An Ordinance amending the City of South Miami Code of Ordinances; Chapter
8A, Section 8A-5 titled "Lobbyists; registration, reporting, fees, exemptions,
expenditures, and penalties" to amend subsection (a) and to add a new
subsection (h) regarding campaign consultants.

8 WHEREAS, it should be the goal of every local government to protect its taxpayers
9 from the unfair influence of special interest; and

11 WHEREAS, elected officials may have a bias in favor of campaign consultants who
12 have helped them get elected and campaign consultants may have an unfair influence over those
13 same elected official; and
14
15 WHEREAS, the City desires to amend Chapter SA, Section SA-5 titled "Lobbyists;
16 registration, reporting, fees, exemptions, expenditures, and penalties" to add a new subsection (h)
17 regarding campaign consultants.

19 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
20 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

22 Section 1. Chapter SA, Section SA-5 titled "Lobbyists; registration, reporting, fees,
23 exemptions, expenditures, and penalties" is hereby amended as to subsection (a) and to add a
24 new subsection (h) and to read as follows:

(a)
Ordinance.
* * *
This section shall be known as the City of South Miami Lobbyist Registration
30 (h) Prohibited Lobbing by Campaign Consultants.
31 (1) Prohibition. No campaign consultant shall lobby a member of the City
32 Commission for a period of 24 months for the duration of the member 's term to whom the
33 Campaign Consultant provide campaign consulting services. the term of the elected official
34 candidate.
35 (2) Definitions.
36 a. "Cam aign consultant" means any person or entity that receives or is promised
37 economic consideration in e)whange for who provides or facilitates campaign consulting services
38 to a candidate for elected office in the City of South Miami.
39 b. "Campaign consultant" shall include any individual who is an employee of or who
40 has a 10% or greater ownership interest in an entity that is defined herein as a campaign
41 consultant, except as otherwise excepted in this Section below.
42 c. Campaign consultant" shall not include:
43 i. any vendor for a campaign whose primary responsibility is to supply goods or
44 services for a campaign.
45 11. any employee of a campaign consultant whose sole duties are clerical: or

111. any employee of a campaign consultant who did not personally provide any
2 campaign consulting services.
3 d. "Campaign consulting services" means those servIces that involve campaign
4 management or campaign strategy.
5 e. "Campaign management" means conducting, coordinating or supervIsmg a
6 campaign to elect a candidate.
7 f. "Campaign strategy" means formulation of plans for the election of a candidate.
8 g. "Candidate" shall have the meaning ascribed to such term in Florida Statutes.
9 section 97.021(5). as amended and supplemented.
10 h. "Economic consideration" means any payment, fee, commission, gift, or anything
11 else of value received directly or indirectly as consideration for campaign consulting services.
12 The term "economic consideration" does not include reimbursement for out of pocket expenses.

14 Section 2. Codification. The provisions of this ordinance shall become and be made
15 a part of the Code of Ordinances of the City of South Miami as amended.

17 Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance
18 is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this
19 holding shall not affect the validity of the remaining portions of this ordinance.

21 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all
22 sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.

Section 5. Effective Date. This ordinance shall become effective upon enactment.
