10 located southeast of US1, north of SW 72,d Street between SW 57 th Avenue and SW 58 th Avenue f rom
11 Specia lty Retai l (SR ) to Downt own SoMi (OS ); and

13 WHEREAS, the Loca l Plann ing Agency reviewed t he proposed amendment to the Official Zon i ng
14 Map, held an advertised pub li c hear i ng on October 26, 2017, provi ded for pub li c participation in the
15 process, and rendered its recommendation of approva l to the City Commission on a vote of 6-1.

17 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISS ION OF THE CITV OF
18 SOUTH MIAMI, FLORIDA AS FOLLOWS:

2 Sect;l)~ 2. Codification, The provisions of this Ordinance shall become and be made part of the
3 Official Zoning Map of the City of South Miami as amended,

5 Section 3. Severability, If any section, clause, sentence, or phrase of this Ordinance is for any
6 reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect
7 the validity of the remaining portions of this Ordinance or the Guidelines adopted hereunder.

9 Section 4. Ordinances in Conflkt. All ordinances or parts of ordinances and all sections and parts
10 of sections of ordinances in direct conflict herewith are hereby repealed,
11
12 Section 5. Effective Date. This Ordinance shall be conditioned on the enactment of an ordinance
13 creating Downtown SoMi (DS) zoning district and shall become effective immediately after the enactment
14 that ordinance creating the Downtown SaMi (DS) zoning district.
