 71 Street. 2 . Variance to Section 7-2-2 of the City of South Miami Zoning Code to allow parking space arrangements and layouts different than design specifications required. 3 . Variance to allow 17 parking spaces where 65 are required. Legal Description: Lots 18, 19 and 20, AMENDED PLAT OF H. 0. COOPERS SUBDIVISION, PB 4/162 . Location: 5830 South Dixie Highway. Chairman Smith stated he was in receipt of a letter from Helen Miller Margolin in which she listed eight items objecting to granting the variances requested by the applicant and requested Mr. Michelson to read the letter into the record. Chairman Smith announced Public Hearing #79-2 was in session and asked if there was any one present wishing to speak for this request. Mr.. Robert Hutcheson, Architect, of 1190 San Pedro, Coral Gables, Florida presented two renderings of the proposed restaurant to the Board stating it is to be located adjacent to The Depot with the kitchens joined together, however, the new restaurant to be called "The Southern Hotel" will be a ,separate entity. He described the concept of the proposed Page 2 1/9/79 jk restaurant which will be a gourmet restaurant open for dinner only from 6: 00 P. M. until Midnight. It will have valet parking and leasing arrangements have been made with the City of South Miami to use the City' s parking lot and with McDonald 's Restaurant to use their parking lot. Mr. Dan Guthery, Vice President of Collegiate Marketing, Inc. and Mr. Jerry Forman, Attorney, of 3000 Biscayne Boulevard, further explained the concept of the proposed restaurant to the Board. Mr. Forman stated the request for variance # 1 is necessary since the existing building to be used is non conforming due to the fact that the official right-of-way width had changed since it was built. Variance #k3 is necessary since the building site will a.ccomodate 17 cars. However, leasing arrangements have been made to use the City' s and McDonald 's parking lots which will be more than ample for the restaurant' s use. He stated the restaurant has a seating capacity of 80. Chairman Smith asked Mr. Guthery to respond to the eight items contained in Mrs . Margolin ' s letter which he did stating in each instance the item was not germane to the proposed restaurant. Chairman Smith asked if there was any one else present caring to speak for or against the request of the applicant. There .being no one, Chairman Smith deemed the Public Hearing closed. Discussion was had by the Board. MOTION: By Mr. Michelson, seconded by Mr. Yarborough, to recommend to the City Commission approval of the variances as presented. VOTE IN FAVOR OF MOTION: Yes - 4 (Coburn, Michelson, Yarborough, McCoy) No - 1 (Masters) Abstained - 1 (Smith) MOTION CARRIED.
