Tompkins, Planning and Zoning Direct0-;t~ February 6, 2018 /1 An Ordinance amending Section 20-3.3{E) of the City of South Miami Land Development Code permitting Outdoor Seating/Dining on all commercial properties that are within the Hometown District Overlay Zone (HD). BACKGROUND: The Hometown District Overlay Ordinance (HD) allows restaurant uses in the Residential Office (RO) district. Outdoor seating/dining, however, is regulated by Section 20-3.3(E) of the Land Development Code (LDC), and is prohibited for properties in the RO District. Accordingly, a RO zoned restaurant in the Hometown would not be allowed to offer outdoor dining/seating. ANALYSIS: Apart from the Hometown area, restaurants are prohibited in the RO district. This makes sense, as the RO districts often abut single-family residential zoning districts which are typically separated or buffered from higher intensity uses like restaurants. The Hometown Overlay, on the other hand, is intended to create an active, urban, pedestrian-oriented environment. Outdoor dining/seating contributes to this environment, and is a common feature ofthe traditional downtown character the regulations encourage. The proposed ordinance would thus further the intent of the Hometown Overlay. Currently, outdoor dining applications are approved administratively, and there is no requirement for any notice to the public. Staff notes, though, that the existing RO zoned properties in the Hometown abut residential uses and thus believe additional consideration should be given to an application. The proposed ordinance includes a requirement for posting a property with notice of the application and requires that any public comments be considered before a decision is made on the application. Staff believes these provisions, coupled with the other restrictions of Section 20-3.3(E), will offer adequate protection to the nearby residents. PLANNING BOARD ACTION: After a public hearing on January 9, 2018, the Planning Board recommended approval of the ordinance by a vote of four (4) ayes to two (2) nays. WHEREAS, the City of South Miami (the "City") currently permits outdoor dining/seating within all commercial properties, except for properties in the RO Residential Office Zoning District; and WHEREAS, the City adopted the Hometown District Overlay Zone (HD) in order to implement regulations characteristic of traditional downtowns and to enhance the City's community identity and sense of place; and WHEREAS, in furtherance of the intent and purpose of the Hometown District Overlay Zone (HD), the City currently permits outdoor dining/seating on properties within the Hometown District Overlay Zone (HD); and WHEREAS, City staff recommends modifying Section 20·3.3(E) of the Land Development Code to permit outdoor dining/seating on all commercial properties located within the Hometown District Overlay Zone (HD), including those zoned RO Residential Office; and WHEREAS, the Planning and Zoning Department has recommended approval of the Ordinance; and WHEREAS, on January 9, 2018, the Planning Board considered the Ordinance, and following a public hearing recommended approval of the Ordinance by a vote of four (4) ayes to two (2) nays; and WHEREAS, the City Commission desires to accept the recommendation of the Planning Board. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. A permit application for outdoor seating and dining or a sidewalk cafe on public property or on public rights-of- way or on private property contiguous with a public right-of-way, must be filed with the Planning and Zoning Department and approved by the City Manager prior to such use. The application shall include a layout (site plan) of the location of all tables, chairs (including number and type of chairs), benches, and other furniture; pedestrian ingress and egress; location of refuse containers; location of approved outdoor speakers; and other elements necessary to illustrate the proposed outdoor seating/dining use and area (all drawings must be titled, indicate orientation, and be at an acceptable scale). If applicable, the site plan must clearly indicate which seats and tables are on private property and which are on the public right-of-way. The City Manager shall require that an amended site plan be submitted in order to address specific problems. At least seven (7) days prior to the City's Manager's decision on an application for a property that is zoned RO Residential Office Zoning District and located within the Hometown District Overlay Zone (HD), the City shall post a sign on the subject property which identifies the nature of the pending application and the means by which questions or comments on the application may be directed. The City Manager shall consider any comments received by the public prior to issuing a decision on the application. *** Section 2. Codification. The provisions of this ordinance shall become and be made part of the Code of Ordinances of the City of South Miami as amended; that the sections of this ordinance may be renumbered or re-Iettered to accomplish such intention; and that the word "ordinance" may be changed to "section" or other appropriate word. Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this ordinance. Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances, that give the appearance of being in conflict when the two ordinances can be harmonized or when only a portion of the ordinance in conflict needs to be repealed to harmonize the ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby amended to harmonize the two ordinances. After Dr. Palmer re-asked her question, Mr. Basu responded that restaurants are permitted in the RO areas that are in the Hometown district but aren't permitted to have outdoor seating. The RO districts outside of the RO district don't permit restaurant uses of any kind.
