A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, RELATING TO THE REQUEST
FOR A SPECIAL USE PERMIT FOR A "RESTAURANT, GENERAL," AS
SPECIFIED IN SECTION 20-3.4(B) (4) (B) OF THE LAND
DEVELOPMENT CODE, LOCATED IN THE SR (SPECIALTY RETAIL)
AND HOMETOWN OVERLAY ZONING DISTRICTS, AND SPECIFICALLY
LOCATED AT 5837 SUNSET DRIVE, SOUTH MIAMI, FLORIDA,
33143; AND, PROVIDING A LEGAL DESCRIPTION.
WHEREAS, Mr. Torres submitted an application to request a
Special Use Permit in order to operate a "Restaurant, General,"
as specified in Section 20-3.4(B) (4) (b) of the Land Development
Code, located in the SR (Specialty Retail) and the Hometown Overlay
zoning districts; and,

MIAMI, FLORIDA, 33143; AND, PROVIDING A LEGAL DESCRIPTION.
BACKGROUND:
Mr. Gaspar Torres applied for a Special Use Permit, in order to operate a General Restaurant at
5837 Sunset Drive, to be called "Laposse Cafe Bakery." The previous use at this location was a
restaurant similar in style, "La Bonne Boulangerie," which seated 20 patrons. The proposed
restaurant will contain tables and chairs to accommodate approximately 38 customers. The
proposed floor plan is presented as part of this application. The floor plan indicates that the
layout of the new use will be somewhat similar to that of the prior use. The restaurant will be
open for both lunch and dinner. The definition of the general restaurant use, the special use
conditions for all uses, and the specific conditions for "Restaurant, General" are included below:
DEFINITION [from Section 20 -2.3; found on page 16 of the Land Development Code]
Restaurant, general. Shall mean an establishment where the principal business is the sale of food and beverages
to the customer in a ready -to- consume state and where the design or principal method of operation consists of
either of the following: Sitmdown restaurants where customers are normally provided with an individual menu and
food and beverages are generally served in non - disposable containers by a restaurant employee at the same table
or counter at which said items are consumed; or, Cafeteria -type restaurants where food and beverages are
generally served in non - disposable containers and consumed on the premises. All such cafeteria -type
establishments shall provide only inside or patio service on private property. Catering service shall be allowed as
an additional use in the SR zoning district. In either the case of Sit -down or Cafeteria -type restaurants, public
streets, rights -of -way, and sidewalks may not be used for patio or street -side services of any kind. This use may
include takeout service, but exclude any service to a customer in a motor vehicle. Seating must be provided for
all patrons dining on the premises.
SPECIAL USE CONDITIONS
(A) General Requirements [from Section 20 -3.4; found on page 39 of the Land Development Code]
(1) All such uses shall comply with all requirements established in the appropriate zoning use district, unless
additional or more restrictive requirements are set forth below or by the City Commission,

(2) All such uses shall be determined to be of a compatible and complementary nature with any existing or
planned surrounding uses.
(3) A public hearing shall be held by the City Commission to determine the overall compatibility of the use
with the surrounding neighborhood.
(B) Special Requirements [from Section 20 -3.4; found on page 40 of the Land Development Code]

ANALYSIS:
Staff believes that the requested special use complies with the overall requirements stated under
Section 20 -5.8 of the Land Development Code [found on page 111], regarding the required
conditions for special use approval by the City Commission. Specifically, staff finds that the use
meets the conditional requirements set forth in Section 20 -3.4 and that the use:
a) Will not adversely affect the health or safety of persons residing or working in the vicinity of the
proposed use [Section 20 -5.8 (B)(1)(a)];
b) Will not be detrimental to the public welfare or property or improvements in the neighborhood
[Section 20 -5.8 (B)(1)(b)]; and,
C) Complies with all other applicable Code provisions [Section 20 -5.8 (B)(1)(c)].
The Planning Board voted 5:0 to recommend approval of the request for a special use permit for
a Restaurant, General in the SR Specialty Retail zoning district, as specified in § 20- 3.4(B)(4)(b) of
the Land Development Code, specifically located at 5837 Sunset Drive. Excerpted Draft Minutes

The undersigned requests a Special Use Permit to operate a cafe bakery in
the location described above.
Laposse Cafe Bakery is a family owned and operated business that was
founded in 1884. The over 100 years of experience and tradition has
allowed over forty successful locations in Mexico City and three in the
United States. Laposse cafe bakery began doing business in south Flo
rida
in 1993 with the opening of its first bakery in Kendall. Today, we have
over 50 employees and also have two additional locations in Bal Harbour
and Aventura. Also, soon to open are stores located on Alton Road, Dade
Station and South Miami.
The mission of Laposse Cafe Bakery is to originate, craft and market
products and services providing a refined ambiance that meets and exceeds
the consumer's gastronomic expectations, establishing leadership and
reinforcing our tradition.

Our products which are made with only the highest quality ingredients
available, consist of cakes, tarts, breads, bruschettas, sandwiches and salads
(See attached menu). These products are pre ared at our plant in Medley
and are delivered daily to each of our stores. Over 90 % of these products
only require re - heating. The remaining products are breads that are freshly
baked every monung on location.
Therefore the reason for our request for a Special Use Peniit is mainly to
allow our customers to eat the goods that we provide in our premises. The
number of seats that would be placed on the location is thirty- eight. Also

Mr. Illas read the request. Staff gave their presentation, stating that the applicant is applying for
a special use permit for a cafe bakery, which represents the same use previously at that location,
that will accommodate 38 customers. Staff added that no negative impact on the surrounding
area is anticipated and that approval of the application is recommended.
