4 An Ordinance pursuant to Section 20-S.7 providing for a Map Amendment to the City of South
5 Miami Official Zoning Map to remove the Hometown District Overlay designation on a 9.68-
6 acre property known as The Shops at Sunset Place.

8 WHEREAS, FRIT Shop s at Sunset Place LLC has requested an amendme nt to t h e Offic ial Zoning
9 Map to remove t he Hometown District Over lay des ignation of the approximate ly 9.68-acre Shops at
10 Su nset Place property located southeast of US1, north of SW 72"d Street between SW 57 th Ave nue and SW
11 58 th Avenue; and

13 WHEREAS, the Loca l Plann ing Agency reviewed the proposed amendment to the Official Zo ni ng
14 M ap, he ld an advert ised pub li c heari ng on October 26, 2017, provided for pub li c partici pation in t he
15 process and rendered its recommendation of approva l to the City Commiss ion on a vote of 6-1.

17 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
18 SOUTH MIAMI, FLORIDA AS FOLLOWS :

20 Section 1. The City of South M i ami hereby adopts an amendment to t he Official Zoning Map, as
21 set forth in the ill ustration be low, removing the Hometown Distri ct Overlay (HD-OV) designation for The
22 Shops at Sunset Place property located between SW 57 th and 58th Avenues and, SW 72 Street and US1,
23 l ocated at 5701SW 72ed Street and more specifica ll y lega ll y described in the attached Exhibit 1.

4 Official Zoning Map of the City of South Miami as amended.

(; Sedio~ 3. §everabilit>!. If any section, clause, sentence, or phrase of this Ordinance is for any
7 reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect
8 the validity of the remaining portions of this Ordinance or the Guidelines adopted hereunder.

10 Sedio!14. Ordinai1ces in Conflict. All ordinances or parts of ordinances and all sections and parts

13 Section 5. Effective Date. This Ordinance shall be conditioned on the enactment of an Ordinance
14 creating Downtown SoMi (OS) zoning district and an Ordinance amending the Official Zoning Map
15 designation for The Shops at Sunset Place property from Specialty Retail (SR) to Downtown SoMi (OS)
16 district and shall become effective immediately alter the enactment of those ordinances.
