BACKGROUND Located in the "West Larkin Park" subdivision, the 125' by 125' lot faces SW 77th Terrace with a total lot area of 15,625 square feet. Currently in construction, the applicant has elected to revise various aspects of the.new single family residence, which is zoned RS-3. In order to correctly submit a plan for revision, it must be presented to the Board for review first. Because of this, it is being presented to the Board as a revision to the plan. ANALYSIS The revisions to the plan are as follows: 1. On the southern (front) elevation, the group of four (4) windows on the first floor is being revised to allow for an additional column to be placed in the center of the group. 2. On the northern (rear) elevation, the two windows that were originally on each side of the two entrances to the balcony have been removed. Also removed were the windows that were on both sides of the entrance on the first floor of the residence. 3. On the western (left side) elevation, the entrance to the family room in the rear of the property has been removed. The property presently complies with all requirements stated within the Dimensional Requirements for Single-Family Districts, Section 20-3.5(E) of the Land Development Code for the RS-3 Zoning District. For comparison purposes, please refer to the attached set elevations that was approved by the ERPB. RECOMMENDATION: Approval with the following conditions: 1. ERPB Mins 8-7-2007 Pg 1 of 11 Action: Mr. Julian Perez, Planning Director, introduced to the ERPB members a letter that references Mrs. Sharon McCain's, inquiries regarding Red Road Commons. In the letter dated August 7, 2007, Ms. McCain raised nine questions (see: Attachment A), which were addressed as follows: 1) Plans are clouded to indicate the changes/revisions. 2) Restrictive covenants or a legal concern are addressed on the contract agreement. 3) Applicant is bounded to the plans through the PUD. Any changes will need to be re- submitted and reviewed by the Board, if they are determined by the Planning Director to be major revisions to the adopted Master Plan. 4) No overspills are allowed by Ordinance. 5) No revisions/reductions have been proposed for the landscaping. 6) On-street parking spaces on SW 57th Avenue (Red Road) have been approved by the state, on-site parking has been approved by the city. 7) Ingress and egress has not been. changed. Mr. Proctor added that new and modern signalization will be added on the Red Road entrance, the facility is self contained, and there is a secondary means of access on SW 68th Street which is a public street, the entrance through SW 66th Street will not impact this residential area, indeed this would be controlled and it will be a right hand turn out, which will limit the impact on the residential area. 8) The answer to this question was previously answered by Mr. Proctor. 9) The Planning Director, Mr. Perez, stated that the Site Plan Committee consists of City department staff, including Public Works Director. Mr. Ajibola Balogun, Public Works Director had several questions regarding specific conditions in the executed agreement. The Public Works Department Director and staff met with the applicant to address the questions regarding the agreement. In addition, there were some inquiries dealing with the traffic, and the applicant addressed those concerns, and the Public Works Department was satisfied with there response. Mr. Chandler thanked the applicant for considering the Board's comments. The Board members had no further comments on this item. Applicant Present: George McArdle Mrs. Cabrera read the item into the record. Action: Mrs. Mark inquired where deliveries would take place. She also questioned the seating capacity of Ra Sushi restaurant, and whether or not the parking garage could sustain the capacity of the three restaurants combined. Mr. McArdle responded that the deliveries will take place in the back alley of the building. Mr. McArdle responded that the seating capacity is approximately 100 seats. Mr. McArdle responded 430 spaces is the capacity. Mrs. Mark then inquired if there would be any problem with these restaurants and parking. Mrs. Cabrera stated that parking ratio is based on the proposed square footage. Mr. McArdle added that the restaurants are required 1 parking space per 100 square feet. Mrs. Cabrera added that the ratio 1 per 100 is the most restrictive as per the Land Development Code. The Board members had no further comments on this item. Vote: 7 Approved 0 Opposed 3) AWNING INSTALLATION: [ERPB-07-060] Applicant: Mr. George McArdle Location: 5829 SW 73 Street South Miami Municipal Parking Facility Request: Applicant is requesting final approval for the awning installation. Applicant Present: George McArdle Mrs. Cabrera read