4 An Ordi nance providing for a Small-Scale Map Amendment amending the City of South Miami
5 Compreh ensive Plan Future Land Use Plan Map from Mixed Use Commercial Residential (Four-
6 Story) to Do w ntow n SoMI (OS) (195 feet) on a 9.68-acre property known as The Shops at Sunset
7 Place and as legally described herein.

9 WHEREAS, the Florida Leg islature intends that loca l planning be a continuous and ongo ing
10 process; and
11
12 WHEREAS, Sect ion 163.3191, Florida Statutes, di rects loca l governments to adopt needed
13 amendments to ensure that the Comprehensive Plan provides appropriate po li cy gu idance for growth and
14 deve lopment; and
15
16 WHEREAS, the Planning and Zoning Department working with the Applicant, FR IT Shops at Sunset
17 Place Fee Owner LLC, prepared a new Future Land Use Map Category to meet the needs of The Shops at
18 Sunset Place Redeve lopment; and
19
20 WHEREAS, the City of South M iam i and Applicant have jO intly prepared a sma ll -scale Future Land
21 Use Map amendment to change the des ignation of the approximate ly 9.68-acre Shops at Sunset Place
22 property located southeast of US1, north of SW 72'" Street between SW 57"' Avenue and SW 58"' Avenue
23 from M ixed Use Commercia l Res identia l (Four-Story) to Downtown SoMi (OS); and

25 WHEREAS, the Loca l Planning Agency has reviewed the proposed amendments to the
26 Comprehens ive Plan and he ld an advertised pub li c hearing on October 26, 2017 and provided for pub lic
27 participat ion in the process and rendered its recommendat ion of app rova l to the City Commission on a
28 vote of 5-2.

30 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
31 SOUTH MIAMI, FLORIDA AS FOLLOWS:

33 Section 1. The City of South M i am i hereby adopts the Sma ll -Scale Amendment to the Future Land
34 Use Map as ind icated on the Map set forth below and changing the future l and use map category from
35 the Mixed Use Commercia l Resident ial (Four-Story) to Downtown SoM i (OS) for the property identified as
36 The Shops at Sunset Place at 5701 SW 72'" Street and lega lly described in the attached Exh ibit 1.

2 Section 2. Codification. The prov isions of this Ordinance sha ll become and be made part of the
3 Future Land Use Map of the City of South Miami's Comprehensive Plan, as amended .

5 Section 3. Severability. If any section, clause, sentence, or phrase of this Ordinance is for any
6 reason held invalid or unconstitutiona l by a court of competent jurisd iction, this hold i ng shall not affect
7 the va li dity of the remain ing portions of this Ordinance or the Guide li nes adopted hereunder.

9 Section 4. Ordinance In Conflict. All ordinances or parts of ordinances and all sections and parts
10 of sect ions of ord inances in direct confli ct herewith are hereby repea led.

12 Section 5. Effective Date . Th i s Ordinance shall be conditioned on the enactment of an ordinance
13 creat ing Downtown SoMi (DS) future land use category ("small scale deve lopment amendment") for the
14 City's Comprehensive Plan and it sha ll become effective 31 days after its adoption, if unchallenged,
15 otherwise, if it is cha ll enged, it sha ll become effective immediate ly after the state land planning agency
16 or the Admin istration Commission, respective ly, issues a fina l order determining that the adopted small
17 sca le deve lopment amendment is in comp li ance as provided by Chapter 163.
