THE C ITY OF PLEASANT LIVING CITY OF SOUTH MIAMI OFFICE OF THE CITY MANAGER INTER-OFFICE MEMORANDUM To: The Honorable Mayor & Members of the City Commission FROM: STEVEN ALEXANDER, CiTY MANAGER Agenda Item NO.:jr DATE: April 3, 2018 SUBJECT: An Ordinance adopting an amendment to the Comprehensive Plan to amend the future land use category "Parks and Open Space" and to amend the Future Land Use Map of the Comprehensive Plan, to identify the area located under the Metrorail, including the Underline Linear Park, as part of the City's Parks and Open Space, and authorizing transmittal to the Florida Department of Economic Opportunity and other review agencies. BACKGROUND: The City of South Miami's Future Land Use Map provides the visual placement for land use categories identified in the Comprehensive Plan. The future land use map brings together most if not all of the elements of the comprehensive plan such as land uses, housing and transportation . It is a map of what the community wants to have happen; it is not a prediction. ANALYSIS: The vision of the Underline Project is to transform the underutilized land below Miami's Metrorail, from the Miami River to Dadeland South Station, into an iconic linear park, world-class urban trail and living art destination. The Underline as envisioned will connect communities, improve pedestrian and bicyclist safety, create over a hundred acres of open space with restored natural habitats, encourage a healthy lifestyle, provide an easily accessible place to exercise, create a mobility corridor that integrates transit, car, biking and walking, provide a 10-mile canvas for artistic expression, attract development along US1, and generate significant economic impact. At a minimum, the Underline is a significant ribbon of open space which is currently actively used by people from all walks of life including City Commissioners. Regardless of its progress toward becoming the proposed vision, it is desperately in need of foliage, especially trees. The inclusion of the Underline as part of our Parks and Open Space can help facilitate the addition of trees and other plants due to the continuation of the partnership the City has begun with the Underline. The proposed Future Land Use Map (FLUM) amendment will establish a Park and Open Space designation along the Underline within the City of South Miami. This will add 11.51 acres of park space to the City's park system. Park and Open Space Comprehensive Plan Amendment April 3,2018 Page 1 of 2 The folio numbers for the Land Use Map amendment are: • Folio: 09-4036-000-0260 Lot Size: 246,S91 S.F. • Folio: 09-4036-026-0040 Lot Size: 10S,S58 Sq.Ft • Folio: 09-4025-000-0970 Lot Size: 149,137 Sq.Ft Total Square footage: SOl,286 SF or 11.51 Acres The proposed text amendment will amend the Future Land Use Element to recognize uses associated with governmental entities on properties designated Parks and Open Space on the FLUM. STAFF RECOMMENDATION: Staff recommends approval on first reading and deferral to the April 10, 2018 Planning Board meeting for review and recommendation. 1 ORDINANCE NO. 2 3 An Ordinance adopting an amendment to the City of South Miami 4 Comprehensive Plan to amend the future land use category "Parks And Open 5 Space" and to amend the Future Land Use Map of the Comprehensive Plan, to 6 identify the area located under the Metrorail, including the Underline Linear 7 Park, as part of the City's Parks and Open Space, and authorizing transmittal to 8 the Florida Department of Economic Opportunity and other review agencies. 9 10 WHEREAS, the City of South Miami has contributed twenty-five thousand dollars 11 ($25,000) toward the planning of the Underline project as it is an open space of some 12 transportation utility with the additional benefit of having open spaces which may be 13 enhanced to provide more park like functions; and 14 15 WHEREAS, the City of South Miami has a desire to help facilitate the planting of 16 trees along the Underline and additionally to help enhance the possibility of the project in its 17 success in applying for and receiving grants to this end; and 18 19 WHEREAS, the City of South Miami has prepared a text amendment to the 20 Comprehensive Plan's Future Land Use Element in order to recognize uses associated with 21 governmental entities on properties designated Parks and Open Space on the Future Land Use 22 Map; and 23 24 WHEREAS, the City of South Miami has prepared a Future Land Use Map 25 amendment to designate the area located under the Metrorail in the City of South Miami as 26 Parks and Open Space; and 27 28 WHEREAS, on September 29, 2015, the Local Planning Agency reviewed the 29 proposed map amendment to the Comprehensive Plan, held an advertised public hearing, 30 provided for public participation in the process and voted six (6) to one (1) to recommend 31 approval of the amendment to the City Commission, and; 32 33 WHEREAS, prior to enactment, the Local Planning Agency ("LP A") will review, for 34 a second time, the proposed text amendment to the Comprehensive Plan, hold a second LP A 35 advertised public hearing, which will provide for public participation for a second time in the 36 process, and render its recommendation to the City Commission; and 37 38 WHEREAS, the City Commission, upon first reading of this Ordinance, authorized 39 transmittal of the Amendments to the Department of Economic Opportunity and review 40 agencies for the purpose of a review in accordance with Florida Statutes. 41 42 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 43 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: 44 45 46 47 48 49 50 Section 1. The City of South Miami Comprehensive Plan, Future Land Use Element, is hereby amended to read as follows: * * * Future Land Use Categories Page 1 of2 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 88 89 90 91 92 93 94 95 96 97 98 99 100 * * * * Parks and Open Space The Parks and Open Space land use category is intended to provide for public parks, park and open space areas, including those associated with public schools and other governmental entities. Sites designated Parks and Open Space should not be used for other purposes without an amendment to this land use plan. Zoning regulations could permit park and open space uses on sites not so designated by this plan. Zoning regulations should permit park-related buildings (e.g., indoor athletic and passive recreation facilities) on land designated as Parks and Open Space. * * Section 2. The City of South Miami hereby adopts the Amendment to the Future Land Use Map as indicated on the Map attached hereto and made a part hereof as Exhibit "A". Section 3. The City Manager shall transmit the FLUM and the text amendment to the Department of Economic Opportunity and other review agencies.; Section 4. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this ordinance or the Guidelines adopted hereunder. Section 5. Codification. The provisions of this Ordinance, upon its effective date, shall become and be made part of the City of South Miami's Comprehensive Plan, as amended, and, where appropriate, the Future Land Use Map of the City of South Miami's Comprehensive Plan. Section 6. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. Section 7. Effective Date This Ordinance shall become effective as provided by Chapter 163, Florida Statutes. PASSED AND ENACTED this __ day of ,2018.
