A resolution authorizing and directing the City Manager to solicit proposals 3
from contractors licensed to restore native pine habitats to restore the 4
property at 6609 S.W. 60 Street. 5

WHEREAS, the City of South Miami owns property at 6609 S.W. 60 Street; and 7
8
WHEREAS, in 1953 the Girl Scouts obtained use of said property via a 99-year lease 9
approved by a City Resolution; and 10

WHEREAS, in 1953 City Charter only provided for the leasing of City property in 12
Section 11 and Section 13 of the City Charter. Section 11 provided that: “No ordinance 13
granting, renewing or leasing the right to use the streets, alleys, public grounds or buildings of 14
the City of South Miami to any person, persons, firm or corporation, shall become a law or 15
effective in any way unless the same is passed by a vote of 4/5 of all the members of the City 16
Council; and no such grant, renewal or lease shall be for a longer period than 30 years ….” 17
and Section 13 provided that: “The City shall have the right, to acquire by purchase, gift, devise, 18
condemnation, or otherwise, property real, or personal, or any estate or interest therein within or 19
without the City and to improve, sell, lease, mortgage, pledge or othererwise dispose of the same or any 20
part thereof. 21

WHEREAS, even if a resolution could legally authorize the leasing of the property in 23
question, the term of the lease exceeded the authority of the City Council and the Girl Scouts are 24
currently occupying the property by the sufferance of the City; and 25

WHEREAS, members of the Urban Landscape Committee have requested permission 27
from the Girl Scouts to enter said property and inspect the fauna of said property, which was 28
denied by the Girl Scouts; and 29

WHEREAS, Boy Scouts approached nearby neighbors around Christmastime, 2017, 31
selling wreaths to obtain money for their Boy Scout project of cleaning invasive and noxious 32
plants at said property, which, as of this date, has not happened. 33

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 35
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: 36

Section 1. The City Commission authorizes and directs the City Manager to obtain 38
quotes from contractors licensed to restore native pine rocklands for full restoration of the 39
property at 6609 SW 60 St, (minus the area where the “Little House” and it’s parking lots are 40
located). In the event that the Girl Scout organization deny these contractors access to the 41
property the City Manager is directed to take the legal steps needed for the contractors to gain 42
access. 43

Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for 1
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall 2
not affect the validity of the remaining portions of this resolution. 3

Section 3. Effective Date. This resolution shall become effective immediately upon 5
adoption by vote of the City Commission. 6
