ANALYSIS: On January 4, 2011, Mr. Busiter was granted approval for the revisions to his project with the condition that the three 12 foot tall Palms that were against the side two-story addition be replaced with three (3) eighteen (18) foot Gumbo Limbo trees, which were approved on sheet L-1 in the permit set and that any other changes are also approved. On February 2, 2011,. a second zoning inspection was conducted to inspect the completed landscaping. It was found that the applicant did not plant the three (3) eighteen (18) foot Gumbo Limbo trees as required by the motion granted by the ERPB. Instead, the applicant planted three (3) Montgomery Palm trees that were eighteen (18) feet in height. Because of this change, the Planning and Zoning Department was unable to either approve the final ' zoning inspection, or recommend the issuance of the Certificate of Occupancy for this project. On February 9, 2011, the Planning and Zoning Department received communication from Bernard F. Superstein, legal representative for Mr. Busiter, requesting that the revision to the landscape plan be waived so that the applicant could obtain the Certificate of Occupancy. Because a motion for approval by the ERPB was granted for this project with the condition that the three (3) twelve (12) foot tall palms be replaced with three (3) eighteen (18) foot tall Gumbo Limbo trees, Staff is presenting this item to the Board to make a determination on whether or not the three (3) Montgomery Palm trees are acceptable in lieu of the three (3) Gumbo Limbo trees. Mr, Lightfoot replied that the applicant could add the three or replace the current trees. Mr. Chandler questioned if the purpose of the trees was to block the view of neighboring properties. Mr. Lightfoot responded by reading the section of the LDC in regards to Landscape requirements. Mr. Chandler questioned,if the applicant was going to remove the trees. The applicant responded that he would rather replant the trees. Mrs. Mark commented that the plans show that the view is blocked in order to provide privacy for the neighboring property. By substituting, the trees with 18' high palms the neighborhood privacy is not resolved. Mrs. Cabrera-Hernandez commented in order to be consistent the applicant would have to plant Gumbo Limbo trees and with staff's condition of three trees 18' high. Mr. Chandler commented that there are Gumbo Limbo plants and where would the applicant like them to go. Mr. Chandler questioned if the palms would be replaced by Gumbo Limbo or re- located. The applicant responded replace and keep them in the same place. Mrs. Mark questioned if the Gumbo Limbos would be placed for privacy purposes. The applicant responded that the property owners to the west can not see the property so it is not an issue of privacy. Mrs. Cabrera-Hernandez commented that the addition that came before the Board indicates that there is a hedge adjacent to the wall of the Gumbo Limbo, which is consistent with the permit set. Mr. Chandler opened for Public Hearing. No discussion - Mr. Chandler closed the Public Hearing. As you may be aware, my client has invested a substantial sum of money to convert a run down property into a residence the neighborhood can be proud of. The property has been completely remodeled. Accordingly, the property owner is requesting a Certificate of Completion from the City of South Miami. Apparently, during the process of the remodeling the property, the landscape plans originally submitted and approved, were revised to change the trees on the west side of the home from Montgomery Palms to Gumbo Limbos, without the owner's knowledge. The owner purchased Montgomery Palms as set out in the original plans, but has since been notified of the requirement to change out the Palms for Gumbo Limbos. The purpose of this letter is to request that the Montgomery Palms planted along side the west side of the residence be accepted by the City and that the Certificate of Completion be issued. In addition to the Montgomery Palms recently planted along the west side of the property, an established mango tree located on the west side of the front yard shields the residence from the street view. Mr. Lightfoot commented that the flat sign complies with the Land Development Code and the black background will be another application. Mrs. Cabrera-Hernandez replied that.the exterior upgrade will be handled by a different contractor. Mr. Jude recommended that the exterior be colored black when it comes back to the Board. Mr. Balli questioned if the last bay of the building is a separate store and should the last bay be colored black. BACKGROUND: Upon conducting the final zoning inspection for the project, it was found that various items did not match