_add-on b)Add-on b) Sponsored by Vice Mayor Welsh 12/19/17 City Commission Meeting RESOLUTION NO. ___________ 1 2 A resolution instructing the City Manager to provide assistance to the South 3 Miami Community Redevelopment Agency to draft an amendment to the 4 City’s Comprehensive Plan and the zoning of certain properties located west 5 of the MetroRail Transit Station, south of S.W. 70th Street, east of S.W. 61st 6 Court and north of S.W. 72nd Street to change the zoing to promote transit-7 oriented redevelopment and affordable housing within the South Miami 8 Community Redevelopment Area. 9 10 WHEREAS, the South Miami Community Redevelopment Agency ("SMCRA") has 11 adopted a resolution indicating that it will be the sponsor of a small-scale land use plan amendment 12 to change the land use designation of certain parcels located within the South Miami Community 13 Redevelopment Area from Mixed Use Commercial Residential (Four Story) to T.O.D.D. (4+4 14 Story) and to change the zoning of certain parcels located within the South Miami Community 15 Redevelopment Area from MO (Medium Intensity Office) to TODD MU -5 and to change the 16 zoning of certain other parcels located within the South Miami Community Redevelopment Area 17 from TODD MU-4 to TODD MU-5, a copy of which Resolution is attached hereto as Exhibit "A". 18 19 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 20 COMMJISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 21 22 Section 1.. The City Commission accepts the Resolution of the CRA and hereby 23 instructs the City Manager assist the SMCRA Board in its sponsorship of the land use plan 24 amendment and the zoning amendments authorized by the CRA Resolution by preparing city-25 initiated amendment documentation and by processing and expediting a small-scale land use plan 26 amendment to change the land use designation of certain parcels identified in the CRA Resolution 27 from Mixed Use Commercial Residential (Four Story) to T.O.D.D. (4+4 Story) and zoning 28 amendments to change the zoning of certain parcels identified in the CRA Resolution from MO 29 (Medium Intensity Office) to TODD MU-5 and to change the zoning of certain other parcels 30 identified in the CRA Resolution from TODD MU-4 to TODD MU-5. 31 32 Section 2. The City Manager is instructed to expedite the requisite notice(s) in order to 33 place the CRA sponsored, city-initiated applications before the City Commission and the Planning 34 Board for further action at their next available meetings. 35 36 Section 3. Severability. If any section clause, sentence, or phrase of this resolution is for 37 any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall 38 not affect the validity of the remaining portions of this resolution. 39 40 Section 4. Effective Date. CRA 83-17-1041 A resolution recommending that the City of South Miami amend the City’s Comprehensive Plan and rezone certain properties located west of the MetroRail Transit Station, south of S.W. 70 th Street, east of S.W. 61st Court and north of S.W. 72nd Street to the T.O.D.D. (4+4 Story) land use designation and the TODD MU-5 zoning district in order to encourage and promote transit - oriented redevelopment and affordable housing within the South Miami Community Redevelopment Area. WHEREAS, in 1978 Metropolitan Dade County adopted its Rapid Transit Zone ordinance providing that properties in close proximity to the Rapid Transit corridor as to have significant impact thereon would be subject to future development standards through a Station Area Design and Development (“SADD”) program; and WHEREAS, the South Miami SADD, adopted in 1980, identified an area immediately west of the South Miami MetroRail station in the blocks between S.W. 72 nd Street, S.W. 62nd Avenue and S.W. 69th Street as a significant commercial redevelopment area; and WHEREAS, the commercial redevelopment area identified in the South Miami SADD is included within the boundaries of the South Miami Community Redevelopment Area; and WHEREAS, said commercial redevelopment area includes (1) a few contiguous parcels that are currently zoned MO (Medium Intensity Office) and that have a comprehensive plan land use designation of Mixed Use Commercial Residential (Four Story)(the “MO Area”); and (2) a few contiguous parcels that are bisected by the TODD MU-4 and TODD MU-5 zones and that have a comprehensive plan land use designation of T.O.D.D. (4+4 Story) (the “TODD MU-4 Area”); and WHEREAS, with the exception of the MetroRail station to the east and Larkin Hospital to the northwest, the MO Area and the TODD MU-4 Area are surrounded by properties, including City Hall, that are zoned TODD MU-5 