WHEREAS, the City's last advertised for legal services seven years ago in early 2011; and WHEREAS, the current City Attorney contract will expire on April 15, 2018; and WHEREAS, the original 2011 contract with the current City Attorney was for $200,400 per year, including litigation, but excluding labor law and pension services; and WHEREAS, the City currently budgets almost $500,000 for legal services, a funding level equivalent to other local municipalities that contract with full service legal firms specializing in municipal representation and providing specialists in land use law, contract law, and labor law; and WHEREAS, the Mayor and Commission wish to put out a competitive solicitation for legal services necessary to determine the most responsible and efficacious legal representation available to the City; and WHEREAS, the Mayor and Commission regardless of whether the current City Attorney or another provider is selected, wish to ensure continuity of legal services remain for the City by providing for a month-to-month contract period for the current City Attorney until such time as a new agreement for City Attorney services becomes effective. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: Section 1. Administrative staff is hereby directed to advertise a competitive solicitation for legal services to provide for the City's diverse legal needs including, at a minimum, expert representation the areas of municipal, contract, labor, and land use law for a flat annual fee. As an option, the provider may propose a separate hourly rate for litigation. Section 2. To ensure continuity of legal services for the City, the current agreement for City Attorney services, minus the termination period requirements, shall continue on a month-to-month basis, until such time as a new agreement for City Attorney services becomes effective. Section 3. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. Section 4. This resolution shall take effect immediately upon adoption.
