BACKGROUND: l a rkin Community Ho spital, Inc. recently submitted plan s to ex pand the Neuro sc ie nce Center at 6129 SW 70 th Street by approximately 2,000 square f ee t. Th e Center is th e only buildin g in th e block bound ed by SW 62 0d Avenue, SW 70th Stree t , SW 69 th Street, and SW 61 st Avenue. Th e r em aind er of th e block is d eve lop e d with a surface parkin g lot. Th e Center, a portion of the parkin g lot surroundin g it, and the ho spit al building at 7031 SW 62 0d Avenue were joined by a uni ty of title in 1969. Th e unity of titl e has bee n r evise d sinc e, most r ece ntl y in 2012 w hen an office condominium building at 6140 SW 70 t h Street was added. Approximately 110 par kin g spaces are includ ed in th e lot s covere d by th e unity of titl e. Thi s is in sufficient to mee t the l and Deve lopm e nt Code (lDC) par kin g requirements for a ho sp ital use. In order to allow th e ex pansion of th e Neuro sc ienc e Center, the property should be brought into compliance with th e LDC park in g re quirem ents. There are approximately 174 parking sp aces on th e remainder of th e blo ck surrounding the Ce nter that are not included in the unity of titl e. By expanding the unity of title to includ e those lots, th e ho spital will comply with th e parkin g requirements. ANALYSIS: Th e ap plic ant is proposing to combine the followin g prop ertie s: Property Zoning District 7031 SW 62 Avenue Ho spital (H) 6129 SW 70 Street Ho spit al (H) 6140 SW 70 Street Medium Int ensi ty Office (MO) lots 1 through 18, inclu siv e, of Block 14, Rea lty Securities Corporation's To w nsi t e of Larkin s, as Ho spital (H) r ec ord ed in Plat Book 2, Pag e 105, of the Public Reco rd s of Miami -Dad e County, Florida larkin Community Hospital, Inc. -Request for Approval of Unity of Title February 6,2018 Page 2 of 2 To bring the hospital into compliance and allow the development of the proposed addition, parking spaces from the adjacent existing surface parking lot must be used. These spaces would be considered off-site parking, which is regulated by LDC Section 20-4.4(F)(2} as follows: a. Off-site parking spaces shall be permitted in RM, RO, LO, MO, NR, SR, GR, TODD, H, PR and PI districts, with the provision that if off-street parking is adjacent to residentially zoned properties and/or RO zoned properties, special use process would be applicable for approval b. Required off-site parking spaces may be located and maintained up to three hundred (300) feet from the principle use requiring the additional spaces. c. Off-site parking spaces shall be on land held in common ownership with the lot on which the prinCipal use will exist under a Unity of Title insuring that the required parking will be provided. If at any time off-site parking ceases to be under the same ownership or control as the principal use or ceases to be used for parking for the principal use, the certificate of use and occupancy for the principal use shall be subject to revocation by the city manager, after notice and hearing. The subject properties all reside in zoning districts that permit off-site parking spaces and are within three hundred (300) feet of both the principle building as well as the proposed addition. Finally, the proposed Unity of Title will take the place of all the previous instruments, including those filed in 1969, 1970, and 2012 as well as the Substitution Agreement that was filed in 1973. NOW THEREFORE, in consideration of the issuance of the Construction Permit for some of the subject property and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Owner hereby agrees to the following: Restrictions: Owner hereby restricts the use of the subject property in the following manner: 1. The properties described as Parcel I, Parcel 2, Parcel 3 and Parcel 4, above, shall be considered as one plot and parcel of land 2. No portion of said plot and parcel of land shall be sold, transferred, devised or assigned separately, except in its entirety as one plot or parcel ofland. 3. No portion of said Propcrty shall be conveyed, mortgaged and/or leased separate and apart from each other and they shall be held together as one tract Substitution of Unity of Title: This unity of title shall take the place of, and substitute, the 1969 Unity of Title, the 1970 Unity of Title, the Substitution Agreement and the 2012 Unity of Title, all of which shall be deemed released upon the recording of this document in the public records of Miami -Dade County, Florida. Owner's Representations: The owner represents that all of the statements set forth in the recitals to this Unity of Title are true and correct, that the City is relying on the truth of these recitals and that said recitals are made a part hereof as if fully set forth herein. City Inspection: As further part of this Unity of Title, it is hereby understood and agreed that any official inspector of the City of South Miami, or its agents duly authorized, may have the privilege at any time during normal working hours of entering and inspecting the use of the premises to determine whether or not the requirements of the building and zoning regulations and the conditions herein agreed to are being complied with. Covenant Running with the Land: This Unity of Title shall constitute a covenant running with the land and shall be recorded, at the Owner's expense, in the public records of Miami-Dade County, Florida. It shall remain in full force and effect and be binding upon the undersigned Owner, and its heirs, successors and assigns until such time as the Unity of Title is modified or released in accordance with the provisions of this Unity of Title. A release will be executed when none of the reason for the execution and recording of this Unity of Title no longer exists and there is no further reason to maintain the Unity of Title on the public rccords. These restrictions shall be for the benefit of, and limitation upon, all present and future owners of the real property and for the public welfare. Term: This Unity of Title is to run with the land and shall be binding on all parties and all persons claiming under it for a period of thirty (30) years from the date that this Unity of Title is recorded, after which time it shall be extended automatically for successive periods of ten (10) years each, unless released by the City of South Miami. The City shall havc the right but not the obligation to re-reeord this instrument [rom time to time. Modification, Amendment, Release: This Unity of Title may be modified, amended or released as to the land herein described, or any portion thereof, by a written instrument executed by the, then, owner(s) of all ofthe Property, including joinders by all mortgagees, if any, provided that all of the conditions and/or criteria which originally required the execution of the Unity of Title ceasc to exist and there is a cessation of any condition or criteria that occurs after the approval of the Unity of Titlc and which condition and/or criteria requires a Unity of Titlc and provided that the modified, amended or released is also approved by resolution passed and adopted by the City Commission, after a public hearing, and executed by the City Manager attested to by the City Clerk and signed by the City Attorney as to form, language, legality and execution thereof. Enforcement: Enforcement shall be by action against any parties or person violating, or attempting to violate, any of the terms, provisions and conditions of this Unity of Title.
