Ordinance No. 5-15-2212 prohibits construction activity to take place during night hours from 6:00 PM though 7:00 AM. FPL is transferring / replacing existing underbuilt facilities to newly installed replacement poles, the removal of the replaced poles and restoration of the construction areas. The electrical demands are higher during the day and the transmission lines need to be de-energized in order to work them safety. Due to the high electrical demands during the day, the only time a clearance on these circuits is granted is during the evening and early morning hours when electrical demands are at their lowest. Based on the aforementioned, FPL is requested a waiver, to allow them to work during night hours between 9:00 PM to 6:00 AM and from Monday evenings to Thursday evenings. A "no construction" moratorium will be in effect between December 20,2017 thru January 3,2018. REQUEST: The Resolution attached is to waive the limitation on hours of construction, as authorized by the Ordinance. The work will be schedule between November 13, 2017 and February 17,2018, between the hours of 9:00 PM to 6:00 AM and from Monday evenings to Thursday evenings. Construction activity is limited to 12 the hours of 7:00 a.m. through-6:00 p.m. on the weekdays of Monday thru through Friday; and 13 between the hours of 9:00 a.m. through 5:00 p.m. on Saturday. No construction activity is 14 permitted on Sunday. A "no construction" moratorium will be in effect between December 20, 2017 thru January 3, 2018, which will include FPL's work. The extended hours for construction activity authorized by this Resolution may also be reduced or revoked upon determination of the City Manager in his sole and absolute discretion that a violation of any of the City's ordinance or this Resolution has occurred and has not been resolved to his satisfaction or that, in the City Manager's sole and absolute opinion, the noise level is otherwise excessive. This resolution may be revoked at any time in the sole and absolute discretion of the City Commission. Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. WHEREAS, from time to time a project that will benefit the City of South Miami may, due to extraordinary circumstances require work to be performed on Sundays and earlier than 9:00 a.m. on Saturdays and WHEREAS, the Mayor and the City Commission desire to provide for more flexibility under extraordinary circumstances for changing the days and hours of permissible work. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. Section 7-16. (g) of the Code of Ordinance of the City of South Miami is hereby amended in pertinent part to read as follows: Sec. 7-16. -Pre-construction and construction standards for sites. .. .. .. Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances, that give the appearance of being in conflict when the two ordinances can be harmonized or when only a portion of the ordinance in conflict needs to be repealed to harmonize the ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby amended to harmonize the two ordinances. In case when the work will disturb the traffic on the only accessing roadway, contractor is to notify all property owners who have properties in between the access points on that roadway. b. Egress and ingress shall remain accessible to each property. 7. During construction, the project site and all adjacent areas shall be secured and maintained in a neat anq clean manner. --.--8. Traffic shall be maintained in accordance with Florida Department of Transporta.tjpr1'(FDOT) Maintenance ofTraffic (MOT) standards, Miami-Dade County standards, Manual of UnifoJm-Traffic Control Devices (MUTCD) and any additional requirements by the CSM PW and Police Department. a. If a full or partial road closure is required, a MOT must be submitted and approved by CSM PW and City of South Miami Police Department (CSM PD). No street shall be closed without written authorization. b. Any pedestrian MOT shall be per FDOT Standard Index 660. c. Applicant shall coordinate the schedule of the MOT with the CSM PD. Access for local traffic shall be maintained at all times. 9. If the work will obstruct parking of vehicles at the street paid parking spaces, the applicant shall pay the daily parking fees for each of the obstructed paid street parking spaces. 10. No material or equipment shall be staged in the public R/W overnight unless specifically authorized by the Department. 11. All pavement open-cut during permitted work shall be temporarily restored with asphalt or steel plates at the end of each workday. NO TRENCHES OR PITS SHALL BE LEFT OPEN OVERNIGHT. Permanent asphalt restoration shall occur within 14 days of open-cut. 12. Contractor shall conduct daily dust control and implement storm water erosion and sediment control measures for pollution prevention. 13. Any damage to private p~operty shall be restored to its original condition or better and as accepted by the owner. 14. Disturbed areas shall be restored to equal or better condition than they were before the work started. The restoration shall include the following: a. Road/pavement areas shall be restored at least 5' from the edges of disturbed areas and as per the City of South Miami Standard Details for Pavement Restoration. b. Sidewalk panels shall be replaced, i.e., the sidewalk shall be restored in full width. c. Landscaped areas, including and not limited to grass,.sod, shrubs and trees replacement, shall be fully restored. d. For intersections with pavers, the full intersection shall be restored regardless of the size of the disturbed area. 15. If all restoration work is not performed within 30 days of work completion, the CSM PW may restore the work area and charge the applicant for the cost of restoration plus a minimum of 15% for administrative fee and any additional incidental fees. 16. All utility location markings within the right-of-way shall be removed before project closeout. 17. All rims of manholes and water valves shall be at grade when repair is finished. 18. Work is not permitted on Saturdays, Sundays and Holidays. Work is only allowed from 8 am to 5 Pn:),. unless otherwise authorized. 19. Call 811 prior to digging.
