Res No 154-96-9908RESOLUTION NO. 15496 -9908 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AFFIRMING RESOLUTION NO. 105 -96 -9859 ACCEPTING A "FINDING OF NECESSITY" REPORT FOR THE COMMUNITY REDEVELOP- MENT AREA IN THE CITY OF SOUTH MIAMI; DECLARING THAT CERTAIN AREAS OF THE CITY OF SOUTH MIAMI, FLORIDA AS SLUM OR BLIGHTED AREAS AS DEFINED IN SECTION 163.340, Florida Statutes (1995); DECLARING THE REBUILDING, REHABILITATION, CONSERVATION AND REDEVELOPMENT OF SUCH AREAS AS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY, MORALS AND WELFARE OF THE RESIDENTS OF THE CITY OF SOUTH MIAMI, FLORIDA, UNDER SECTION 163.355, Florida Statutes (1995); DIRECTING THE CITY MANAGER TO INITIATE AND PREPARE A PLAN FOR REDEVELOPMENT FOR ADOPTION IN ACCORDANCE WITH SECTIONS 163.360 THRU 163.365, Florida Statutes (1995); WHEREAS, the City Commission adopted Resolution NO. 105 -96 -9859 on May 21st 1996 by a 5 -0 vote; and WHEREAS, the City of South Miami, Florida desires to affirm that it has retained Dickey Consulting Services to prepare a report concerning a "finding of necessity" with respect to redevelopment; and WHEREAS, Dickey Consulting Services has prepared a "Finding of Necessity" report for the South Miami Community Redevelopment Area, dated April 1996 as set, and WHEREAS, the Mayor and Commission has considered expert testimony by Dickey Consulting Services concerning the existence of slum and blighted areas within the City in accordance with the "Finding of Necessity" report; and WHEREAS, the Mayor and Commission hereby finds that one or more slum or blighted areas, as defined in Section 163.340 Florida Statutes (1995), exists within the City's boundaries; and WHEREAS, the Mayor and Commission hereby finds that rebuilding, rehabilitation, conservation and redevelopment of said slum and blighted areas is necessary and in the interest of the public health, safety, morals, and welfare of the residents of the City of South Miami pursuant to the provisions of Section 163.355 Florida Statutes (1995); and WHEREAS, the Mayor and Commission hereby finds that said slum and blighted areas are appropriate for redevelopment; and NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section I_. That the mayor and Commission of the City of South Miami affirms the resolution accepting the "Finding of Necessity "; and Sectio2�1. That the Mayor and Commission of the City of South Miami accepts the "Finding of Necessity" report for the Community Redevelopment Area in the City of South Miami, dated April 1996. This acceptance, and the matters set forth in this resolution are expressly conditioned upon a finding by Metro Dade County that the South Miami Redevelopment Area is a "blighted" area within the meaning of Part III of Chapter 163, EWrb, a Statutes, and further conditioned upon a subsequent delegation of authority by Metro Dade County to the Mayor and Commission of the City of South Miami, pursuant to Florida Statute 163.410; and Section III. That, as evidenced by the expert testimony of Dickey Consulting Services, a blighted or slum area, as defined in Section 163.340, Florida Statutes (1995), exists and is specifically delineated in the accompanying report. The areas described in the report shall be referred to as the "South Miami Redevelopment Area." Section IV. That the rebuilding, rehabilitation, conservation and redevelopment of the South Miami Redevelopment Area as provided in the Community Redevelopment Act of 1969, Chapter 69 -305, Laws of Florida, Codified As Chapter 163, Part III, Florida Statutes (1995) (hereinafter referred to as the "Community Redevelopment Act ") is necessary and in the interest of the public health, safety, morals, and welfare of the residents of the City of South Miami pursuant to the provisions of Section 163.355, Fl"n Statutes (1995). Section V. That the South Miami Redevelopment Area is hereby found and declared to be a slum or blighted area as defined in Section 163.340, Ej ri Statutes (1995). Section VI. That the City Manager initiate and prepare a plan for redevelopment for adoption in accordance with Sections 163.360 thru 163.365, Florida-SSa (1995). Section VII. That this resolution shall be effective immediately upon its passage. The City Manager and Staff met with the TIF (Tax Increment Financing) Committee on July 23. Following that meeting, a letter was received from the Director of OCD notifying the City of the necessary steps to be taken to complete the requirements of F.S. 163, Part III "Community Redevelopment." We are now required to re- affirm resolution # 105 -96 -9859, relating to a "finding of necessity." This step will complete all of the requirements of South Miami. The process will proceed for designation of a Community Redevelopment Agency by the County Commission. The County Commission has final approval authority. I will inform you of the date and time for this item to be considered by the County Commission.
