An Ordinance amending the City of South Miami Code of Ordinances, Chapter 3
8A, Section 8A-5 titled “Lobbyists; registration, reporting, fees, exemptions, 4
expenditures, and penalties” to amend subsection (a) and to add a new 5
subsection (h) regarding campaign consultants. 6

WHEREAS, it should be the goal of every local government to protect its taxpayers 8
from the unfair influence of special interest; and 9
10
WHEREAS, elected officials may have a bias in favor of campaign consultants who 11
have helped them get elected and campaign consultants may have an unfair influence over those 12
same elected official; and 13

WHEREAS, the City desires to amend Chapter 8A, Section 8A-5 titled “Lobbyists; 15
registration, reporting, fees, exemptions, expenditures, and penalties” to add a new subsection (h) 16
regarding campaign consultants. 17

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 19
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 20

Section 1. Chapter 8A, Section 8A-5 titled “Lobbyists; registration, reporting, fees, 22
exemptions, expenditures, and penalties” is hereby amended as to subsection (a) and to add a 23
new subsection (h) and to read as follows: 24

(a) This section shall be known as the City of South Miami Lobbyist Registration 26
Ordinance. 27

(h) Prohibited Lobbing by Campaign Consultants. 30
(1) Prohibition. No campaign consultant shall lobby the City Commission for a 31
period of 24 months following the end of an election cycle in which any official, to whom the 32
campaign consultant provided any campaign consultant services for that election cycle, is 33
elected. 34
(2) Definitions. 35
a. "Campaign consultant" means any person or entity that receives or is promised 36
economic consideration in exchange for campaign consulting services to a candidate for elected 37
office in the City of South Miami. 38
b. "Campaign consultant" shall include any individual who is an employee of or who 39
has a 10% or greater ownership interest in an entity that is defined herein as a campaign 40
consultant, except as otherwise excepted in this Section below. 41
c. Campaign consultant" shall not include: 42
i. any vendor for a campaign whose primary responsibility is to supply goods or 43
services for a campaign. 44
ii. any employee of a campaign consultant whose sole duties are clerical: or 45

iii. any employee of a campaign consultant who did not personally provide any 1
campaign consulting services. 2
d. "Campaign consulting services" means those services that involve campaign 3
management or campaign strategy. 4
e. "Campaign management" means conducting, coordinating or supervising a 5
campaign to elect a candidate. 6
f. "Campaign strategy" means formulation of plans for the election of a candidate. 7
g. "Candidate" shall have the meaning ascribed to such term in Florida Statutes. 8
section 97.021(5). as amended and supplemented. 9
h. "Economic consideration" means any payment, fee, commission, gift, or anything 10
else of value received directly or indirectly as consideration for campaign consulting services. 11
The term "economic consideration" does not include reimbursement for out of pocket expenses. 12

Section 2. Codification. The provisions of this ordinance shall become and be made 14
a part of the Code of Ordinances of the City of South Miami as amended. 15

Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance 17
is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this 18
holding shall not affect the validity of the remaining portions of this ordinance. 19

Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all 21
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. 22

Section 5. Effective Date. This ordinance shall become effective upon enactment. 24