the item into the record. Action: Mr. McArdle provided an overview of the physical structure of the awnings. He stated that there is one pipe on the awning that runs horizontally. The purpose of the pipe is to provide outdoor seating. She questioned if the awnings are going to be fixed on the building, and if the 5ft extension of those awnings would be sufficient to cover the people who are waiting outside to be seated and/or dine outside. Mr. McArdle responded that the awnings will be fixed on the building. He added that they are simple awnings with an angle, and an 8 inch valance at the bottom. Mr. McArdle also stated that the 5ft projection is sufficient to cover anybody who is waiting to be seated and/or is dining outside. Mr. Glukstein stated that these canopies are clear anodized aluminum, and the signs sit on these canopies, and they have 5 ft projections that are cabled back to the building. He added that whenever there is a design on the building it is either a canopy where the signs sit to define the individual spaces or they are sloped awnings. Mr. Glukstein added that these awnings have been on the design since the very beginning, and added that when the signage plans were approved, the signs were indeed held up by these canopies. All of the Board members complimented the architect on the "contemporary building design." The design reflects the existing narrow conditions of the site. Mr. Bedell suggested to the architect that there should be consistency with the tree and shrub requirements as per the Land Development Code. Mr. Jude informed the Board of the concerns that some residents had, concerning the flat roof design.", Mr. Fernandez requested that. the architect consider the triangle of visibility and that the mechanical system at the roof be properly screened. The proposal for a concrete landing, a new sloped walkway (accessible route), and two new handicap parking spaces were discussed among the Board members and the applicant. Mrs. Mark questioned the parking spaces and wanted to confirm.that it complies with the Land Development Code. As part of the conditions in the staff report the proposed accessibility must be consistent with the Land Development Code, the ADA (American Disability Act), and the Florida Building Code. Action: The applicant is requesting approval for the revision of the site plan that was previously approved by the Environmental Review and Preservation Board (ERPB) on October 18, 2005. The revisions to the plans are as follows: 1. On the northern (front) elevation, the window that resides above the entrance to the building has been altered from the double window that was originally approved. On the southern (rear) elevation, the two windows that were on the second floor on the east side of the fagade have been changed to two (2) sliding glass doors with a balcony. 3. On the western (side) elevation, the trim that goes along the building as well as the four (4) columns that are on the second story have been removed from the building. 4. On the eastern (side) elevation, the trims as well as the two windows located on the second floor in the rear have been removed. The Board members stated that the changes that were made are difficult to find, since most of the changes are not clouded in. Mrs. Mark expressed her concerns with the fourth revision of the removal of the two windows in the rear that were located on the second floor. Mr. Chandler agreed with her statement. Mr. Bedell proposed for two skinny palms like Solitaire or Thatch palms with a minimum of 12ft in height to be placed on each side of the blank wall, one palm on each side of the wall in the rear. Motion: Mr. Chandler moved for a final approval with the following condition, (1) to require the applicant to place one palm on each side of the blank wall. Mr. Balli seconded the motion. • Mr. Jude inquired if there was any way to prevent these changes from occurring before the applicant comes before the Board. Applicant Present: Hank Courtney Mr. Lightfoot read the item into the record. Action: Mr. Courtney is proposing to paint the exterior facades of two buildings (Washington Mutual, 5801 Sunset Drive, and Margaux, 5805 Sunset Drive). Several Board members proposed that there be an accent color assigned to the trimmings. Mr. Courtney agreed with this proposal, and when the accent color is chosen it will coordinate with the colors that have been selected for Washington Mutual and Margaux Store. Mr. Balli suggested the color white as an accent color. Motion: Mr. Chandler moved for a final approval with the following condition: (1) the body colors of the buildings and the trim pieces of the building have an accent color such as white. Action: Mr. Chiu presented the Board members with a revised perspective