A Resolution authorizing a temporary change in the permitted hours of
construction operations of Florida Power & Light (FPL) to perform work on SW
68th Street, between SW 5ih Avenue and SW 58th Place.
Ordinance No. 5-15-2212 prohibits construction activity to take place during
night hours from 6:00 PM though 7:00 AM. FPL is transferring / replacing
existing underbuilt facilities to newly installed replacement poles, the removal of
the replaced poles and restoration of the construction areas.
The electrical demands are higher during the day and the transmission lines need
to be de-energized in order to work them safety. Due to the high electrical
demands during the day, the only time a clearance on these circuits is granted is
during the evening and early morning hours when electrical demands are at their
lowest. Based on the aforementioned, FPL is requested a waiver, to allow them
to work during night hours between 9:00 PM to 6:00 AM and from Monday
evenings to Thursday evenings. A "no construction" moratorium will be in effect
between December 20,2017 thru January 3,2018.
REQUEST: The Resolution attached is to waive the limitation on hours of construction, as
authorized by the Ordinance. The work will be schedule between November 13,
2017 and February 17,2018, between the hours of 9:00 PM to 6:00 AM and from
Monday evenings to Thursday evenings.

8 WHEREAS, Pursuant to Section 7-16(g) of Code of the Ordinances, all construction sites
9 shall comply with the city's noise code and it provides in pertinent part as follows:

11 All construction sites shall comply with the city's noise code. Construction activity is limited to
12 the hours of 7:00 a.m. through-6:00 p.m. on the weekdays of Monday thru through Friday; and
13 between the hours of 9:00 a.m. through 5:00 p.m. on Saturday. No construction activity is
14 permitted on Sunday. Notwithstanding the above, no construction activities shall take place in,
15 or within 500 feet of, residentially zoned districts, other than those in the Hometown District,
16 on either Saturday or Sunday and, as to construction activities in non-residentially zoned
17 districts and in the Hometown District, all days of the week and hours of the day may be
18 changed by resolution of the City Commission upon a finding of extraordinary circumstances.

20 WHEREAS, FPL wishes to perform work along SW 68th Street, between SW 5ih Avenue
21 and SW 58 th Place to replace existing transmission line concrete poles; and

42 Section 1: The recitals set forth above have been found to be true and they are hereby
43 incorporated by reference as if fully set forth herein and the City Commission hereby
44 determines that these circumstances represent extraordinary circumstances. The construction
45 hours are hereby changed temporarily for the current construction activities of FPL between
46 November 17, 2017 and February 17, 2018, from the date of permit issuance or until such time
47 as the City Commission or the City Manager revokes these extended hours of operation. The

temporary hours of construction pperations are limited to the hours of 9:00 PM to 6:00 AM.
The contractor shall hire, at their own expense, an off duty City of South Miami Police officer
for these days and during these hours to insure that the FPL complies with the City's ordinances
and this resolution. A "no construction" moratorium will be in effect between December 20,
2017 thru January 3, 2018, which will include FPL's work. The extended hours for construction
activity authorized by this Resolution may also be reduced or revoked upon determination of
the City Manager in his sole and absolute discretion that a violation of any of the City's
ordinance or this Resolution has occurred and has not been resolved to his satisfaction or that,
in the City Manager's sole and absolute opinion, the noise level is otherwise excessive. This
resolution may be revoked at any time in the sole and absolute discretion of the City
Commission.
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this resolution.
Section 3. Effective Date. This resolution shal.1 become effective immediately upon
adoption by vote of the City Commission.

Due to Distribution line clearances available only during nighttime and early morning hours, Florida
Power and Light Company respectfully request a resolution to waive the limitation on hours of
construction and to authorize nighttime hours for the proposed Gonstruction.
The location is along SW 68 th St between SW 57 th Ave and SW 58th Place. The proposed cbnstru,ction is
to facilitate the transfer of Distribution underhuiIt facilities to newly instaUedreplacement
poles; the removal of the replaced poles,ahd includes the restoration of the construction areas and
any sidewalks damaged. Traffic control-will conform to FDOT's Roadway and Traffic Control
Standards. FPl would not be working on weekends, only from Monday evenings to Thursday evenings. The
transmission crews anticipate worldng f!om the week of Nov 13th to the week of February 17th •

