A Resolution authorizing the City Manager to waive program fees for the
afterschool program, from January through June 2018.
The afterschool program is managed and operated by the City's Parks and
Recreation Department (lithe Department"). Transportation is provided
to participants from schools within the City. This program provides a
variety of supervised activities such as homework assistance, computer
instruction, organized recreation activities and games, arts and craft, and
dance. The goal of our program is to grow physically, emotionally,
socially and intellectually by playing, exploring and learning with others in
a fun, safe, healthy environment.
The program runs concurrent with the Miami-Dade County Public Schools
Calendar and serves approximately one-hundred (100) school aged kids
between the ages of 5-12. The City provides recreational staff,
instructors and college volunteers that are professional, motivated and
diverse role models for the children.
The following are some of the items required in order to become a
licensed child care provider under State law:
• Notarized application and fee
• Background screening info and employment/work history
• Approved annual fire inspection report
• Approved annual building/zoning/plumbing (Certificate of Use or
Occupancy)
• Transportation information (copies of driver's license, vehicle
insurance, inspection reports, physical examination, etc.)
• Current CPR & first aid cards/records
• Training requirements (approximately $200 per employee)
o Child Care Director (i.e. Supervisor, Asst. Director):
40 hour Introductory Child Care Training comprised of Part
I and Part II courses;
5 hours Early literacy & Language within 1 year of
employment;

10 hours of Annual In-service training completed between
July 1st and June 30 each year.
o Child Care Employee (i.e. Recreation Aide, Instructor,
Recreation Leader): 40 hour Introductory Child Care
Training comprised of Part I and Part II courses;
5 hours Early literacy & Language within 1 year of
employment;
10 hours of Annual In-service training completed between
July 1st and June 30 each year.
Financial Impact: The City budgeted $8,500 for the afterschool program for this year.
During the 9-month school calendar year, the afterschool program
generates approximately $19,000 in revenue. From August through
December 2017, the program generated approximately $8,000 dollars.
Based on the requirements of the State law, and in order to continue the
afterschool progam, from January through May 2018, the City will need
to forego an estimated $11,000 dollars in revenue from the participants
of the program, to continue the program for our kids and avoid being
found not in compliance with State law.
Recommendation: We are concerned that there is not enough time availiable until the
resuming of the regular schedule of the afterschool program, to address
all of the requirements of State law to the approval of the Department of
Children and Families. To ensure that the children do not suffer from lack
of this very successful program, we strongly suggest that the City resume
the afterschool program, at no cost to students, through the end of the
2017-2018 Miami-Dade County Public Schools Calendar year-June 7,
2018 as proposed in the attached resolution.

6 WHEREAS, the afterschool program is managed and operated by the City's Parks and

18 WHEREAS, under State law is the definition of "child care facility" which has as part of the
19 definition that there not be any the receipt of any type of payment, grant or fee from any source
20 for any child attending; and

22 WHEREAS, if the City offers the program without the receipt of any type of payment, grant
23 or fee from any source for any child attending, we will not be regulated as a "child care facility"
24 under State law and therefore, the City's afterschool program does not require a license from the
25 Department of Children and Families; and

27 WHEREAS, The City commenced its afterschool program operations on Monday, January 8,
28 2018; and

31 WHEREAS, while City staff researches and explores other options for the 2018-2019 school
32 year, staff strongly recommends that the City resume its afterschool program, at no cost, through
33 the end of the 2017-2018 Miami-Dade County School year-June 7,2018.

35 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY
36 OF SOUTH MIAMI, FLORIDA:

38 Section 1. The City Manager is hereby authorized to waive program fees for the
39 afterschool program, from January through June 2018.

41 Section 2. If any section clause, sentence, or phrase of this resolution is for any reason
42 held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect
43 the validity of the remaining portions of this resolution.

45 Section 3. This resolution shall become effective immediately upon adoption by vote of
46 the City Commission.

The Department received your licensure questionnaire describing the operations and activities of your
afterschool program. Based on a review of your questionnaire, it has been determined that your program
does not meet the definition of child care pursuant to s. 402.302(1), Florida Statutes because there is no
fee, grant or payment for the program. Therefore, you are not required to obtain a license from the
Department of Children and Families.
Please be advised that if you change the operation of your program, you will need to submit another
questionnaire.