rendering and color selection. Mr. Chiu explained the revisions that were made to the property. Mr. Chandler expressed his concerns with the removal of the awnings, which leaves a blank wall. The Board members agreed with Mr. Chandler. Mrs. Mark added that the awnings help by softening the appearance of the house, and suggested that the awnings be kept. Mrs. Mark expressed her concerns with the massive amount of gravel that is on the driveway area, which takes up the entire front yard, and stated that the Chattahoochee needs to be removed. Mr. Fernandez commented on the separation of the gravel and the grass area, and stated that there should be a divider between the grass and the gravel in order to maintain a good appearance. Mrs. Mark suggested that the original grass pavers be used. Mrs. Mark then commented on the location of the vent. The applicant responded that the vent could not be re- located, but it could be painted to match the house. Mr. Bedell suggested that evergreen be placed around the vent to cover the vent and the evergreen must be higher than the vent so that it can not be seen. Mr. Perez, (Planning Director) recommended that this application be approved as a preliminary project, subject to the applicant meeting with the Planning Department and making a determination, as to whether or not an Administrative Waiver is a feasible approach. Then the applicant can take the suggestions study them, make the changes and if the administrative process is indeed chosen, when the process is done, they come back before the Board for final approval. The Board members agreed with Mr. Perez's recommendation. Motion: Mr. Chandler moved for preliminary approval of the project with the following recommendations: 1. Reinstall the three awnings on the house. 2. Leave the vent where it is located, paint the existing vent to match the house, and place evergreen on either side for symmetry, the evergreen is to be taller than the vent in order to cover it. 3. The drive way is to be revisited, pending the-impervious coverage. 4. The landscaping is to be completed as per approved plans. Mr. Bedell seconded the motion. REMARKS ERPB Mins 8-7-2007 Pg 10 of 11 Mr. Perez, ,(Planning Director) stated that Mr. Peter Jude was re-appointed at the last City Commission Meeting on July 30, 2007. Mr. 'Perez then stated that Mrs. Alicia Morales- Fernandez is in the process of being re-appointed due to an excess amount of absences. Mr. Perez thanked the members of ERPB, Planning Board, Historic Preservation Board, and Parking Board, for their participation in the Two-Story Ordinance Meeting, which was held on August 6, 2007. Mr. Perez stated that this meeting was very successful. Mr. Balli agreed with Mr. Perez's statement. Mr. Balli inquired when the Moratorium will end. Mr. Perez responded that it will end on September 5, 2007, and stated that the goal is to take the draft Ordinance to the Planning Board on August 14, 2007, where a public hearing will be held. From there it will go to the City Commission before September 5th for the first reading. Mr. Perez introduced one of the items that will be on the City Commission Agenda tonight, August 7, 2007, which is the Green Task Force for the City of South Miami. Mr. Perez noted that we will be one of the first cities in Miami-Dade County to have a Green Task Force. Mr. Perez mentioned that the Mayor will appoint one person from each of the Boards and two citizens. Mr. Balli stated that the idea of going green is to create incentives. Mrs. Mark stated that if new homes were built with solar water heating systems the electric bills will be less, and this would be a major incentive. Mr. Perez mentioned that this issue is addressed on the ordinance. He then said that the two-story workshop generated plenty of information, which brought ideas that will be dealt with in the Green Task Force. Mrs. Mark commented on her vote pertaining to the awnings for the South Miami Municipal Parking Garage. She stated that the Hometown Plan on this project is not being implemented, because the Hometown Plan encourages having wide awnings that will cover more of the street, and the proposed five feet will not be enough to cover people when it is raining. Mr. Balli agreed with her statement. Mrs. Mark added that impractical actions have taken place in this project including the way that these awnings and canopies are. Mrs. Mark then stated that the intent of this parking garage is to provide more parking spaces, and with the capacity of these restaurants and tenants it will cause a problem with parking space. Mrs. Mark stated that she is very disappointed with the outcome of this project. V. ADJOURNMENT Action: There being no further business, the meeting was adjourned at approximately 11:07 A.M.