and have a land use designation of T.O.D.D. (4+4 Story); and WHEREAS, in 2005 the City adopted the Community Redevelopment Area Phase II Plan Supplement (the “CRA Plan”) which noted that zoning of the MO Area was inconsistent with the City’s comprehensive plan because it did not permit residential development, and, in the Recommended Action Plan stated that the City should process land use amendments and zoning applications to eliminate inconsistencies as part of the 2005 -06 EAR-based amendments; and WHEREAS, Section 163.3202(1), Florida Statutes, provides that each city must adopt or amend land development regulations that are consistent with and implement its adopted comprehensive plan; and Res. No. CRA 83-17-1041 Page 2 of 3 WHEREAS, the City’s comprehensive plan incorporates Goals, Objectives and Policies requiring the elimination of inconsistencies with the comprehensive plan, discouraging urban sprawl, promoting growth in the area around the MetroRail station, increasing the tax base with new development and redevelopment, expanding Transit Oriented Development Districts ("TODD"), revitalizing redevelopment areas, implementing the Community Redevelopment Area ("CRA") Plan, providing adequate supply of affordable housing, and addressing affordable housing and redevelopment in CRA area; and WHEREAS, the City has not rezoned the MO Area to bring it into consistency with the City’s comprehensive plan pursuant to state statute; has not implemented the Goals, Objectives and Policies of the comprehensive plan as stated above with regard to the MO Area and the TODD MU-4 Area; and has not implemented the Recommended Action Plan of the CRA Plan regarding the MO Area; and WHEREAS, it is the mission of the SMCRA to improve the documented slum and blighted conditions within the Community Redevelopment Area by using redevelopment tools and incentives to promote affordable housing and foster economic development; and WHEREAS, the inconsistency between the MO Area's zoning and land use designation, the dual zoning of the lots in the TODD MU-4 Area and the incompatibility of the MO Area and the TODD MU-4 Area with the surrounding TODD MU-5 zoned properties hamper the attainment of the goals of both the City's comprehensive plan and the CRA Plan; further, those anomalies thwart redevelopment as envisioned by the CRA Plan, that is, redevelopment that would provide well-designed, transit oriented developments which incorporate affordable housing and enhance economic development for the benefit of the community. NOW, THEREFORE, BE IT RESOLVED BY THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: 1. The South Miami Community Redevelopment Agency Board will be the sponsor of a small-scale land use plan amendment to change the land use designation of the MO Area from Mixed Use Commercial Residential (Four Story) to T.O.D.D. (4+4 Story). 2. The South Miami Community Redevelopment Agency Board will be the sponsor of zoning amendments to change the zoning of the MO Area from MO (Medium Intensity Office) to TODD MU-5 and to change the zoning of the TODD MU-4 Area to TODD MU-5. 3. The South Miami Community Redevelopment Agency Board urges the City Commission of the City of South Miami to instruct the City Manager and the Planning and Zoning Department at the next regularly scheduled City Commission meeting to assist the South Miami Community Redevelopment Agency Board in its sponsorship of the land use plan amendment and the zoning amendments authorized by this Resolution by preparing city agency-initiated amendment documentation and in processing and expediting a small-scale land use plan amendment to change the land use designation of the MO Area from Mixed Use Commercial Res. No. CRA 83-17-1041 Page 3 of 3 Residential (Four Story) to T.O.D.D. (4+4 Story) and zoning amendments to change the zoning of the MO Area from MO (Medium Intensity Office) to TODD MU-5 and to change the zoning of the TODD MU-4 Area to TODD MU-5. 4. The South Miami Community Redevelopment Agency Board urges the City Commission of the City of South Miami to consider adopting incentives to encourage the inclusion of affordable housing in multi-family and mixed use projects, which incentives may include but would not be limited to subsidies, including the use of TIF revenues as affordable housing subsidies within the Community Redevelopment Area, and incentives such as citywide bonuses in height and floor area in areas where increased intensity of development would not adversely and directly impact single family homes. 3. This resolution shall take effect immediately upon its adoption. PASSED AND ADOPTED this 11th day of December, 2017.
