Lightfoot Subject: Administrative Waiver Permit Facilitator (6811 SW 77th Terrace) REQUEST Peter Myrtetus, the owner of the property located at 6811 SW 77"' Terrace is requesting an Administrative Waiver to reduce the side setback from a minimum of 7' —6" to 5' —3" pursuant to Section 20-5.10(C)(1)(a) of the City's Land Development Code. BACKGROUND&ANALYSIS The owner is preparing to construct a one story addition onto his existing one story residence along the northern portion of his property, which is zoned RS-3. The applicant is asking for a reduction in the side setback in order to line up the proposed addition with the existing structure along the eastern side of the property. Currently, the property is below the 40% maximum impervious coverage as well as the 30% maximum building coverage. However, the parcel of land that the structure currently resides on does not meet the frontage requirements or the net area requirement for the RS-3 Zoning District. Pursuant to Nonconforming Lots of Record, Section 20-4.8(D) of the Land Development Code, this discrepancy has been overlooked. Aside from the issue regarding the side setbacks and the issues with the frontage requirement,the existing single family residence is in compliance with all other regulations as set forth in The Dimensional Requirements for Single Family Districts, Section 3.5E of the Land Development Code for the RS-3 Zoning District. The owner is asking for the side setback to be reduced from the minimum of 7' —6"to 5' —3". Once completed, the property will still be below both the maximum impervious and building coverage. The proposed improvements do not exceed the limitations of an administrative waiver, as set forth in Section 20-5.10(C)(1)(a). Furthermore, through review of the application and.inspection of the property, it has been found that the waiver (1) would be in harmony with the general appearance and character of the neighborhood and the entire community and (2) would not impose any substantial negative impact on the surrounding area. Lastly,the applicant has submitted the written consent of all surrounding property owners COMPREHENSIVE PLAN This requested administrative waiver does not conflict with the adopted Comprehensive Plan of the City of South Miami. RECOMMENDATION Staff recommends approval of the requested Administrative Waiver. Any construction will be in accordance with the site plan presented with the application. The applicant should be aware that only one administrative waiver may be granted for the subject property. The applicant is also required by ordinance to record this administrative waiver in the official Public Records of Miami-Dade County.
