An Ordinance Adopting a Small-Scale Amendment to the Future Land Use Map of the City of South Miami's Comprehensive Plan, amending the designation of an approximately 2.60-acre property generally located northwest of the intersection of SW 72 nd Street and SW 67th Avenue, and as legally described herein, from Religious to Multiple Family Residential (Four Story). 9 WHEREAS, the Florida Legislature intends that local planning be a continuous and ongoing 10 process; and 11 12 WHEREAS, Section 163.3191, Florida Statutes, directs local governments to adopt needed 13 amendments to ensure that the Comprehensive Plan provides appropriate policy guidance for growth and 14 development; and 15 16 WHEREAS, Fellowship Church (the "Applicant") submitted an application to amend the Future 17 Land Use Map to change the designation of an approximately 2.60-acre portion of the property at 6781 18 Sunset Drive as legally described in Exhibit I, from Religious to Multiple Family Residential (Four Story) to 19 effectuate the development of a townhouse project; and 20 21 WHEREAS, the City of South Miami has prepared a small -scale Future Land Use Map amendment 22 to change the designation of the property from Religious to Multi-Family Residential; and 23 24 WHEREAS, the Local Planning Agency has reviewed the proposed amendments to the 25 Comprehensive Plan and held an advertised public hearing and provided for public participation in the 26 process and voted zero (0) ayes to six (6) nays to recommend approval to the City Commission on. 27 28 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF 29 SOUTH MIAMI, FLORIDA AS FOLLOWS: 30 31 Section 1. The City of South Miami hereby adopts the Small -Scale Amendment to the Future 32 Land Use Map for the property legally described as: the North 160 feet of the East 100 feet of the west 33 1/2 OF N 1/2 of the SE 1/4 of the SE 1/4 of the SE 1/4 and the East 1/2 OF N 1/2 of the SE 1/4 of the SE 34 1/4 of the SE 1/4, less the East 35 feet in Section 26, Township 54 South, Range 40 East, lying and being 35 in Miami-Dade County, Florida, as indicated on the Map below changing the Future Land Use Map 36 category from Religious to Multiple Family Residential (Four Story). 37 Page 10f2 1 2 \-Ill Ul ! The City Manager shall transm it the FLUM amendment to the Department of Econom ic 4 Opportunity and other review agencies as required by Chapter 163, Florida Statutes. 5 6 Section 3. Codification. The provisions of this Ordinance shall become and be made part of the 7 Future Land Use Map of the City of South Miami's Comprehensive Plan, as amended. 8 9 Section 4. Ordinance in Conflict. All ordinances or parts of ordinances and all sections and parts 10 of sections of ordinances in direct conflict herewith are hereby repealed . 11 12 Section 5. Severability. If any section, clause, sentence, or phrase of this Ordinance is for any 13 reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect 14 the validity of the remaining portions of this Ordinance or the Guidelines adopted hereunder. 15 16 Section 6. Effective Date.
