8ORDINANCE NO. ______ _ An Ordinance relating to the year 2018 General Election of the Mayor and City Commissioners for Groups, I and IV; scheduling the day, place and time of the election; scheduling the day, place and time of early voting; providing for qualification of candidates; providing for close of election books; approving the sample ballot; providing for notification. WHEREAS, Article V, Section 2A, of the City of South Miami Charter provides that the City Commission of the City of South Miami shall schedule a general election for February of each even year, and that the Mayor shall be elected for a term of two (2) years and commissioners shall be elected for terms of four (4) years at the general election; and WHEREAS, Article V, Section 2D, of the City of South Miami Charter provides that no person may appear on the Ballot for Election as Mayor or City Commissioner if, by the end of his or her current term of office, the person will have served (or, but for resignation would have served) in office as the Mayor or as a City Commissioner for a total of nine years or more; and WHEREAS, the Charter requires the City Commission of the City of South Miami to schedule the day, place and time of the general election by ordinance; and WHEREAS, state law requires election books to close twenty-nine (29) days prior to the election. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The 2018 General Election will be held on Tuesday, February 13, 2018. On that date, a mayor will be elected to serve a term of two (2) years, and two (2) Commissioners, one from Group I and one from Group IV, will be elected to serve a term of four (4) years. Early voting shall occur on Saturday, February 10,2018, from 9:00 a.m. through 5:00 p.m. Section 2. The qualifying period for this election shall open Monday, December 4, 2017 and close Thursday, December 14, 2017 (excluding weekend), from 9:00 a.m. through 5:00 p.m. sharp each day. Candidates shall qualify at the office of the City Clerk, 6130 Sunset Drive, South Miami, Florida. Page 1 of2 Section 3. Voting shall be conducted at City Hall in the City Commission Chamber, 6130 Sunset Drive, South Miami, Florida. The polls shall open precisely at 7:00 a.m. and close precisely at 7:00 p.m. Section 4. The sample ballot for the 2018 general election is annexed to this ordinance. Section 5. The election books shall close Tuesday, January 16,2018. Section 6. The City Clerk shall publish notice of such general election once a week for four consecutive weeks next preceding the general election in a newspaper of general circulation in South Miami. The notice shall contain the date, time, and place of the general election and identify the Commission Groups. Section 7. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 8. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed. Section 9. This ordinance shall take effect immediately upon enactment.