An Ordinance amending Section 7-16. (g) of the Code of Ordinances of the
City of South Miami in pertinent part to provide for Commission approved
change in construction days and hours of operation.
WHEREAS, from time to time a project that will benefit the City of South Miami may,
due to extraordinary circumstances require work to be performed on Sundays and earlier than
9:00 a.m. on Saturdays and
WHEREAS, the Mayor and the City Commission desire to provide for more flexibility
under extraordinary circumstances for changing the days and hours of permissible work.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Section 7-16. (g) of the Code of Ordinance of the City of South Miami is
hereby amended in pertinent part to read as follows:
Sec. 7-16. -Pre-construction and construction standards for sites. .. .. ..
(g) All construction sites shall comply with the city's noise code. Construction
activity is limited behveen !!Lthe hours ffem of 7:00 a.m. through-6:00 p.m.,on the
weekdays of Monday tBm through Friday; and between the hours of 9:00 a.m. through
5:00 p.m. on Saturday.hours shall be from 9:00 a.m. to 5:00 p.m. No construction activity
is permitted on Sunday. Notwithstanding the above, no construction activities shall take
place in, or within 500 feet of, residentially zoned districts, other than those in the
Hometown District, on either Saturday or Sunday and, as to construction activities in
non-residentially zoned districts and in the Hometown District, all days of the week and
hours of the day may be changed by resolution of the City Commission upon a rmding of
extraordinary circumstances.
Section 2. Codification. The provisions of this ordinance shall become and be made
part of the Code of Ordinances of the City of South Miami as amended; that the sections of this
ordinance may be renumbered or re-Iettered to accomplish such intention; and that the word
"ordinance" may be changed to "section" or other appropriate word.
Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is
for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding
shall not affect the validity of the remaining portions of this ordinance.
Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.
However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances,
that give the appearance of being in conflict when the two ordinances can be harmonized or
when only a portion of the ordinance in conflict needs to be repealed to harmonize the
ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby
amended to harmonize the two ordinances. Therefore, only that portion that needs to be repealed
to harmonize the two ordinances shall be repealed.

1.2. Two (2) sets of plans, sketches and other documentation that is required to describe the proposed work
adequately. Engineering design plans shall be Signed and sealed by Professional Engineer.
1.2.1. It is advised that the plans, sketches and other documentation be done according to acceptable
engineering standards.
1.2.2. Maintenance of traffic (MOl) plan shall be submitted when there is any impediment to vehicular and/or
pedestrian traffic.
1.2.3. The impediment to vehicular or pedestrian traffic shall require that the applicant notifies the City of
South Miami Police Department about the work upon receiving the permit, which is also specified in
the Permit Conditions that are attached to the permit.
1.3. Documentation that proves that the following are current (copies are acceptable):
1.3.1. County or State Ucense;
1.3.2. Certificate of Insurance, naming the City of South Miami as additional holder;
1.3.3. Performance Bond and/or Letter of Credit (pB/LoC) in the amount of 100% of the estimated total cost
of the proposed construction work within the right-of.way. Note that per Resolution 05-05·11984,
PBlLoC shall remain in effect for at least 6 months after the work is accepted by the City.
1.4. The submission can be made in person, by mail, or by e-mail.
P> City of South Miami Public Works and Engineering Department (CSM PWED) shall accept the permit application.
~ CSM PWED shall notify the applicant about any missing items and/or other deficiencies at the submission time and/or while the
permit application is in review.
2. APPLICANT shall correct any notified deficiencies in order for CSM PWED to continue the review.
2.1. Otherwise, the permit application may be disapproved.
~ CSM PWED, upon the review of the permit application, as modified according to the above (if any), will issue the "City of South
Miami Payment Due Selection" form to the applicant.
3. APPLICANT, upon receiving the "City of South Miami Payment Due Selection" form from CSM PWED shall do the
following:
3.1. Pay the permit fee at the City of South Miami Finance Department, 6130 Sunset Drive, South Miami, FL 33143
(phone 305 663 6343). Note that it is necessary to submit the "City of South Miami Payment Due Selection"
form to Finance Department because it contains permit number and fee amount
3.2. Upon payment of the permit fee, the applicant shall sign the Permit Conditions at the CSM PWED and pick up
the permit, as approved. .
Upon fulfillment of the above two requirements by the applicant, the permit will become valid. It is to be noted
that the actual time when the permit will become valid is the time when payment of the permit fee is recorded
by Finance Department.
3.3. APPLICANT shall have the approved Permit Application for Work Within the Public Right·of·Way form,
Permit Conditions and the plans, sketches and other documentation at the construction site all the time.

