Date: February 6, 2018 SUBJECT: 6 An Ordinance amending the City's land Development Code, Section 20-3.3(0) and Section 20- 7.112(A) and Section 20-3.4(11), regarding restaurant uses. BACKGROUND: Currently, the Land Development Code (LDC) contains several categories of restaurant uses that include "General Restaurant", "Small Restaurant", "Accessory Restaurant", "Convenience Restaurant", and "Walk up Restaurant." Of the restaurant uses mentioned, the "General Restaurant" use and the "Walk up Restaurant" use are the most commonly used categories. Pursuant to both the Permitted Use Schedule, Section 20-3.3(D} and the Permitted Storefront Uses, Section 20-7.12(A} ofthe LDC, both use categories require the applicant to obtain a Special Use permit from the City. Because of the time it takes to obtain the required permit, it may be a hardship on new restaurants opening in the City. As an ongoing effort to ensure that the LDC maintains consistency, the LDC is routinely cleaned up whenever an error presents itself. In this situation, it was identified that the "Small Restaurant" use is still listed in Section 20-7.12(A} of the LDC. On February 3, 2009, the Commission adopted Ordinance #01-09-1993, removing the "Small Restaurant" use and its' special use conditions. Most likely an oversight, the removal of the "Small Restaurant" use in Section 20-7.12(A} was overlooked. ANALYSIS: For a Special Use Permit to be granted, the application must be reviewed by the Planning Board and approved by the City Commission. In an effort to foster economic development in the City and assist new restaurants, the City is proposing that both the "General Restaurant" use and the "Walk Up Restaurant" use categories be amended so that they are both permitted by right in all the commercial districts where they are permitted. Currently, new restaurants entering the City must go through the lengthy special use process before they can obtain a building permit for construction or a Business Tax Receipt for operation. By amending the LDC, the time needed to go through the required City reviews would be reduced by up to three (3) months. It is Staffs' Jecommendation that the City could benefit from the reduction in time that it takes for a Restaurant Special Use Text Amendment February 6, 2018 Page 2 of 2 restaurant to get started. A reduction in time could create a more positive and attractive appearance in the Downtown area by filling vacant storefronts sooner. When researching the LDC for a list of the restaurant uses that are permitted in the City, it was realized that the "Small Restaurant" use was still listed in Section 20-7.12(A) even though the City Commission effectively removed it via Ordinance #01-09-1993. At the time the ordinance was adopted, it was the observation of the Planning Department that limiting the location of small restaurants to the Hometown District caused a negative effect on restaurants that wanted to locate in other areas ofthe City. To comply with the original intent of Ordinance #01-09-1993, it is Staff's recommendation that the "Small Restaurant" use be removed from Section 20-7.12(A} as well. PLANNING BOARD ACTION: After the public hearing held at the Planning Board's January 9, 2018 meeting, the Board recommended approval of the application with a vote of 6 ayes to 0 nays. RECOMMENDATION: Staff recommends that the City Commission adopt the proposed ordinance. Mr. Lightfoot explained the special use permit process. Mr. Basu asked what was prompting the creation of this item. Mr. Lightfoot stated that staff was directed to create the ordinance which would hopefully assist future restaurants in the City by speeding up the time it takes to get permitted and lowering the costs by not requiring the special use permit. 2 Mr. Basu stated that the only issue he has with the iterp is how parking will be addressed. Mr. Lightfoot stated that parking will still be addressed administratively. Mr. Basu stated that this ordinance should be coupled with a revised parking section of the LDC. Ms. Tompkins responded that revising the parking section of the LDC is part of the LDC Rewrite but won't be coming before the Board until later in the year. Ms. Tompkins also stated that the Special Exception application which is used to address parking issues in the Hometown, would still come before the Board. Mr. Robinson asked if only new restaurants would need togo through the special use permit process, to which Mr. Lightfoot stated yes.