what the Board previously approved. In order to rectify this issue, the applicant was instructed to submit revisions to the approved plan for review by the ERPB. ANALYSIS: The revisions to the plan are as follows: 1. The applicant revised the entrance leading into the residence as well as the overhang above the second floor balcony. The applicant also removed the columns in front of the main entrance as well as the decorative shutters from the front of the residence. This is shown on sheet A-5 2. The applicant did not install the following windows on the residence: Two windows on the Left Elevation, shown on sheet A-5; . Two windows on the Right Elevation, shown on sheet A-5; and . One window on the Back Elevation, shown on sheet A-5. 3. The applicant also revised the Floor Plan, sheet A-4, to reflect these changes to the residence. The applicant also revised the landscape plan to remove plant material from the plan that was removed from the site. It is important to note that the applicant did install new palm trees as shown on the Landscape Plan approved by the Board. However, these new trees do not meet the height requirement listed in Section 20-3.5(H)(C)(8) of the Land Development Code, which states the following: Landscape Requirements. A minimum of fifty(50)percent of the entire front yard area shall be green space. All yard areas shall be landscaped with trees and drought resistant native vegetation, as necessary, to enhance privacy from abutting properties. The landscaped open space required by this Section shall consist of pervious landscaped area and- shall not consist of any paved or otherwise impervious areas. The minimum height of new trees for two-story homes shall be eighteen (18) feet. An inventory of existing trees located onsite shall be prepared and submitted to the Planning Department as part of the Environmental Review Preservation Board (ERPB) application. The required landscaped plan shall be prepared by Florida Registered Landscape Architect consistent with the City's Tree Ordinance. As per the attached excerpt minutes for the April 7, 2009 ERPB meeting, the applicant was required to make the height of the three (3) Montgomery Palm trees consistent with the section of the code listed above. Because the applicant did not comply with the condition of the Board pertaining to tree height, staff recommends that three (3) new trees be planted that comply with Section 20- 3.5(H)(C)(8) of the Land Development Code. 5. The applicant also revised the color scheme for the residence. The applicant painted the building with Americas Finest Exterior Acrylic (AF3011 N Flat) and white trim. A sample of the paint color will be available at the meeting. The property complies with all other requirements stated within the Dimensional Requirements for Residential Districts, Section 20-3.5(H) of the Land Development Code. RECOMMENDATION: Approval with the following conditions: 1. The applicant must plant three (3) additional trees that comply with Section 20-3.5(H)(C)(7) of the Land Development Code; 2. Mr. Trautman commented that the applicant was going to have a conflict with the depth of the balcony. He then suggested making the room smaller or extending the balcony that might have an impact on the facade, but if the wall is recessed there will be a structure configuration and the owner may not be pleased with having a smaller master bedroom. Mr. Chandler commented that the addition to the west elevation of the house is incongruent, where it looks like a majority of it is set behind the house and resembles a rear elevation. The applicant responded that the elevation has to be taken in the context that certain trees cover the front of the house. Mr. Chandler questioned why the width was limited and if there is a setback. Mrs. Cabrera- Hernandez commented that the lot width is 88' and the applicant is over the rear setback requirements, and the height of the building. Mr. Trautman questioned if the balcony could be moved enough to get the door to swing open. By doing so, would give the corner column a bit of animation. The applicant responded if the roof will blend the two masses together and its part of the owner's request. Mr. Rivera commented that the height of the building is exceeded by a foot or a foot and a half. Mr. Trautman commented that the height is at 25'. The applicant commented that the intent was to keep the ridge at 25' and work down from that and then they didn't know the criteria, but if the crown of the road is what is going to be used, the dimensions need to be altered because the crown of the road is at least 6 or 8 inches. Mr. Trautman commented the height of the building is ok. Mrs. Cabrera-Hernandez read the section 20-2.3 of the Land Development Code.
