Res No 091-18-15124RESOLUTION NO. 091-18-15124 A Resolution deferring the second reading of the Fellowship Church proposed amendments to the Future Land Use Map of the City of South Miami's Comprehensive Plan and the zoning map concerning the Fellowship Church property generally located northwest of the intersection of SW 72nd Street and SW 67th Avenue. WHEREAS, on April 17th, 2018. the Commission deferred the second reading of the two ordinances for Fellowship Church until May ISth; and WHEREAS, the attorney for the applicant has sent the Planning and Zoning Director a written request to defer these items since the Fellowship Church will not be able to submit the requested revisions in time for that meeting; and WHEREAS, in light of this request the ordinances in question were not advertised for the May IS, 2018 Commission meeting; and WHEREAS, the City Manager has indicated the City should defer the second reading until the June 19th , 2018, City Commission meeting; and WHEREAS, Section 20-S.S (E) (4) authorizes the City Commission to defer an Hem and it provides that "[a] request for deferral made by the city manager, planning director, planning board, city manager or city commission and shall not be subject to the requirements set forth above in subsections 20-S.6(E)(1)(2)(3). NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The application of the Fellowship Church and the 2nd reading of the following ordinances are hereby deferred to June 19, 2018: An Ordinance Adopting a Small-Scale Amendment to the Future Land Use Map of the City of South Miami's Comprehensive Plan, amending the designation of an approximately 2.60-acre property generally located northwest of the intersection of SW 72nd Street and SW 67th Avenue, and as legally described herein, from Religious to Multiple Family Residential (Four Story); and An Ordinance amending the Official Zoning Map, amending the designation of an approximately 2.60-acre property generally located northwest of the intersection of SW 72nd Street and SW 67th Avenue, as legally described herein, from "R" Religious to "RM-18" Low Density Multi-Family Residential. Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. We are working to address all of the comments that were provided to us by the Commission at the last hearing. Our architect is in the process of studying/incorporating these changes and we are hopeful to have the design alternatives ready by May 2nd. As a result, we will not have the submittal packet in time for the May 15th meeting and will be requesting a deferral to the June 19th meeting. In the meantime, we would like to schedule a meeting with you for Friday, May 4th to review the updated site plan and obtain your feedback. Instead, they're going to ask for a deferral until June 19th . As I read the Code, if the applicant requests a deferral, they have to pay a fee equal to 25% of the original filing fee and the hearing has to be delayed at least 60 days. On the other hand, city staff, the Planning Board and the Commission can request the. deferral and not subject the applicant to those requirements. Would you like to request the deferral?