1. Permit for construction work shall be on project site at all times.
2. Permits are valid for a period of six months from the date of issuance. If work is not complete before
permit expiration (six months), a permit extension can be applied for, before the permit expires.
Otherwise, a new permit application will be required for work on the right of way to be performed.
A new permit application will be required ifthe permit expires. It is the sole responsibility of the
contractor to apply for an extension at the PWoffice.
3. All materials and labor under the project shall be in strict accordance with the requirements of the City of
South Miami, Miami-Dade County, and all other local, state, and national codes, where applicable.
4. All construction shall be performed in a sate manner In accordance with the rules and regulations of the
OccupationaLSafety and Health Administration (OSHA).
5. Contractor shall notify the City of South Miami Public Works Department (CSM PW) forty"eight hours (48)
prior to commencing work and Coordinate with South Miami Police for the MOT.
6. Contractor shall notify any affected property owners prior the permitted work starts.
a. In case when the work will disturb the traffic on the only accessing roadway, contractor is to
notify all property owners who have properties in between the access points on that roadway.
b. Egress and ingress shall remain accessible to each property.
7. During construction, the project site and all adjacent areas shall be secured and maintained in a neat anq
clean manner.
--.--8. Traffic shall be maintained in accordance with Florida Department of Transporta.tjpr1'(FDOT) Maintenance
ofTraffic (MOT) standards, Miami-Dade County standards, Manual of UnifoJm-Traffic Control Devices
(MUTCD) and any additional requirements by the CSM PW and Police Department.
a. If a full or partial road closure is required, a MOT must be submitted and approved by CSM PW
and City of South Miami Police Department (CSM PD). No street shall be closed without written
authorization.
b. Any pedestrian MOT shall be per FDOT Standard Index 660.
c. Applicant shall coordinate the schedule of the MOT with the CSM PD. Chief of police and/or CSM
PD may be reached at 305-663-6301. Any directions by CSM PD, before, during and/or after the
work is being performed, shall be followed by the applicant, workers and/or any other involved
party.

d. Access for local traffic shall be maintained at all times.
9. If the work will obstruct parking of vehicles at the street paid parking spaces, the applicant shall pay the
daily parking fees for each of the obstructed paid street parking spaces.
10. No material or equipment shall be staged in the public R/W overnight unless specifically authorized by the
Department.
11. All pavement open-cut during permitted work shall be temporarily restored with asphalt or steel plates at
the end of each workday. NO TRENCHES OR PITS SHALL BE LEFT OPEN OVERNIGHT. Permanent asphalt
restoration shall occur within 14 days of open-cut.
12. Contractor shall conduct daily dust control and implement storm water erosion and sediment control
measures for pollution prevention.
13. Any damage to private p~operty shall be restored to its original condition or better and as accepted by the
owner.
14. Disturbed areas shall be restored to equal or better condition than they were before the work started.
The restoration shall include the following:
a. Road/pavement areas shall be restored at least 5' from the edges of disturbed areas and as per
the City of South Miami Standard Details for Pavement Restoration.
b. Sidewalk panels shall be replaced, i.e., the sidewalk shall be restored in full width.
c. Landscaped areas, including and not limited to grass,.sod, shrubs and trees replacement, shall be
fully restored.
d. For intersections with pavers, the full intersection shall be restored regardless of the size of the
disturbed area.
15. If all restoration work is not performed within 30 days of work completion, the CSM PW may restore the
work area and charge the applicant for the cost of restoration plus a minimum of 15% for administrative
fee and any additional incidental fees.
16. All utility location markings within the right-of-way shall be removed before project closeout.
17. All rims of manholes and water valves shall be at grade when repair is finished.
18. Work is not permitted on Saturdays, Sundays and Holidays. Work is only allowed from 8 am to 5 Pn:),.
unless otherwise authorized.

"Trees cannot be removed/relocated without approval from City of South Miami Planning Department and Public Works
Department"
I received today the package with the check for $3,200 but it does not include the surcharges. Keep in mind payment is
not determined until the permit is approved and entered into our system.
Please send the revisions at your earliest convenience so we may process the permit.

As discussed, please find below the following comments. Also attached is the permit fees calculation for your review.
1. Comments to the General Notes
2. Please advise what other utilities are connected to the poles and what is the mechanism to ensure they will
remove within 60 days. We have some locations were it has taken way over 60 days to remove the old poles
and it prohibits for AOA access
3. Are the trees at B2ABB and 89AI0 going to be removed/relocated/trimmed? Include this in the note and to
contact the City of South Miami Arborist at the Parks and Recreation Department
4. Please provide the release from the private property owner.
