The minimum lot width for properties in this district is 60 feet, and the minimum lot area is 6,000 square feet. The subject property measures only 40 feet wide, and totals only 5,000 square feet in area, rendering the property nonconforming with respect to the required lot width and lot area dimensions. However, Section 20-4.8(D) of the City's Land -Development Code, entitled "Nonconforming Lots of Record," contains a provision for addressing this problem. The Code states that a single- family dwelling and customary accessory buildings may be erected on a single lot of record at the effective date of adoption or amendment of this Code, notwithstanding the minimum lot width or area for the zoning district. To take advantage of this provision, the lot must be in separate ownership and not of continuous frontage with other property owned by the same owner. My review of the ownership of the lots immediately adjacent show different owners, and therefore, the subject lot would meet the criteria of Section 20-4.8(D). The provision permitting development of lots of record which are nonconforming with respect to lot width and lot area is intended to help avoid situations where a property owner's property is rendered economically useless and unable to be used for development. Please note, however, that any proposed development on the property must meet all other requirements of the Land Development Code, including the required yard setbacks.
