Gardner, and I reside at 7871 S. W. 69th Avenue', South Miami, Fla. for a period of 12 years. I am objecting to the request of the applicant for a rezoning of the property in question from RU-1 to RU-4 for the purpose of construction of apartments, for the f ollwoing reasons: 1. ) All City of SoutYi Miami property adjoining this property is zoned residential RU-1. Property on the West, in the unincorporated area is zoned EU-1 and completely 'developed with one acre homes. Metropolitan Dade County purposely zoned the property to the South as .RU-2 to become a buffer zone from the Industrial area on S. W,. 81st St. The majority of this property has already been developed within their zoning restridtions. It cannot be denied that this development has been a decided improvement. 2.) The resident owners of property on the North, East, and West of the property in question feel that any commercial project would- definitely lower the value and quality of their residences. . My actual cash outlay .for the original cost and improvements amounts to $20,000. This includes no maintenance, taxes, etc. 3.) Dilce in the past, when this property was in the unincorporated area of Metropolitan Dade County, -the City 'of South Miami has gone on record as opposing any change in zoning. Also since this property was incorporated in South Miami, Metropolitan Dade County has opposed any change in zoning. The residents of this area have been contesting this zoning request since April 161 attending many meetings and spending long hours on this matter. It has been stated in the past that the owner of the property in question paid $44,000.00 and at present has an investment of over $70,000.00. I feel sure that the additional amount was not all for improvements. There- fore, there is no hardship on the property, for it can be used for single family residences. On March 11, 1964, the owner was granted a special use permit for the construction of an apartment house.' During the almost eighteen months interval nothing had been started and a new variance was denied. I have no one to protect an investment for me and if I make a wrong purchase I take the loss and I have no recourse .to anyone. Several times in the past the City of South Miami has .opposed.: any change of zoning for the property on the corner of S. W. 69th Ave. and -80th Street. Now in additions, a change of zoning is requested for Tract ."XI Block 5, West Larkin Park, commonly known as the "bowling alley strip, x%hick is directly adjacent to my residence. The apartment development will, according to the Plan submitted to the City of South Miami will include a four story building adjacent to my property. In conclusion, I believe the Planning Board and the City Commission has been more than patient in this matter and feel that now is the .time to protect the residents of this area and South Miami in general by denying the zoning request and retain the single family residential zoning. The area is now one of single-family dwellings. The requested change would have a traumatic effect on land use in-'the area and is clearly uncalled for and unnecessary. We feel that the requested rezoning, if granted, would create conditions highly undesirable and detrimental to the surrounding, developed low-density residential area. The zoning in the unincorporated area to the West is for one-acre estates and to the South for duplex residential. The proposed apartment zoning would be out of character with the County zoning and uses in the area.
