A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, RELATING TO AN ORDER TO
THE CITY ADMINISTRATION TO ENTER INTO A CONTRACT WITH
THE WINSTON GROUP FOR SERVICES RELATED TO DEVELOPMENT
OF A TRANSIT - ORIENTED DEVELOPMENT DISTRICT ORDINANCE;
PROVIDING FOR A PRESENTATION BY THE WINSTON GROUP AT A
JOINT WORKSHOP OF THE PLANNING BOARD AND THE ERPB; AND,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on September 3, 1996, the City Commission voted 3:2
to approve the Transit- Oriented Development District Ordinance,
where said ordinance required four affirmative votes, in order to
be adopted, and, therefore the motion for approval failed; and,
WHEREAS, on October 22, 1996, the City Commission met with
the members of the Planning Board and the Environmental Review &
Preservation Board [ERPB] to discuss the proposed ordinance; and,
WHEREAS, the City Commission desires that The Winston Group
prepare a draft ordinance for joint review by Planning Board and
the ERPB prior to first reading before the City Commission; and
WHEREAS, the City Commission desires that The Winston Group
present the draft ordinance, as revised by the Planning Board and
ERPB, at first reading before the City Commission; and,
WHEREAS,

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The City Administration shall enter into contract
with The Winston Group for the preparation and two presentations
of revised Transit - Oriented Development regulations for a sum not
to exceed $6,000 and the disbursement shall be charged to account
number 001 - 2100 - 519.55 -90, "Urban Design Project - Charrette."

BACKGROUND & ANALYSIS:
Pursuant to the direction of the Joint Workshop on October 22, 1996, the following resolution is
presented for review and approval by the City Commission. City Administration is instructed to
retain the professional services of Jack A. Winston of The Winston Group, in order that revised
Transit - Oriented Development regulations may be developed as discussed at the workshop.
RECOMMENDATION: Approval.

This serves as a Letter of Understanding between City of South Miami and The Winston Group
in conjunction with Corzo, Castella, Carballo, Thompson & Salmon, regarding professional
services to be performed by Jack Winston to develop Transit - Oriented Development regulations
for the City of South Miami.
The Winston Group will perform services per the agreed schedule and hours as follows:

The City of South Miami and The Winston Group in conjunction with Corzo, Castella, Carballo,
Thompson & Salmon hereby agree, for the purposes of invoicing, that the maximum number of
hours for all service activities, both those listed herein and those not listed, that may be invoiced
to the City of South Miami, may not exceed a total of fifty (50) hours.
The City of South Miami and The Winston Group in conjunction with Corzo, Castella, Carballo,
Thompson & Salmon hereby agree that the maximum hourly fee that may be invoiced for any or
for all of the aforementioned
services may not exceed a total of $6,000.
The City of South Miami and The Winston Group in conjunction with Corzo, Castella, Carballo,
Thompson & Salmon hereby agree that those services listed as numbers 1 through 6 inclusive
shall be completed on or before January 14, 19970
The City of South Miami and The Winston Group in conjunction with Corzo, Castella, Carballo,
Thompson & Salmon hereby agree that tasks 8 through 14 will be completed in tandem with the
regular schedule for items in the Public Hearing process. The City and The Winston Group shall
work together with all diligence so that this process may be completed prior to April 16, 19970
The City of South Miami and The Winston Group in conjunction with Corzo, Castella, Carballo,
Thompson & Salmon hereby agree that this Letter of Understanding may be amended from time
to time, as agreed to by both parties in writing, prior to the completion of all tasks listed herein.
