4 An Ordinance pursuant to Section 20-5.7 providing for a Map Amendment to the City of South
5 Miami Official Zoning Map to remove the Hometown District Overlay designation on a 9.68-
6 acre property known as The Shops at Sunset Place.

8 WHEREAS, FRIT Shops at Sunset Place LLC has requested an amendment to the Official Zoning
9 Map to remove the Hometown District Overlay designation of the approximately 9.68-acre Shops at
10 Sunset Place property located southeast of US1, north of sw nnd Street between SW 57 th Avenue and SW
11 58 th Avenue; and

13 WHEREAS, the Local Planning Agency reviewed the proposed amendment to the Official Zoning
14 Map, held an advertised public hearing on October 26, 2017, provided for public participation in the
15 process and rendered its recommendation of approval to the City Commission on a vote of 6-1.

17 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
18 SOUTH MIAMI, FLORIDA AS FOLLOWS:

20 Section 1. The City of South Miami hereby adopts an amendment to the Official Zoning Map, as
21 set forth in the illustration below, removing the Hometown District Overlay (HD-OV) designation for The
22 Shops at Sunset Place property located between SW 57 th and 58 th Avenues and, SW n Street and US1,
23 located at 5701 SW 72nd Street and more specifically legally described in the attached Exhibit 1.

3 Section 2. Codification. The provisions of this Ordinance shall become and be made part of the
4 Official Zoning Map ofthe City of South Miami as amended.

6 Section 3. Severability. If any section, clause, sentence, or phrase of this Ordinance is for any
7 reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect
8 the validity ofthe remaining portions of this Ordinance or the Guidelines adopted hereunder.

10 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts
11 of sections of ordinances in direct conflict herewith are hereby repealed.

13 Section 5. Effective Date. This Ordinance shall be conditioned on the enactment of an Ordinance
14 creating Downtown SoMi (DS) zoning district and an Ordinance amending the Official Zoning Map
15 designation for The Shops at Sunset Place property from Specialty Retail (SR) to Downtown SoMi (DS)
16 district and shall become effective immediately after the enactment of those ordinances.
